Issue: Struggling to pay your loan
Subissue: Loan balance remaining after the vehicle is repossessed and sold
Consumer Complaint: I had to go out of work due to personal illness. The vehicle was sold at the auction and I told the finance company I could not afford to make payments and on a vehicle I no longer possess.During the time I had the vehicle it kept needing major repairs and the finance company would disable my vehicle and still expect payments. They have put the loan up for legal review and it was just sold at the auction in XXXX .I tried to do a settlement for the truck last year and they refused to accept it.

I called back on XX/XX/XXXX and now they are saying it is up for audit on XX/XX/XXXX and it would take another 21-30 days. To me it is simple add and subtract but they keep dragging it out.

Subissue: Lender trying to repossess or disable the vehicle
Consumer Complaint: I recently appplied for a loan with Credit Acceptance i n XXXX . In XXXX I was admitted into he hospital for 2 months and fell behind on my payments. Consequently, I the collection calls started coming in. I recieved a call fr om Credit Acceptance in the month of XXXX and was told that a full payment of {$280.00} was due today to avoid repossession. Once payment was made over the phone, the associate would then contact the towing company and tell them to cancel the repossession process. The payment was made and the account was settled I called again in XXXX to make arrangements w ith Credit Acceptance so that I could build a rapport with them. I al so inquired with the associate what their policy and time frames were on repossessing vehicles and told about the situation that happened in XXXX . She informed that the associate had no right telling me that my car is was about to get repossed without an immediate payment and she then apologized on behalf of the company. Naturally I felt confused and lost peace of mind with Credit Acceptance. It is now XXXX and I fulfilled my arrangement of {$100.00} to keep the account satisfied. They called again today XXXX / XXXX / 2017 a nd I spoke with an associate to make further arrangements. I told what I could afford and when the payment would be made. She did n't accept my offer and when I tried to explain to her my hardship situation she not only interrupted me several times but was condescending and threatening. She then further threatened to notate my account and said I was being " uncooperative ''. I understand th at Credit Acceptance h as a job to do it collecting payments. But I do not have any peace of mind with this company. They are very aggressive with their collection calls and ask me inappropriates questions like " in order to make payments can you ask your parents for help? Or can you ask your relatives for help? '' These questions make me feel uncomfortable. I also need them to give me a clear understanding of what their policy is on repossessing vehicles. I was told that as long as I make arrangements with them I can avoid that consequence but each time I speak with this bank I get different answers. As a result I wake up every day XXXX wondering if my car will be gone or not.

Consumer Complaint: i called credit acceptance in the beginning of XXXX to notify them that i would be making a payment on XXXX to avoid towing/repossession and the customer service rep agreed. Credit acceptance than towed my car before the agreed upon date. on XX/XX/XXXX i made the payment as agreed + the additional towing charge and was promised that it would not be reported on my credit due to it being prematurely towed. on on XXXX XXXX XXXX i was alerted via XXXX that Credit acceptance reported my car as reposed and on the XXXX reported it as redeemed. i again contacted them and notified them of the error and was told there is nothing they can do and that it is not their problem. another issue i have with credit acceptance is that they do not call me to notify me of ANYTHING my phone number is XXXX and they do not try and contact me at all. the only notice i received was via mail on XXXX that my car was due to be towed ( the car had been towed the week prior )

Consumer Complaint: I took out a loan in XXXX of XXXX for a used car with a huge interest rate because of my credit issues from a very corrupt suto company and it was financied through Credit Acceptance. I n XXXX if XXXX the car was repossed due to late payments I paid the past due amount in XXXX to get the car back from repossession. This is where my tragedy starts, when I picked the car up from the auction the interior was completely covered in MOLD. So much that I could n't sit in tbe car. The auction attempted to clean the car claiming it was sent that way from the repo company i called the finance company credit acceptance and told themI could not drive th e car because of the mold. The auction cleaned the car was still filled with black mold. I told the finance company I could not keep the car even after extensive cleaning. I have XXXX boys bor n at 27 weeks I let credit acceptance know my son is extremely allergic I can not drive him around in the car. They refused to take responsibility for the fact that their repo company left the windows down and the car was rained in for almost 2 months on and off. What was I to do. I had them come and get the car after they refused to help clean the car so I could drive it with m y children. I have pictures to coloborate my story

Consumer Complaint: On XXXX XXXX , XXXX I purchased a car from XXXX XXXX XXXX XXXX XXXX in XXXX , VT. Said car was financed thr ough Credit Acceptance Corp. out of XXXX , MI. My finance contract had the purchase price minus my down payment, but also included fees for the extended warranty and for th e GAP Protection. On XXXX XXXX , XXXX I re-financed my car through my local credit union and a check for the payoff amount was sent t o Credit Acceptance Corp. That GAP protection was issued by XXXX XXXX XXXX XXXX and I was told by them that the protection was cancelled and there would be a partial refund issued. I then spoke with a customer service agent at Credit Acceptance an d was flat out told that there would be no refund issued to me on this. My contract has me paying for the car, the financing, the warranty AND the GAP! My refinance took care of the pay-off. So I should be entitled to that partial GAP refund because I 'm the one who paid for it. Credit Acceptance Corp., is re fusing, actually they are just telling me that there will be no refund issued to me for the GAP period, end of story, sorry! BS

Consumer Complaint: I purchased a vehicle from XXXX XXXX and was set up with financing through Credit Acceptance. I was told I was getting financed on {$18000.00}. If I go through full term of the loan I will be paying them over XXXX for a vehicle that is only valued through XXXX . at {$8400.00}. Now when I try to refinance the vehicle I am getting denied due to the loan amount exceeding the value of the vehicle. This is not right for a business to do to somebody who is already low income and struggling to keep his family a float.
