Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: This balance represents fraudulent transactions on a XXXX XXXX issued credit card for XXXX XXXX. XXXX was the predecessor to Midland Credit Management. The fraudulent balance, after XXXX XXXX shut its doors in XXXX or XXXX of 2020, was {$58.00}. To be clear, my actual charges to the card in question were paid in full when the company closed. In dealing with XXXX to try to resolve the fraudulent balance of {$58.00}, I was told, by the customer service department, " Ordinarily, we would be able to waive these charges, but, since XXXX XXXX is out of business, we can't. '' So, although, the transactions were fraudulent, they would not waive them because the company was bankrupt and out of business. It is still unclear how that equated to me needing to cover the expense. Every few months, I would dispute the charges with the credit bureaus, XXXX would lower the balance, then, the process would start all over again. Prior to the account being sold to Midland Credit Management, it had once again bloomed to {$370.00} which includes interest and late fee. I explained this long, drawn-out history, repeatedly, but Midland refuses to acknowledge it. In fact, in a demonstration of utter ignorance and a sheer lack of common sense or maybe with specific intent to be obtuse, Midland 's representatives ' solution was to send a copy of the bill showing the balance of {$370.00} as their version of proof that the charges are mine! I do not understand how these tactics are legal. How can I be forced to pay for documented, demonstrably fraudulent transactions? For a company that is no longer in business? On charges which, most likely were written off in the companys bankruptcy proceedings? How can Midland slither into this issue and ignore the prior history while demanding full payment?

Consumer Complaint: I disputed the account and ask that they validate this account, and they fail to respond to the action. The law states they have 30 days to do so if not or over the 30 days this account must be removed from the credit file and in this case, they fail to respond to the matter. It has been over 30 days with no response, and I did not open or authorize this account, and I therefore request that it be closed immediately. By the federal law requirement this account must be removed because you do not have proof or any evidence to support this matter and failure to respond.

Consumer Complaint: I have attempted to reach out to Midland Credit Management multiple times at the phone number listed on their listings on my credit reports. I have not been able to reach anyone due to being told that the department who is handling the accounts are busy. I have been attempting to advise them that I am a victim of Identity Theft/Fraud and to notify them to remove their listings on my credit reports fro XXXX, XXXX, and XXXX. Due to not being able to reach anyone by phone. I did send documentation to their Compliance department via email and they are still reporting to my credit reports. I have removed the fraud alerts from my reports that were previously listed as they prevented me from accessing my own credit file which made it difficult to catch fraud as I had no access to my credit file and do not authorize any alerts being added but only listings to my credit file being removed by Midland Credit Management and providing proof that they have processed removal request via Eoscar and written letter on letter head uploaded to the CFPB portal.
