Consumer Complaint: Through the response received from the creditor, I would like to inform you that your company has violated 15 USC 1692j ( a ) because your company furnished a deceptive form to create a false belief in me as a consumer that the Creditor was attempting to collect the debt but in reality it was not true. Midland Credit Management violated numerous FRCR laws when it fraudulently tried to get me to pay a debt that was a result of my stolen identity Account # XXXX ( {$5700.00} ) on or around XX/XX/2022. I was a victim of identity theft, I was made aware on XX/XX/2022 ( Police Report # XXXX ). Midland Credit Management has used deceptive tactics in the past to get me to pay for items that didn't belong to me. Pursuant to 15 USC 1692j ( b ), any person who violated the above-mentioned section shall be liable to the extent as mentioned under 15 USC 1692k i.e. {$1000.00} ( XXXX XXXX USD ). Also, I am including an invoice in the about of {$4500.00} ( XXXX XXXX XXXX XXXX USD ) the amount it will cost to repair my credit. If you fail to pay for the violation I will escalate this matter to federal court, if you prefer to settle this matter out of court please make an offer.

I received an email alert from XXXX credit that said my email and social had been detected on the XXXX XXXX Later that day I changed most of my passwords due to this being the XXXX time this year this happened. I noticed in my spam there were several emails from loan and credit card companies. I have reason to believe either and old neighbor or relative opened this account without my permission for years. This account was sold to collections which is further damaging my XXXX XXXX

Consumer Complaint: Midland Credit Management composed a letter XX/XX/2022 stating that they had acquired an account from a company that I owed. Midland violated my rights according to the Fair Debt Collection Practice Act because they did not include in that letter, nor did they send a letter within 5 days that stated : Section 15 USC 1692g ( a ) ( a ) Notice of debt ; contents Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing -- ( 3 ) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector ; ( 4 ) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector ; and ( 5 ) a statement that, upon the consumer 's written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor I have enclosed proof of that letter. I, in turn, sent them a letter stating that they violated my rights and what section that they violated. They sent me another letter and that letter also did not have those REGULATIONS. This company is not abiding by the law and they continue to contact me, despite breaking the law. Date of first letter Midland Credit Management sent : XX/XX/2022. Consumer Complaint: Midland Credit Management placed two collection lines on my credit report without providing me a chance to send a validation challenge. This was a brazen violation of my rights. I successfully got these lines removed from my credit reports as the documents that they presented ( eventually ) were clearly doctored and contained no identifying information that any of these lines were mine. This includes : lack of signatures, no ssi number, no birth date, etc. This company has now proceeded to harass me through XXXX XXXX XXXX ( their lawyer ) by threatening to sue me for an invalid debt, repeated phone calls numerous times throughout the day and by mail.

Consumer Complaint: I have been contacted several times by this company claiming I have a debt that is owed to them in a card that was stolen and was eventually supposedly resolved by XXXX XXXX. When I explained this to the debt collector he then proceeded to use foul language with me calling me slurs and telling me it was my debt and did not offer a solution since clearly this collection was not supposed to happen as I was promised. This is all being handled in professionally.
