Consumer Complaint: Company : Midland Credit Management Date contacted : XX/XX/22 Representative I spoke with : XXXX XXXX ( XXXX ) XXXX My checks at work started to be garnished without notice on XX/XX/22 and I looked on my credit report to find the debt. I assumed it was MCM and contacted them. I explained my situation that my checks were being garnished at work and I was not able to pay my bills nor live off of the wages they were leaving me with as I have XXXX kids under XXXX y/o. The representative falsified information in order to receive my bi-weekly payments. XXXX XXXX stated that if I set up a payment plan the garnishment would stop. The garnishment was not through MCM and she lied to me to receive my payments. I am now paying via XXXX from my bank account that I can not afford. On 3 accounts = {$200.00} every other week. And my checks are still being garnished!

Consumer Complaint: To whom it may concern MIDLAND CREDIT MANAGEMENT you are in violation of the FDCPA you are in violation of my consumer protection rights as a federal protected consumer remove this account that you have on a consumer from all three major credit bureaus immediately XXXX, XXXX, XXXX Pursuant to 15 U.S. Code 1692a Definitions The term " debt collector '' means any person who uses any instrumentality of interstate commerce or the mails in any business the principal purpose of which is the collection of any debts, or who regularly collects or attempts to collect, directly or indirectly, debts owed or due or asserted to be owed or due another. Notwithstanding the exclusion provided by clause ( F ) of the last sentence of this paragraph, the term includes any creditor who, in the process of collecting his own debts, uses any name other than his own which would indicate that a third person is collecting or attempting to collect such debts. Consumer Complaint: Today XX/XX/2022 I contacted Midland Funding about a collection account on my credit reports. I do not believe this is my account. I asked to speak with a supervisor and was told there was not one available. All of sudden there was one available and he briefly spoke with me saying to the likes are you going to pay it or not and the best deal possible. He refused to answers my questions and frankly sent me back the consumer rep. They again attempted to get me to pay the debt. They did agree to open a dispute. This company is very rude, doesnt seem to fully understand the FDCA or the FCRA and frankly wont even obey by there own website promises. The CFBA has reached a massive legal agreement with them but that doesnt seem to change there behavior. They continue to carry on the same old ways and a complete disregard for the FDCA and FCRA.

Consumer Complaint: On XXXX XXXX I received a debt collection letter by Midland Credit Management stating that I had a XXXX XXXX XXXX XXXX XXXX XXXX account. I've checked my credit XXXX report and see no report on this account. The amount that is states I owe is {$7000.00}. Supposedly my last payment date was XX/XX/XXXX and my date of default was XX/XX/XXXX, account was charged off on XX/XX/XXXX. I don't ever recall ever opening this account. I've called the company, but I felt very sketchy vibe over the phone. They were very eager and demanding for me to pay this account that i have no clue about. Consumer Complaint: MIDLAND CREDIT MANAGEMENT XXXX INC. is violating my consumer rights. This company that I never done business with is reporting an alleged debt on my consumer report. This company is reporting false and misleading information on my consumer report and has not sent me any " notice of debt '' pursuant to 15 usc 1692g ( a ). MIDLAND CREDIT MANAGEMENT , INC. has committed an act of aggravated identity theft pursuant to 18 usc 1028A ( a ) ( 1 ) and 18 usc 1028A ( c ) ( 8 ) by obtaining ; and possessing my identifying information without lawful authority. With that being said, attached will be my cease and desist letter I have sent to this company certified mail. I expect all claims to be handle in good faith.

Consumer Complaint: I had to file a police report on an original debt from XXXX XXXX that Midland funding has bought. I sent int police reports and case numbers for identity theft and Midland Funding LLc is still furnishing this acct on my report. I have tried disputing in many ways to get this removed and every month it is still updating Im not sure why a fraudulent debt was sold but this is a violation of the FCRA to keep publishing with the bureaus it is a bill for XXXX $ dollars that does not belong to me and I've stated this many times

Consumer Complaint: MIDLAND FUNDING LLC has stole my identity and are reporting fraudulently on my credit report. There is no contract binding me to this alleged debt, as it was In result of identity theft. 18 USC 1028 states they are violating my consumer rights by unlawfully transferring my authentication feature ( social security number ) electronically. I have token it upon myself to even request the validity of this account yet they never provided me with proper proceeders and policies that ensures the integrity of the account. MIDLAND FUNDING has also used the postal service to defraud ME, the consumer. Furthermore 15 USC 1681c-2 states that ( a ) Block Except as otherwise provided in this section, a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt by such agency of ( 1 ) appropriate proof of the identity of the consumer ; ( 2 ) a copy of an identity theft report ; ( 3 ) the identification of such information by the consumer; and ( 4 ) a statement by the consumer that the information is not information relating to any transaction by the consumer.

Consumer Complaint: I XXXX XXXX was served papers around XXXX, XXXX from the court house in XXXX Tx, ( XXXX ) XXXX. Midland Credit management, XXXX, is suing me, XXXX XXXX, ( XXXX ) XXXX ) for the amount of XXXX $ that they acquired from XXXX XXXX, on behalf of XXXXXXXX XXXX. I have contacted XXXX XXXX, XXXX XXXX on the purchase that was made with neither company having any record of that amount in all totaled purchases using XXXX. When I contacted Midland credit Management after several times and a week later, one of Midlands customer service people had told me the the Purchase was from a person with a last name of XXXX, and address of XXXX XXXX XXXX. XXXX NC XXXX, from which I have never been or have known of this person, or knowledge of any purchase from which was made. The Company suing me is where I acquired the name and address of this person that did make the purchase.The Credit Bureau has put this against me as bad credit. And needs to be reversed.
