Issue: Improper use of your report

Subissue: Reporting company used your report improperly

Consumer Complaint: My original complaint can be referenced to complaint ID XXXX. My response to there response is here. I trust this message finds you well, and I appreciate your swift response to my recent communication with the Consumer Financial Protection Bureau ( CFPB ). After carefully reviewing the information provided regarding my Discover card account ending in XXXX, it is evident that there are ongoing concerns that require further attention. As explicitly stated in my correspondence dated XX/XX/XXXX, I exercised my right to opt out and unequivocally revoked any authorization for the reporting of my personal non-public information to credit reporting agencies, in accordance with the Fair Credit Reporting Act ( FCRA ), particularly under 15 U.S. Code 1681a ( 2 ) ( A ) ( i ). This opt-out request was unmistakably communicated in the letter I sent on that date. While I acknowledge that Discover card updated my account preferences as of XX/XX/XXXX, reflecting my request not to share information with third parties and corporate affiliates for marketing purposes, it is crucial to emphasize that my opt-out request extends beyond marketing preferences. It encompasses the reporting of any information, including transactional history, to all credit reporting agencies. Furthermore, the reporting agencies are currently portraying different and inaccurate information. I demand that the reporting be halted to all credit reporting agencies, not limited to XXXX, XXXX, XXXX, and XXXX. The inconsistencies among the reporting agencies are not only causing confusion but also violate the accuracy requirements outlined in 15 U.S. Code 1681s2 ( A ) ( 1 ) A of the FCRA. In addition to the cessation of reporting, I reiterate my request for compensation in line with my initial demands. For each occurrence of reporting since the inception of my account, I am requesting {$1000.00}, as well as {$25000.00} for pain and suffering and embarrassment associated with the unauthorized reporting of my information. Moreover, I would like to bring to your attention the inclusion of non-mailable addresses and non-callable phone numbers in the reported information. These inaccuracies must be promptly addressed, and such erroneous data should be removed from all credit reporting agencies. Once again, I am exercising my right to opt out, and I expect immediate action to remove all reporting, including transactional history, from all credit reporting agencies. Your thorough review of my original communication and the relevant legal provisions cited therein is essential. Immediate corrective action is imperative to address my compensation demands, cease the reporting of any information to all credit reporting agencies, and rectify inaccuracies in the reported data. Considering the potential consequences of ignoring these requests, I must express my commitment to pursuing further investigation into the information transfer process. Should these concerns persist, I am prepared to report XXXX XXXX to the Securities and Exchange Commission ( SEC ) for securities fraud. I appreciate your prompt attention to this matter and anticipate a swift and comprehensive resolution.

Issue: Took or threatened to take negative or legal action

Subissue: Sued you without properly notifying you of lawsuit

Consumer Complaint: I am filing this complaint against Discover Bank, represented by XXXX XXXX XXXX XXXX, related to an ongoing lawsuit for an alleged debt, which was the subject of previous CFPB complaints ( XXXX and XXXX ) in XX/XX/XXXX. These complaints addressed Discover Bank 's failure to provide necessary documentation to validate the alleged debt. Despite my requests for debt validation, Discover Bank, through XXXX XXXX XXXX XXXX, filed a lawsuit on XX/XX/XXXX, without my knowledge and while the debt validation request was still pending. This was before their response to CFPB complaint number XXXX on XX/XX/XXXX, which was my first indication of the lawsuit when Discover Bank mentioned it in their response. In a court filing on XX/XX/XXXX, XXXX XXXX XXXX claimed that on XX/XX/XXXX, I evaded service, an assertion I categorically deny. This claim of evasion of service is particularly concerning as it could have led to a summary judgment against me based on false information. A copy of the documents filed by XXXX XXXX XXXX is attached, unfortunately I have yet to receive a copy of the case information from either party and can not provide at this time. I am concerned about the potential violation of fair debt collection practices and request a thorough investigation into these actions by Discover Bank and XXXX XXXX XXXX XXXX. The opposition noting the evasion of service is attached.
