Issue: Attempts to collect debt not owed
Subissue: Debt was paid
Consumer Complaint: Jefferson Capitol Systems aka / XXXX XXXX XXXX XXXX Aka Jefferson Capitol LLC/Aka Jefferson XXXX keeps appearing on all 3 major credit bureaus, this company is in violation of thr FCRA, because once the item is proven to be paid with payment receipts of the {$2400.00} to the 3 Major Bureaus, they violate the FCRA by Re-inserting their account under different aliases. The Debt was paid before Jefferson Capitol Systems took it over, This Complaint I am submitting I am requesting a Debt Verification. And this is what Jefferson Capitol Systems needs to verify, they need verify XXXX XXXX XXXX phones both worth {$1200.00} per phone totalling {$2400.00} were returned and balance paid in full with receipts from the original creditor. Requesting Debt Verification. Merchandise ( 2 XXXX worth {$2400.00} ) - verify if they recieved the phones. Verbal Agreement with Original Creditor- if both phones ( Merchandise ) are returned back to XXXX , they agreed to write off the not part but ( ALL ) of the balance. Meaning- Consumer requires receipt after consumer returned merchandise to original creditor, so after XXXX XXXX were returned, and a payment of {$920.00}, plus an additional payment of {$150.00}, XXXX issues receipt stating they wrote-off the balance after phones was received, and also they sent reciepts with pictures/photocopies of the XXXX merchandise returned valued at {$1200.00} for one, and {$1200.00} flr the second phone I returned to them showing phones were paid off {$1200.00} + {$1200.00} -- -- -- -- -- -- -- -- -- = {$2400.00} ( written off ) Seems that Jefferson Capitol Systems does not know what a write-off is so here is the meaning. If a creditor writes off a debt, it means that no further payments are due. In addition : the balance should be set to XXXX on credit reference agency reports. If Jefferson Capitol Systems continue collection activities on a debt that was already paid, consumer will be forced to hire an attorney and sue under the Fair Debt Collection Practices Act ( FDCPA ) for violations. For a [ Fraudulent Delinquent Balance Payment Request. ] This has been an ongoing issue with Jefferson Capitol Systems, and there are numerous other consumers who are experiencing the same issue this consumer is, Jefferson Capitol Systems needs to close this account out of they can not verify the debt is a charge-off and not a write-off. I am not the only consumer they are doing this to trying to collect debt not owed to them. Consumer Complaint: In 2011, I first noticed that a XXXX XXXX bill appeared on my credit report when I attempted to purchase my first vehicle. According to my credit report at the time, someone by the name of XXXX XXXX, who resided in XXXX, California at the time, had used my Social Security number as a cosigner for her to get a XXXX phone. This charge had fallen off of my credit report in XXXX timeframe, however, when my husband and I recently wanted to look into buying our first home, the credit repair company we worked with pulled what they called a deep dive report that they claimed will pull anything lingering on our report, even if it has fallen off. It was at that time that the XXXX XXXX bill came back onto my credit report as if it was a brand new collection account. Considering how long I have been disputing this account and have proved that it is not mine over and over again and XXXX and the creditors continue to sell the debt and ruined my credit is unacceptable. I need someone to intervene and get them to stop. It is {$700.00} of debt that is not mine, and I refuse to pay for someone elses debt, and they should be going after the person who owns the account, not me.
