Issue: Incorrect information on your report
Subissue: Personal information incorrect
Consumer Complaint: On XX/XX/XXXXXXXX I applied for XXXX XXXX benefits due to all the stress that I had been going through since there is false information being portrayed from accounts that where opened online, funds where deposited elsewhere and not to my personal checking account XXXX is my routing number and XXXX is my account number that is under my real name XXXX XXXX XXXX someone opened up a fake account in XXXX XXXX under a false name and number since they were only capable of writing XXXX XXXX and my ssn number that clearly is not what resembles on my physical SSN card because it has all 4 of my names on it. I believe it was my old roommate who self evicted me and stole my stuff including my lap top and was able to get partial information about me that allowed him to get a enormous amount of credit lines through online websites and I had not gone out of my way ever since my last car loan with XXXX XXXX in the year XXXX because I always make it my goal to use my sensitive information to get car loans or personal loans in person and never online how many of the fraudulent accounts show I did I am positive it is his because when I was getting unemployment benefits and went out of town the bank caught my old roommate removing XXXX $ from that account which they gave me back after they investigated and looked through the video footage of the ATM where he removed the cash from not far from where we used to rent together along with 6 other people but he was a XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX. I tried contacting the XXXX XXXX police department but they were of bo help since they said that they don't deal with civil cases and if I wanted something done I had to go to court but other than standing by as I retrieved all my belongings and fit what I could in my XXXX I ended up loosing the court case of getting a restraining order against him because XXXX XXXX believed all the fake witnesses he brought to testify under my name. I do have messages from XXXX XXXX sending me pictures of my stuff in the street and even saying that he tried to look for me at XXXX XXXXXXXX XXXX XXXXXXXX XXXX california XXXX which is my father 's house that I had not lived in since XXXX so that's how I concluded that he was the culprit as to who opened those fraudulent accounts under my name because he never knew my full name or ever knew where I was staying since I've been homeless for the past 2 years because I don't pass credit checks due to all the damage he has caused me in a mental level which I thought was somewhat impossible but once I became a first hand victim of his mental torture I realized that he went to prison for a reason I just never knew for what because he had already self evicted me on his own without being the main man who collected rent. So everything that says XXXX XXXX and his old number XXXX are accounts opened by him not me due to the fact that no contract has my signature or my whole 4 names.

Consumer Complaint: " Did you change your mobile number? Lets make sure weve got the right number. XXXX, Looks like the mobile phone number we have on file for you may be incorrect. This could be the result of changing your phone number and/or mobile carrier. Please update your mobile number so you can receive important account alerts. '' I received an email ( above ) from Capital One at XXXX on XX/XX/XXXX while out of town at a business event. I raced back to my hotel room to check if my identity was stolen which had happened a month prior with another credit card. I logged on to the Capital One to find my phone number had not been changed. I called Capital One customer service and the first rep. denied it was sent, then I spoke to a supervisor and she admitted it was sent but could not explain why it was sent. This erroneous email caused me stress and lost time ; as I noted I just had a identity theft breach on another credit card. This is wholly unacceptable.

Issue: Advertising and marketing, including promotional offers
Subissue: Confusing or misleading advertising about the credit card
Consumer Complaint: In XX/XX/XXXX I was presented with an offer in the Capital One mobile app offering me 6 months of XXXX XXXX ( premium {$9.00} monthly service ) credits if I signed up. I signed up and cancelled early ( XX/XX/XXXX ). 5 months later I was presented with an identical offer stating another XXXX months free of XXXX XXXX credits were available to me. This advertisement insinuated that this trial was available again to me for another XXXX months. I signed up again in XX/XX/XXXX by clicking the promotional advertisement that was re-offered to me for XXXX months free. I received my XX/XX/XXXX reimbursement of {$9.00} but never was reimbursed for XXXX, XXXX, or XX/XX/XXXX for total charges of {$29.00}. I called Capital One XX/XX/XXXX asking about this reimbursement and they informed me that I had already used the promo trial and I will be responsible for the remaining months, despite presenting a promotion insinuating that I'm eligible for another 6 months. They agreed to credit one month for {$9.00} but not the remaining months. I feel this promotion was completely misleading and false. Had they not presented it as another 6 months of the credit ( 5 months after I had already cancelled the trial ) I would never have clicked on it. I would expect them to change their promo to myself and others who have cancelled mid trial to state something like " You have 2 months remaining of credits '' and not present in a way that you have another 6 months. I'd also expect them to reimburse me for this misleading marketing. Capital One employee who helped and case number listed below XXXX XXXX ID XXXX XXXX XXXX

Capitol One and XXXX XXXX have yet to respond. Dates of correspondences were XX/XX/2023, XX/XX/2023 and XX/XX/2023. Which violates the above law. The IRS considers canceled or forgiven debt as income. You may need to pay taxes on the canceled debt amount reported on the 1099-C form. The amount you'll have to pay depends on your federal tax bracket and whether you qualify for an exception or exclusion. The amount in box 2 of Form 1099-C may represent some or all of the debt that has been canceled. The amount in box XXXX will include principal and may include interest and other non principal amounts ( such as fees or penalties ). Unless you meet one of the exceptions or exclusions discussed later, the amount of the debt that has been canceled is ordinary income and must be reported on the appropriate form, as discussed earlier Capitol One and XXXX XXXX were negligent in sending me a 1099C. Issue: Problem with a purchase shown on your statement
Subissue: Credit card company isn't resolving a dispute about a purchase on your statement
Consumer Complaint: I stopped doing business with XXXX in XXXX. The company refused to cancel my subscription. I contacted Capital one Walmart mastercard. The company said that they would put a block on the merchant so that they can not submit charges again. Since that call, I also request new card with new number to the issue. After that call on about XX/XX/XXXX, I have report by email from Capital one that there were daily charges attempt by XXXX, but were declined because there is insufficient credit card. I have a payment coming up, and there will be enough credit for this charge to go through. I call capitalone on XX/XX/, and spoke to XXXX, who told me that the merchant was not blocked because they ( Capital One ) is investigating. They said that if they allowed the charge to go through, they can launch a dispute with the merchant afterwards. This is almost ridiculous. I believe if I am responsible to pay the card, then if I direct them not to pay any merchant out of my account, they should implement that, and if the merchant does not like this, it should be between the merchant and myself
