Subissue: Reporting company used your report improperly

Consumer Complaint: In accordance with the Fair Credit Reporting Act, this creditor has violated my rights under 15 USC 1681 section 602, states that I have the right to privacy ( 15 USC 1681 section 604 ( a ) section ( 2 ) It also states a consumer reporting agency can not furnish an account without my written instructions under 15 USC 1666b, a creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose. I do not give permission to report to my consumer profile/report and that you remove all fraudulent accounts immediately. There should not be any damages on my report as this is a defamation of character causing personal injury. I have been constantly harassed by these 3rd party collection companies. I have also received a response that clearly violates my rights according to HIPAA reporting & selling my information to those 3rd parties. I have thoroughly reviewed my credit report and I would like to inform you of the inaccuracies it contains. I am requesting, under the provisions of the Fair Credit Reporting Act ( FCRA ), 15 USC section 1681i, that you investigate these accounts, remove ALL inquiries, pay me for violations, and update my credit report immediately I opt out of all 3rd party consumer credit reporting.

Consumer Complaint: 1026.13 - Billing Error Resolution 1. Creditor 's failure to comply with billing error provisions. Failure to comply with the error resolution procedures may result in the forfeiture of disputed amounts as prescribed in section 161 ( e ) of the Act. ( Any failure to comply may also be a violation subject to the liability provisions of section 130 of the Act. ) 2. Charges for error resolution. If a billing error occurred, whether as alleged or in a different amount or manner, the creditor may not impose a charge related to any aspect of the error resolution process ( including charges for documentation or investigation ) and must credit the consumer 's account if such a charge was assessed pending resolution. Since the Act grants the consumer error resolution rights, the creditor should avoid any chilling effect on the good faith assertion of errors that might result if charges are assessed when no billing error has occurred. billing error on my credit report the payment for the car went to the treasury of that account capital one financial is not the trustee it is XXXX XXXX XXXX payment was sent to the treasury and therefore this is a billing error that continues to show up on my credit report

Issue: Getting a credit card

Subissue: Sent card you never applied for

Consumer Complaint: I recently received a credit card in the mail from CapitalOne that I never applied for. I never even considered opening an account with them. When I called CapitalOne they passed me to their fraud department who claimed that I DID apply for it, but they would start their investigation into it as a fraud complaint. They then informed me that it would take 90 days to clear/correct my credit reports. Didn't the Federal Trade Commission ban the unsolicited mailing of credit cards way back in XXXX?

Issue: Other features, terms, or problems

Subissue: Other problem

Consumer Complaint: On XX/XX/2023 I opened a 360 Checking with Capital One Bank. I opened it in person at the Capital One XXXX in XXXX, Louisiana. I funded the account right as I opened it. The woman who I opened the Account with was named XXXX. I passed all the background checks. I had my Valid Photo Drivers License, Passport, and original Social Security Card. XXXX provided me with Forms with my " New Account # and Routing Number '' to send to the 2 companies that would now be making Direct Deposits to my Account. I made clear to the Banker that I would be doing 2 DIRECT DEPOSITS PER MONTH. They are as Follows : 1. Social Security Full Retirement Check. 2. A Pension Check Paid Monthly This Qualifies me for a Capital One Bonus of {$350.00}. Next : I opened a Capital One XXXX Account. I was then PRE-APPROVED for a SAVOR CREDIT CARD by CAPITAL ONE. I now have XXXX Accounts with CAPITAL ONE BANK. I was then shocked by Capital One. The US Post Office sent me 2 envelopes both had been sent by Capital One, I couldn't believe what I was looking at. Both addresses were written in an absolutely discombobulated way. Even the POST OFFICE placed a " Stamp on the Envelope commenting on it. This was my first negative experience with Capital One. They were given my complete correct Mailing address right in the Bank. They clearly can not address an envelope to a Banking Customer that is correct. Next, anytime you contact Capital One by telephone you are connected to a XXXX XXXX center. The 6 or 7 times I spoke to them you could not understand what the person was saying. There English was unintelligible. These calls are taped. They will clearly validate what I am stating as Fact. I have PERFECT CREDIT. This a FACT. I do not have 1 negative mark on any report. 5 Days Ago I could not believe what Capital One did. Without sending me a letter, without contacting me by telephone CAPITAL ONE placed a RESTRICTION ON MY CREDIT CARD. I had just sent them a {$100.00} Payment and with no forewarning I was at XXXX and my Savor Card was declined. I am a Certified Paralegal. Capital One has broken the Law. They have violated the rights of this Account Holder. To place a Restriction on a Customer with 3 Accounts Legally you must take the perfunctory steps of proper notification. Capital One violated the law. They just went ahead and performed this extreme step. If Capital One makes 1 move to ruin my Perfect Credit they will face MAJOR LITIGATION!! Here I trusted this Bank and moved my 2 Direct Deposit Checks to this Bank. I want to state as fact that The Savor Card gives an Account Holder a {$200.00} Bonus for spending {$500.00} in 3 months. I was {$250.00} shy of this goal when they restricted this account. How convenient of them. Now they committed FRAUD AGAINST ME. Capital One as a Bank bestows major problems on its Customers. If they place 1 negative mark on my Credit Report I will sue this Bank.
