They also stated that Midland Credit Management has taken over the account and it is no longer with XXXX. I have never owned/opened a XXXX credit card and they are stating that I opened it in South Dakota XXXX which I have never visited and am a California resident XXXX Customer service at Midland Credit Management was also very rude, asked for my social security number right away ( which I did not provide ), and stated I had to pay them immediately with no explanations.

This company is not register in Georgia as a Collection Agency, or a Debt collector so there for they can't collect on any behalf, and I never had an account with this consumer.

Consumer Complaint: They are calling me non-stop, almost everyday, sometime multiple times a day for weeks now. They are calling me while I am at work, which is oppressive, extremely frustrating, and affecting my ability to work. They keep trying to misrepresent who they are when they call to mislead me to believe they are a different entity by using dozens of different random auto-generated phone numbers to show up on my caller ID, but they keep leaving the same exact erry message. I've tried communicating that the debt is not right, I do not agree with it, and that I have to refuse to pay or continue to be harrassed to no end. Still, they persist to call over and over again. They are clearly violating the Fair Debt Collection Practice Act and need to be stopped. A lawyer told me they would file a lawsuit against them for me, but I am hoping that this might work faster.

I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. In a good faith effort to resolve the matter amicably, I must demand proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. Absent such proof, you must correct any erroneous reports of this past debt as mine. I am writing to request that you please provide the following information : 1. Consumer Complaint: I have an account with XXXX. I owed a balance of about {$1300.00} for the XXXX XXXX account. I was paying this account every month for {$80.00}. Then I received a bill from them stating that I owed a balance of {$1300.00} with a past due amount of {$470.00}. I called because the payments were being deducted from my account every month. It turns out that because they are no longer working with XXXX XXXX, they closed out my XXXX XXXX account and open a new account for me called XXXX XXXX which is the account that I was paying for when I thought I was paying the XXXX XXXX. The balances owed on both accounts were about the same amount so that was the part that confused me. The previous balance that I owed on the account they closed out, they now wanted full payment on of {$1300.00}. I contacted XXXX around XX/XX/2022 when I received the notice. I first asked to speak with a manager because I didnt ask for the first account to be closed and I didnt give authorization for a second account to be opened. The manager stated there was nothing they could do. When explaining that I didnt have the money to full pay the balance and I requested a payment plan or for the accounts to be merged, they stated that wasnt possible. I attempted to send a payment of {$50.00} to start paying off the old balance on the XXXX account and XXXX returned the payment with a letter dated XX/XX/2022 that stated they sent the account to collections. Now I have a collections account on my credit report and Im having to deal with Midland Credit. This is unjust because I was never given an option on closing one account and opening another. I was never notified that I now have 2 accounts. I was not given a reasonable option to satisfy the balance with XXXX before they sent it to collections.

MCM XXXX XXXX only provided XXXX verifications XXXX on XX/XX/XXXX and i received on XXXXAgain a verification doesn't provide any proof of any kind. They had XXXX plus year enough time to provide any proof and again none provided. Knowing that multiple lawsuits filled by CFPB & Attorney Generals from all States over the years against zombie debt buyers XXXX XXXX, MCM .Inc. and millons and millions was payed in fines for massive FDCPA violations. And again that MCM, XXXX is violating the laws by trying to collecton unresolved dispuded debts and ignore all my request for complete validations sent by certified mail. I consider this debt invalite and a complete fraud. I Demand a immediate respond to mine complaints filled to both the CFPB and XXXX and again they had more than enough time to provide any proof. If they dont respond within XXXX business days another complaint will follow with the XXXX Attorney Generals office and i will consult with my legal counsil for suit.
