Consumer Complaint: On XX/XX/XXXX. XXXX the Defendant, XXXX XXXX XXXX had a XXXX meeting with Discover Card Services the Plaintiff in XXXX. District Court before Judge XXXX regarding the illegal filing of a Judgement Lien. State of Michigan XXXX case XXXX was incorrectly heard as a Garnishment Case instead of a Judgement. Plaintiff 's attorneys did file a Judgement Lien with the register of deeds in XXXX XXXX County on XX/XX/XXXX. The owners of the property the lien was filed on is owned by XXXX XXXX XXXX and XXXX XXXX XXXX, husband and wife by the entireties and in Michigan that prevents a creditor from attaching property owned jointly when their claim is against only one of the parties. Now, Plaintiff should know this as they did it in XXXX and were later chastised for failure to release the lien, which was and illegal use of the law. ACT 236 of 1961 Section 600.2813 allows penalties of {$300.00} for failure to discharge the illegal lien. The law also allows fines of {$5000.00} and 3 years imprisonment as this is a felony under Michigan Law.

Consumer Complaint: In 2020 Discover credit card alerted me they overcharged me as there was a surplus payment of {$110.00} on my account and offered me a refund. They were supposed to send me a check for that amount but never did. I called them re the issue. They then were supposed to send {$110.00} in an ACH XX/XX/2020 transfer, but never did. Instead they reversed the non-refund re and overcharging my account again. In fact they recharged my account. three, ( 3 ) times for {$110.00} equaling {$330.00} which I was compelled to pay as if I didn't, I'd accrue phony finance charges and I'd have to fight that as well. So Discover now owed me {$330.00}. In the interim I called them to resolve. They refunded me for {$110.00} but they continued to recharge me again for same so that they still owe me/owe me more than what they originally owed me which is now {$220.00} as they re/overcharged me {$110.00} three, ( 3 ) times, and refuse to pay me back. We called them repeatedly. They gave all sorts of excuses, e.g., it's Discover 's policy to recharge the consumer when Discover owes and then pays consumer back for overcharges, your old card was replaced with a new one so that's what Discover does, that's how debits work at Discover, and my account balance had to be XXXX, ( XXXX ) for them to pay me back -- FYI My balance is always at XXXX, ( XXXX ), as I pay my balance in full and on time every month which is evident on all my statements. They called my bank without my written consent and tried to get me on the phone for a three-way, without my prior knowledge and consent. Bottom line, when you owe a debt -- in this case Discover is the debtor/ indebted to me, the creditor, now for {$220.00}, you pay it back and it ends there. Just like when I pay my bills. You don't try to have/re/overcharge me, the creditor, the money you owe me plus more. Discover owes me {$220.00} and I want my money. Breakdown : 1-Prior to XX/XX/2020 Discover owed me {$110.00} for a {$110.00} overcharge on my credit card account. On XXXX, Discover over/recharges me again for {$110.00} on XX/XX/2020 to -XX/XX/XXXX Statement for supposedly sending me the money they owed me, i.e., in a {$110.00} check they said they would but never sent. So by XXXX, they owed me {$220.00} : 2-By XXXX owes me {$220.00} 3-On XXXX Discover removes one, ( 1 ) over/recharge but they still owe me {$110.00} 4-But on XXXX Discover re/overcharged me again for {$110.00} so they owe me {$220.00} 5-On XXXX Discover deposits {$110.00} into my bank so Discover owes me {$110.00} 6-But also on XXXX Discover re/overcharges again in the guise of ( ACH reversal for an ACH that never occurred ) so they owe me {$220.00} again. 7-I can produce all my relevant statements upon request in attachments to an email. Discover has no email address I asked a XXXX rep on the chat, but got no answer. I spoke to a few supervisors re this issue including XXXX-to no avail at the refund dept. # XXXX In fact contacting Discover to get resolution to this issue, i.e., get my money back has been impossible. Consumer Complaint: For the past 60 days, I have received telemarketing calls ( 90 % of calls appear as 'Scam Likely..with XXXX XXXX .... ) on behalf of Discover Credit Card ( which I don't have ) Chase and Visa to qualify for 0 % promotion. I initially blocked the calls, but all the phone # s are similar and on average I receive 20 calls/day. When I have chosen to speak with someone ( option # 1 ) to request my phone # to be removed, they either agree to do so, or hang up on me. Then will call back. Most recently, I received a call from XXXX XXXX XXXX ( which is similar to my cell # ). When I called it back, I reached Asst. Atty XXXX XXXX who advised this was her personal ph #. Her advice was for me to file a complaint with the FBI in my local area. She provided the contact # and I called. Was advised to file an IC3 complaint.

Consumer Complaint: On XX/XX/XXXX, XXXX, XX/XX/XXXX, & XX/XX/XXXX of XXXX I have sent out four rounds of dispute letters to the 3 credits bureaus in efforts to dispute inaccuracies on my credit profile in addition to the creditors. The debt keeps coming back as verified with absolutely no proof sent to me. The credit card company are sending statements in efforts to convince me that the debt is mine. I have asked for fraud affidavit, etc. I completed the fraud affidavit as requested and still the issue has not being resolved. The company continues to ignore my request for proof to validate the the debt belongs to me ( contract, promise to pay, etc. ) I've requested several investigation however, the issue still persist. Also, the company is taking longer than 30 days to reply to my request. The debt is causing harm to my credit profile and score. I can not get certain jobs or apply for certain lines of credit due to this issue. In addition to this, I have stated numerous times to the company that this is not my debt, I have never owned a credit card with this firm. This account was opened without my permission and I have no information on who, what, when, and where this account was opened. The company refuse to help! I need help.
