Consumer Complaint: On XX/XX/XXXX, I discovered that Discover was reporting a negative credit card account on my consumer reports which is in violation of under the Privacy Act of 1974. They agreed per there contract with me that they would not report my non public personal information to a non third party affiliate. It is evidenced on all of my consumer reports that Discover has breached there agreement with me and violated there terms and conditions by reporting my non public personal information to third parties, namely XXXX, XXXX and XXXX pursuant to 16 cfr 313.3 and 313.7 ( 1 ). Pursuant to 15 USC 1681 ( b ) Creditors can not furnish consumers information without explicit consent. And Discover is also still currently reporting transaction history which is illegal. I wish to Opt out pursuant to 15 USC 6802-6805. Discover was obligated to send me a opt out request every 30 days and failed to do so.

Consumer Complaint: I realized XX/XX/XXXXXXXX that my credit limit went from {$13000.00} to {$1200.00} unilaterally with no disclosure before hand, as per the provisions of the Truth in Lending Act ( TILA ) and to also assert that there has been a Violation of Equal Credit Opportunity Act ( ECOA ) and Consumer Credit Protection Act ( CCPA ), Discover Bank had no lawful right to unilaterally reduced my Extension of credit of {$13000.00} to {$1200.00}, Which is a substantial injury to me by interrupting commerce and causing a harm to my livelihood as I am the original creditor to these agreements as my consumer credit was utilized and extended to open this account. In accordance with the FDIC Laws and Regulations, I assert there has been a Violation of TILA, FCRA, ECOA, CCPA and Rule 10b-5, promulgated under the Securities Exchange Act of 1934. - Violation 15 USC 1637 ( I ) ( 2 ) In the case of any credit card account under an open-end consumer credit plan, a creditor shall provide a written notice of any significant change, as determined by rule of the Bureau, between the creditor and the obligor, not later than 45 days prior to the effective date of the change. - Violation 1031 ( a ) and 1036 ( a ) ( 1 ) ( B ) of the CFPA An act or practice is unfair when it causes or likely to cause substantial injury to a consumer which can not be reasonably avoided Violation 16 CFR sec 433.1 -Colorable Contract- a contract that seems to be genuine but is not, due to the accepting of taking XXXX XXXX XXXX XXXX originally utilized my collateral security ( The Application ) to pay for the services. Which was Financed. ( 15 USC 1605 ( A ) Finance charge defined Except as otherwise provided in this section, the amount of the finance charge in connection with any consumer credit transaction shall be determined as the sum of all charges, payable directly or indirectly by the person to whom the credit is extended, and imposed directly or indirectly by the creditor as an incident to the extension of credit. - Violation 15 USC 1681 ( D ) ( 6 ) a denial or revocation of credit, a change in the terms of an existing credit arrangement, or a refusal to grant credit in substantially the amount or on substantially the terms requested, shall be disclosed to consumers Within thirty days prior to making changes. Violation 15 USC 1692J ( A ) It is unlawful to design, compile, and furnish any form knowing that such form would be used to create the false belief in a consumer that a person other than the creditor of such consumer is participating in the collection of or in an attempt to collect a debt such consumer allegedly owes such creditor, when in fact such person is not so participating. - Violation 15 USC 1691 ( D ) ( 6 ) the term adverse action means a denial or revocation of credit, a change in the terms of an existing credit arrangement, or a refusal to grant credit in substantially the amount or on substantially the terms requested. Such term does not include a refusal to extend additional credit under an existing credit arrangement where the applicant is delinquent or otherwise in default, or where such additional credit would exceed a previously established credit limit.

Consumer Complaint: Hi I had a credit card which I am carrying since 2016. I was a XXXX XXXX at that time and the credit limite is {$500.00}. Today, I managing 5 credit cards with a limit of {$12.00} XXXX. Discover never notified me or sent me any alert. My credit score went down by XXXX points as a result of a late payment. I have tried to write letters and called multiple times discover and the bureaus. This is the first time a late payment occured. The amount was {$140.00} and was paid in full, the second I learned about this whole situation. Discover bank decided to refund me for late charges and I since enrolled in automatic payments. Today, I would like you to verify please that late charges were refunded, and that discover never gave me a notice by email. I am a frequent traveler and I have been abroad for the past couple of months. I have signed for paperless documents with them, but they still want to communicate by paper for such alerts.

Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.

Consumer Complaint: I currently have an active Business Account with Discover Business ending in XXXX with a XXXX limit. Several years ago I successfully settled out of court for an undisclosed amount with Discover Business Card because they refused to comply with the FCRA regarding fraudulent transactions that were made to my account. After receiving the payment from Discover Card the agreement was that they were going to remove all fraudulent transactions and reissue a new account number. Yesterday when I spoke with a representative at Discover she advised me that the new account would be mailed expedited. Today when I spoke with the fraud department I was told that the account was closed. This is not true because several people at Discover advised me that I have XXXX available for use with a XXXX balance.

Consumer Complaint: I filed a ftc report pertaining to this alleged fraudulent charge card account and sent the ftc report to Discover Bank. Making them aware of the fraudulent charge card account that was opened by someone else using my identity. The company responded back to me through USPS mail stating that. This account was in deed owned by me which is 100 % false information. When I first contacted the company Discover Bank about this issue through the CFPB complaint website. Their company didn't even have my current address on file in their system until I filed a complaint using the CFPB portal website. And they took my address where I have currently been residing since the year XXXX and committed fraud themselves. By switching my current address on the bank statements that they sent me through USPS mail. On XX/XX/XXXXXXXX when in fact this fraudulent account had been open under a completely different address that do not belong to me. As XXXX XXXX XXXX XXXX XXXX, XXXX, WI XXXX. I have uploaded and attached the " REPRINTS '' with this complaint showing proof that. Discover Bank have committed fraud using my identity to make the credit reporting agencies believe this account legally is owned or belongs to me.

Consumer Complaint: Discover abruptly closed my secured card, on the very month it was going to be moved to unsecured and my security deposit refunded. They claimed I did not prove identify verification and also claimed they sent me emails, I even asked the date they supposedly sent these and I did not recieve XXXX notice or request of information from them. They have also kept my security deposit, and continued to try to take a final payment from my account ( attempted to process a few times, when I had already paid the account in full. ) I was told I would get my deposit back in the mail but it looks like the absorbed it, by taking {$150.00} from a payment that failed ( because I no longer owed them ) they added a new {$150.00} balance to my account and seemed to have pocketed my deposit. This tanked my credit score, and it is all too convenient that they did this after I complied with the XXXX months of good payment history.

Consumer Complaint: Discover imposed interest expense in a way put its customers to incur more charges than necessary. The practice is also inconsistent with another credit card that I have. In the attached XXXX statement shows that I have paid {$1400.00} of the total {$1400.00} of the total balance, leaving an outstanding balance of {$14.00} supposedly. I have also attached the XXXX statement showing there are no outstanding balance prior to XXXX. However, in the XXXX statement, I was charged with an interest expense of {$44.00} based on a balance of {$1800.00} and not that {$14.00}, apparently new purchase amount that supposedly entitled to a 30-day interest free period are somehow not qualified and subject to interest charges. Again, I paid {$1800.00} of the total {$2000.00} during the period, leaving a balance of {$160.00} supposedly. In the XXXX statement, despite after fully pay off the any outstanding balance, I still incur an interest amount of {$9.00} based on the balance of {$370.00}, not {$160.00}. The explanation I received is that interest accrue on a daily basis based on the balance until it's paid off. However, to an ordinary person like me, I wouldn't know how Discover would consider " balance subject to interest rate '' is determined
