Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: 2017 XXXX placed past due on credit report. Contacted XXXX multiple times via phone and in person at multiple stores. Informed me that i owed on a cell phone bill which was past due. I explained I haven't had a XXXX phone in more than 18 years. They continued to pass the buck and/or call me a liar. I paid them in 2017 approx. XXXX or XXXX to protect my credit and they agreed to clear my name and close any accounts associated with myself and credit and SS #. Now Jefferson capital says I owe them and my acct is in debt collections. I have reached out to them and XXXX with no positive reactions. They still call me a liar and i disputed with XXXX Credit reporting companies which also have done nothing to remove the fraudulent acct. I am being taken advantage of by the fact its small claims and like the banks have told me, " just pay them and get it off my report so i can borrow from them, everyone pays to play ''. This XXXX be XXXX dollars but is a XXXX dollar a year or more scam on the consumers who they create these fraudulent small claims debts.

Subissue: Debt was result of identity theft
Consumer Complaint: My issue with this debt I believe began in XXXX when I discovered via a credit report that XXXX XXXX XXXX accounts had been started in my name using an address I was no longer living at. I have never had a XXXX XXXX plan and have always been on an XXXX XXXX XXXX family plan with my parents and siblings since I was a teenager. That plan is under my parents ' name and I have never had another cell phone that was not on their plan. At some point around this time I also received a call from a debt collector ( XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX, MN XXXX ) trying to collect on this / these account ( s ). When I discovered all this I tried to report ID theft on the XXXX XXXX website, but it said I needed a police report in order to start the ID theft process. When I went to a police station and tried to submit a police report I was told I needed a paper copy of one of my bills that had the account number on it. But as far as I know I had never received any bill because the address used to open the accounts was one I was no longer living in at the time the accounts were apparently opened. Subsequently as I was going back and forth between XXXX, debt collector and police department, I saw that on my credit report the debt and the accounts associated with it had disappeared, and there were no outstanding debts listed as being associated with my name or my credit report. Although I had not successfully filed a police report I took this to mean that somehow the companies involved had understood that it was fraudulent debt, and I stopped receiving any contact about the debt from collections. However a few years later I once again received contact about what is apparently the same debt from a different debt collector ( JEFFERSON CAPITAL SYSTEMS LLC, XXXX XXXX XXXX, XXXX XXXX, MN XXXX ). I first received contact from them via phone on XX/XX/XXXX but I believe they may possibly also have tried to contact me at my parents ' residence via mailmy parents subsequently forwarded several bills to me from the debt collector. The bills I have on hand are dated XX/XX/XXXX and XX/XX/XXXX but they have sent several others as well. At this point I am once again attempting to navigate the process of disputing the debt and having it removed from my credit report.

Consumer Complaint: On XX/XX/2022 I have disputed a debt on my credit that is not my debt almost 5 times now. I have asked XXXX to investigate this issue properly. I asked for them to please ask the credit company Jefferson Capital Systems who is reporting I owe {$1200.00} for XXXX. This is not my debt, I have never opened a account with XXXX for { {$270.00} I have asked XXXX to request proof of this debt as the law states. There has been no proof of what Government Issued ID was used to open this debt. What city and state was this debt opened. This company Jefferson capital systems just writes that the debt is valid and XXXX just keeps it on my debt. Under section 611 of FCRA they have to actually do some investigation work and verify this debt is real and my debt. Its caused problems with my life. Also how would XXXX let someone have a {$1200.00} phone bill!!! phone bills on average are $ XXXX is a fraud debt and needs to be removed immediately. XXXX is just using a computer generated system to get a response from Jefferson capital and all they have to do is say " yes '' the debt is valid and XXXX reports this!! XXXX and Jefferson capital should be responsible for the problems this has caused me and my family and it shouldnt be up to the consumer to seek legal action when XXXX isnt following the law. They should not be allowed to control a debt score if they dont follow the law.

Consumer Complaint: Jefferson Capital Systems LLC is running a fraudulent company. They are claiming I owe XXXX XXXX {$430.00}. This is impossible considering I currently have a wireless XXXX account that I pay monthly bills for. I have contacted them and they told me I am completely up to date with my payments. If this debt was true, XXXX would have contacted me or not let me sign up with them in the beginning until I rectified this " debt ''. I have googled this " Jefferson Capital '' and there are 100 's of reviews all saying the same thing. They all state that this " company '' is inventing XXXX debts with people or they are buying very old debts and " re-aging '' them to make them look more recent, so they will not drop off people 's credit report. I am very discouraged because I have been working to build my credit and this fraudulent company is trying their best to undo my work by conducting a massive scam. This company needs to be investigated and stopped immediately.

Consumer Complaint: I am writing to alert the Consumer Financial Protection Bureau of a collections company that is violating my rights and not using proper communication methods when showing up on my credit report. I need the CFPB office to please look into my case. This JEFFERSON CAPITAL SYSTEM accounts with a balance of {$3400.00} and {$2400.00} has just popped up on my credit report without ever communicating to me. There was no written letter to me or calls to me so I can explain that they have the wrong person. They have recently just popped up on my credit report and I am not familiar with how they got my information or how they have my social security number. I do not owe this company and I Right now I am getting an alert on my XXXX XXXX and credit monitoring service saying my credit score has dropped tremendously. I can furnish the images of this alert showing the collections company. They are hurting me financially and this is a really big issue. To my understanding they must be compliant with laws and regulations that say they must write the consumer within days of the first communication. They are using my credit to communicate with me yet they NEVER wrote me before. If they don't write me then how could send me a right to dispute or explain my rights? Please review the original paperwork for this account. I request they send me a copy of this information to my address. I also request the original contract signed showing my signature long with all other pages of the original agreement. I am suffering damages because of this error. I have been a victim of ID theft before and I monitor my financial affairs very closely. To me this seems like an instance of debt parking that I read about on the FTC website. The Federal Trade Commission has taken action against debt collection companies that allegedly placed bogus or highly questionable debts onto consumers credit reports to coerce them to pay the debts. They label this as DEBT PARKING. The Federal Trade Commission recently took action against a Missouri collection company and its owners, alleging that they collected more than {$24.00} million from consumers, largely by placing bogus or highly questionable debts on their credit reports. The defendants used this illegal debt parking to coerce people to pay debts they didnt owe or didnt recognize, XXXX XXXX XXXX director of the F.T.C.s bureau of consumer protection , said in prepared remarks about the agencys settlement with the company, XXXX XXXX XXXX XXXX I DO NOT HAVE ANY BUSINESS RELATIONSHIP WITH THIS COMPANY and I am concerned they have unethically acquired my information and they are acting unethically with their debt collections. There is a process in law that protects consumers from these illegal actions. This account is lowering my credit score and if I am declined for anything, I will seek financial remedy by talking to a fdcpa lawyer.
