The company reported late payment on my credit on or about XX/XX/2021. 15 u.s.c 1681 section 602, states I have the right to privacy. 15 u.s.c 1681 section 604a section 2 also states that a consumer reporting agency can not furnish an account without my written instruction. Under 15 u.s.c 1681 section 1666b a creditor may not treat a credit card account under an open end consumer credit plan as late for any purpose.

My debt was discharged a long time ago theough bankruptcy. They are calling me trying to collect someone else debt through me but calling me instead. They need to stop I do not owe anyone and whatever debt this is they need to find the rightful people and call them instead. This number is rightfully registered to only me who owes no debt and they need to STOP calling me or XXXX make further legal charges after this.

Consumer Complaint: I am a federally protected consumer. This is a formal Notice of Default that Midland Credit Management has violated my rights under the Fair Credit Reporting Act and the Fair Debt Collection Practices Act. I have attached Invoice # XXXX that itemizes these violations in detail. Midland Credit Management as not complied with the cease and desist notice they received XX/XX/2022 via my first complaint with the CFPB. 15 USC 1692c ( b ) states without prior consent of the CONSUMER given directly to the debt collector, a debt collector may not COMMUNICATE, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law. 15 USC 1692c ( c ) states if a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further COMMUNICATION with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt. Midland violated both 15 USC 1692c ( b ) and 15 USC 1692c ( c ) on XX/XX/2022 by continuing to communicate with me after they received my Cease & Desist Notice on XX/XX/2022. The communication was made by updating the status of the collection account on my XXXX, XXXX, and XXXX consumer reports without my prior consent. 15 USC 1692a ( 2 ) states the term communication means the conveying of information regarding a debt directly or indirectly to any person through ANY MEDIUM. Communicating to 3rd parties is prohibited, in this case, consumer reporting agencies, because the Cease & Desist Notice is effective and the communication is not permitted by law. Midland has stated in their response to my first CFPB complaint that they will continue to furnish information to the consumer reporting agencies even though the account is marked as CEASE & DESIST, this is a direct violation 15 USC 1692c.

Consumer Complaint: Hello Ive disputed this midland credit management account numerous times on my credit report. Ive even sent a letter to XXXX and XXXX explaining my concerns and errors in reporting. Ive requested a full investigation and copy of information for debt validation which I have yet to be provided with. XXXX deleted the account assuming investigation was complete and they could not provide the details I requested. The amount this creditor originally had on my account was {$2200.00} and now around {$2200.00} is being reported I have no knowledge or verification of this account or amount being owed I have never made any sort of payment to this account it is also being reported as open which is not accurate or possible. I also received a letter in mail threatening legal action if payment arrangement was not set up. To my knowledge that goes against FCRA as well as the account is past the statue of limitations in my state so that would be a false threat as well. I also believe it is past the 30 days since I sent in request for investigation.

Consumer Complaint: XXXX XXXX XXXX has been calling me to collect a debt this was a debt from about five years ago but I reported the card stolen at that time. One of the very first times they called they said that it was verified that it was not my debt to pay, so they sent papers to the house I used to live in another state I never got those papers. I've been disputing the issue for about 3 months with the credit bureau. They recently called and said they verified everything and that all I need to fax them is a copy of a fraud report so I can have evidence on file.
