Consumer Complaint: MIDLAND CREDIT MANAGEMENT , INC. are attempting to sue me for a debt. The company has used unfair, and unconscionable means to collect or attempt to collect debts. The company did not present the original contract. Pursuant to 15 USC 1692 ( I ) ( b ) : Authorization of actions : nothing in this sub chapter shall be construed to authorize the bringing of legal actions by debt collectors. This debt collector has placed derogatory items on my consumer credit report and participated in identity theft regarding my information. I have never given this company direct consent to obtain any of my information. The company had its attorneys reach out to me in which no remedy was given. Pursuant to 15 USC 1692 ( e ) ( 3 ), attorneys are of false representation. However, my instruction for remedy was not completed properly. Both companies have violated the TILA, FDCPA and FCRA. I would like remedy and this matter to be resolved immediately.

Consumer Complaint: On three separate occasions i sent debt validation letters to Midland Credit Management, the FCDPA has outlined laws regarding debt validation letters, and part of it states that once a creditor recives a debt validation letter, ALL ATTEMPTS TO COLLECT A DEBT MUST CEASE UNTIL THE DEBT IS VALIDATED, AND THEY CAN NOT DIRECTLY OR THROUGH THIRD PARTY CONTACT OU. in my matter midland credit has circumvented the process by taking civil action against me. This is deemed as a third party attempt in that midland is seeking to have the courts to order me to pay the debt.

I used to have a XXXX XXXX account bout 10 years ago, limit was round $ XXXX, I never had a credit with a limit that high. I closed the account because of fraud and identity theft issues that kept happening. I have no knowledge of the balance/account they are saying I'm being sued for.

There was no valid contract between me and Midland Credit Management Inc. They have not file suit in the state of Virginia in the XXXXXXXX XXXX XXXXXXXX, VA the amount of {$1000.00}. I wasn't properly served the Debt in Warrant paperwork and not being forced to go to court for a debt I do not owe to Midland Credit Management Inc. Please be further advised, I dispute the validity of the alleged debt in its entirety. Further I request verification of the alleged debt, including, the name and address of the original creditor, along with a copy of a signed contract with the creditor. Additionally any attempts to harm my credit history and rating by updating or changing dates after you have been informed that the debt is expired, is a direct violation of the FDCPA. During the call I denied the obligation as it was described to me and requested to receive documents regarding same by mail. On XX/XX/XXXX, I received a collection document from MCM ( account number XXXX ) identifying the purported creditor ( XXXX XXXX-XXXX XXXX ) the purported amount ( {$1700.00} ) and the debtor address ( XXXX XXXX XXXX XXXX, XXXX, PA, XXXX ). None of which I had anything to do with and all of which were news to me. This letter was sent to me at my current residence address XXXX XXXX XXXX, XXXX, Tennessee, XXXX and forwarded to me at a temporary address in New York. That same day, I responded to MCM ( letter attached ) categorically denying the obligation to be mine and requested MCM send me documents or other information upon which it was relying to falsely claim the obligation was mine. I have received none of the requested materials. On XX/XX/XXXX, I received a collection document from MCM offering to discount the amount owed if paid in full. That same day I responded to MCM ( letter attached ) repeating my denial and request for documents or other information supporting its false claim. Consumer Complaint: The problem that I'm having with this company is that whenever I try to make a settlement with them because I can't afford the offers that they're giving me they always act mean and mess around with me acting like they care ( sarcastically ) while I can tell that they're saying in a sarcastic way that they're trying to help me, and they also come up with a lot of nonsense stuff when I'm just trying to see if they can accept what I have or what they can do on this account. Last call that I made I asked if I could just speak to the manager to see if he could help me any further and they just put me on hold for a long time and then the call dropped, I don't know if it was them messing with me or the call did drop since I have no evidence but of what I'm sure is that they really had no intention of helping me like they said on their sarcastic way of speaking because what you less expect when you are the most stressed about your financial situation is dealing with people like this that really don't care about you and feel like they could treat you however they want.

The first one I was told to call XXXX XXXX XXXX XXXX., " your accounts have been referred to a XXXX XXXX XXXX XXXX. Please call them at ( XXXX ) XXXX ext. XXXX to assist in reaching a resolution of your account balances '' Well I did call like they stated and of course I got the run around AGAIN. Why? So now I have spend my time doing another complaint against them. When I call I get told that I have to transfer to another department why? when I was told to call that number to resolve my issues. I feel they are playing games with me. This is so unprofessional and rude all at the same time.
