Consumer Complaint: Since XXXX of this year I have been going back and forth with credit acceptance about a XXXX XXXX car that I co-signed for my daughter which can not make the payments due to being incarcerated. The car had been in the pound since XXXX racking up to XXXX and still has not picked up the car but keeps putting all this interest on with the car sitting at the pound I call every day and ask for a suo and they say one will call me back and none had called me yet. They have not went and picked up there car but they call me 3 times a day for a payment. What do I do from here?

XXXX XXXX recently served my employer for garnishment on XX/XX/XXXX, this is a 9-year-old debt that overpasses the statute of limitations in my state. Nebraska, the statute of limitations 5 years from the last payment made. This means that a creditor or debt collector may not sue you for debt after five years have passed. If the agreement was verbal, then that number is reduced to 4 years in the state of Nebraska. I have been harassed by this creditor in the last 6 months calling me at work calling on weekends portraying they are laws enforcement. I was served a summons for XXXX this debt is 9 years old.

Consumer Complaint: The Fourth Amendment stands for the principle that the government generally may not search its people or seize their belongings without appropriate process and oversight. my vehicle was illegally taken. And the company is still using and selling my information without my consent and still can not provide proof that I allowed or gave permission for my signature or information to be used. In the previous complaint i sent the company stated in there response that the account was " 180 days past due '' the company have not reported anything on this account since XXXX ( XXXX XXXX ) the day a payment was last posted but it shows on my credit file that the last payment was posted XX/XX/XXXX and the payment status is 150 days past due. on my credit file it states on the account that -3 % of this " loan '' was paid how can it be listed as -3 if its still in a positive standing? Also it states that I have made 50 % of these payments on time. The company states that they are accurate on reporting and its clear they're making mistakes on their reports. According to 1022.42 Reasonable policies and procedures concerning the accuracy and integrity of furnished information. it states Each furnisher must review its policies and procedures required by this section periodically and update them as necessary to ensure their continued effectiveness. And as shown no updated credit report has been placed since the month of XX/XX/XXXX. this account is a charge off you cant collect a debt from a charge off the account information was suppose to be sent to the irs and has not been. the company is in violation of the following :. 18 U.S. Code 241 - Conspiracy against rights. A demand of cease and desist. 1022.42 Reasonable policies and procedures concerning the accuracy and integrity of furnished information ..4th amendment .fair credit reporting act .congressional findings and statement of purpose .15usc1681b permissible purpose of consumer reports .15usc1681c requirements relating to information contained in consumer reports An agency has the affirmative responsibility to try to collect delinquent debts that are owed to the agency, or referred to the agency for collection. However, at some point in the collection process it may become evident that a debt is uncollectible, and it may be appropriate to terminate collection action, and/or writeoff the debt. An agency fulfills its affirmative responsibility to try to collect delinquent debts by engaging in active collection. Active collection means that the debt is being collected through the use of all appropriate debt collection remedies, including, but not limited to, demand letters, credit bureau reporting, offset, garnishment, foreclosure, litigation, and referral to the Department of the Treasurys ( Treasury ) Bureau of Fiscal Service ( Fiscal Service ) for collection ( known as cross-servicing ). I do not owe this alleged debt and for the 4th time i am demanding for it to be removed from my credit profile

XXXX, XXXX and XXXX also keeps reporting this debt as validated and verified, even though no proof of such has ever been provided by the creditor or the credit reporting agency. I am demanding proof of the original date of delinquency on this debt. It is believed this debt is over 6 years old, which is past the statue of limitations for collection, which would take away the right of the creditor to collect and report this debt to the CRA 's. I am also demanding detailed report of accounting. Information provided to me indicates original date of delinquency of XX/XX/2015 which is now over 6 years old and is now time barred.
