After I got the card in the mail, I logged into the same account I used to sign up and they would not let me unless I consented to receive Texts and calls so I called and spoke to XXXX, a supervisor who confirmed that CapitalOne requires consumers to agree to calls and texts for marketing and other reasons as a required condition to use the website - even though I used the website to get the card in the first place.

Consumer Complaint: on XX/XX/XXXX I was scammed via XXXX messenger. I sent a XXXX for {$800.00} to XXXX for XXXX XXXX tickets- and no tickets were delivered and I was immediately blocked on FB messenger. I reported it to my bank, Capital One within minutes. The service rep I talked to on XX/XX/XXXX said they would be able to get my money back and I would see the credit back to my account within 10 days. That did not happen and there has been no follow up from cap. one. I followed up with Cap One on XX/XX/XXXX and found that the claim was denied and closed. I explained that the previous rep said my money would be returned. They offered to reopen the claim. Once again, there was no follow up from Cap one. I called again today and was told that the claim was denied again and that basicallythey are not legally required to protect your money from XXXX transactions. I've also reported my scam to XXXX and the FBI. A large bank like CapOne should protect our money- specifically if a scam is reporting within minutes of happening. Scams are going to become more frequent - banks need to protect us. In my situation, I thought I was talking to someone I knew and I thought I was " being smart '' to only send half the money, get XXXX the tickets delivered and the send then other half. I saw images of the tickets- so they seemed real. The person on the other side chatted with me as if we knew each other, so I had no reason to believe it wasn't her. Reported to cap one XX/XX/XXXX at XXXX Followed up with Cap one on XX/XX/XXXX. Claim was closed. They re-opened. Followed up with Cap one on XX/XX/XXXX. Claim was denied a second time. They said there was nothing they could do as they aren't legally required to do so. XXXX XXXX. no : XXXX

Consumer Complaint: I hope this letter finds you well. I am writing to express my concern regarding the reporting of transactions or experiences between myself and Capital One on my consumer report, which is a clear violation of the Fair Credit Reporting Act ( 15 USC 1681a ). Which clearly states that you can not report late payments to a third party data furnishing company that you do not own ( other than agents of the institution ). The Fair Credit Reporting Act ( 15 U.S. Code 6803 ) also states that you can not disclosure any non public information about me without my knowledge or expressed consent. According to Congress, CAPITAL ONE may also be in violation of 15 U.S. Code 2068, which clearly states that my consumer report can not be distributed in commerce if the manufacture knew or should have known of such voluntary corrective action. In addition the Fair Credit Reporting Act ( 15 U.S. Code 2069 ) states that aforementioned violation of 15 U.S. Code 2068 requires monetary relief not to exceed {>= $1,000,000}. I have identified the following issues : Late payments ( transactions or experiences ) being furnish on my consumer report. I believe these matters warrant resolution before resorting to arbitration.
