Issue: Written notification about debt
Subissue: Didn't receive enough information to verify debt
Consumer Complaint: Midland is reporting in my credit file however it is inaccurate because it was said to be late, yet all the payments are OK. I do not think that this is mine. I did my research on what to do because it is affecting my scores to badly, I asked for documents, disclosure and where did the account come from but they failed to provide me, so I came online and researched. The plaintiff is asking the same thing that I wanted and at the end of it all the plaintiff won this case. I am talking about the Texas VS Midland Funding Case. I have learned that Midland claims to have a disclosure and an agreement that there is a Consumer Agreement for all who they are collecting from. I guarantee you that there is no such thing that I have agreed upon to.

Consumer Complaint: On XX/XX/2021 I wrote a letter to Midland Credit management requesting validation for an account they have listed on my credit report, I specifically asked for validation bearing my signature showing that I have ( or had ) some contractual obligation to pay them. I also requested that if validation was not provided removal of all entries to the credit agencies must stop pending the out come of the investigation. As of XX/XX/2021 the validation has not been provided, Midland continue to report to the credit agencies which is a violation of the Fair Debt Collection Practice as well as the Fair Credit Reporting Act, I'm respectfully seeking your assistance in resolving this matter. I need your help!

Subissue: Debt was result of identity theft
Consumer Complaint: Because Midland Credit contacted me regarding a fraudulent account back in XX/XX/2020, I have written a letter to the company explaining that the account was fraudulent. I included a police report and FTC identity theft report with the letter. I requested proper validation to be processed and provided documents that were used for the validation. Since then, I did not receive any types of communication from Midland Credit Management. It was shocking for me when I received a letter from the court stating the Midland Credit Management is attempting to make a lawsuit against me for the same debt that they contacted me initially. I specifically stated that the account from XXXX XXXX is a fraudulent account that had been involved with identity theft and requested verification and validation to be processed. Midland Credit Management completely ignored my statement and supporting documents and falsely attempting to collect the debt that is fraudulent. I will include a letter that was submitted on XX/XX/2020 with the original copies of the police report and FTC identity theft report.

Consumer Complaint: Midland Funding Account # XXXX asserted collection for XXXXXXXX XXXX for {$560.00}. This collector continues to report inaccurate information, that is known to them as inaccurate. Midland Funding is " recycling '' asserted debt, passed delinquency date in effort to oppress consumers financial standing by exceeding the retention date. Historically, Midland Funding has changed the payment history for the purpose of extending the retention date within consumers credit file. In review of my XX/XX/XXXX report and my XX/XX/XXXX XXXX Credit file reveals Midland Funding extending this reporting time by an additional 2 years. The actions of this collector is reckless, targeted, and with malice intent.

Consumer Complaint: I recently filed a report with XXXX, XXXX, and XXXX of inaccurate items being reported on my credit reports. XXXX and XXXX removed the above mentioned item once an FTC Report and documents to verify my identity were sent. XXXX did not. Failure to delete items that were disputed as debts which resulted from identity theft is a violation of The Federal Fair Credit Reporting. I never received notification of these debts on my credit reports. This is a defamation of character and misrepresentation of my true credit worthiness. I recently applied for a loan and was denied due to inaccurate information being report on my credit reports. I am exercising my right as a consumer who is a victim of identity theft. I ask that these accounts be deleted within 15 days of these receipt otherwise I will be forced to file a litigation explicitly stating your companys negligence to abide by the Fair Credit Reporting Act and Fair Debt Collection Practices Act.
