Consumer Complaint: In XXXX I enrolled into a debt counseling program. I gave them all my credit info. And never opened any new accounts due to wanting to get out of debt. In XXXX or XX/XX/XXXX I received a call from the debt counseling company asking if I wanted to add the new debt of XXXX. I advised them i never opened any new credit cards nor had I had any new debt. They gave me the number of the company claiming I owe them XXXX. I called the number which was Midland credit management XXXX XXXX XXXX. They would not.give me any information on the account I told.them I never opened an account with them and wanted to know who opened the account. They just kept transferring me over and over. Never giving me any information just wanting to collect money from me. So I ignored this fraud claim thinking they got the hint I was not going to pay them any money. So, today I checked my free credit report and noticed this company is on my credit report it had the date the card was opened how much is due. So I called them again to let them know I never opened this account and asked for information on who opened the account and again I was transferred over again. Also, when I call they answer the phone as if they were home and not.in a professional setting. I dont know what to do and how to dispute this fraud. Any help would be greatly appreciated. XXXX

XXXX and XXXX the attorney 's for Midland Funding got a Final Judgement for me XXXX XXXX XXXX to pay the debt in which there is no contract that I XXXX XXXX XXXX does not have. The final Judgement was on XX/XX/XXXX in XXXX XXXX County so called " Court '' of the XXXX XXXX XXXX in and For XXXX County. A Delegation of Authority Order was never shown forth by XXXX XXXX XXXX. I am moving this case to XXXX Court. This is the 2nd time I had to file a complaint against Midland Funding LLC. The number of the first complaint I filed with the XXXX XXXX XXXX XXXX was XXXX.

Consumer Complaint: Midland Credit Management , Inc has been calling and harassing me for weeks. I have sent them a cease and desist letter multiple times, the last one by certified delivery via XXXX with a signature required and tracking showing it was delivered. This company has called me multiple times a day, every time they call its from random phone numbers. Its never the same number, when I answer the first thing they say is Dont hang up or you will be sued. - they have also sent me multiple letters threatening to sue me for a balance that they have yet to very that I owe. I submitted to them in writing a denial of debt letter and a request for verification and proof of debt, they have refused to respond to. They continue to send me threatening letters indicating they are going to file a lawsuit as well as indicating that my credit will be impacted by such lawsuit. If I refuse to provide them with my personal information over the phone they immediately hang up on me. This company has been harassing me for months!

Midland has entered their own arbitrary date which incorrectly reflects the 7 year statute of limitations. Midland has also failed to provide proof of account ownership from XXXX XXXX custodian of records. They only offer copies of the last few statements with an existing balance, a balance not indicated as to when the purchase was made or last date of payment activity - only " existing balance '', which I refuse to accept as proof of ownership.
