Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 ( a ) states there is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX, XXXX, and XXXX are consumer reporting agencies, and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states It is the policy of the Congress that each. Financial institutions have an affirmative and continuing obligation to respect the privacy of their customers and to protect the security and confidentiality of those. Customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 ( a ) section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX, XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), but no consumer reporting agency may also make any consumer reports containing any of the following items of information. Adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission, which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681 ( e ) states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681 ( b ) of this title. XXXX, XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.

Consumer Complaint: XX/XX/2023 XXXX XXXX Director, Consumer Financial Protection Bureau Attn : XXXX XXXX Complaint Per the FCRA as a federally protected consumer I am now opting out of any and all authorization. I, the consumer may have given you written, unwritten, verbal and non verbal Per 15 USC 6802. Effective immediately ; indefinitely. According to my credit reports, there are third party reporting agencies reporting my private information to all three credit bureaus, which is a violation of my Privacy Right, ( Privacy Act of 1974 ) Also, there are charge offs listed on my credit reports. A charge off is considered a Certificate of Indebtedness, which means it is income and has to be removed. Income can not be reported to my credit report. The law says it's illegal to report transaction history. All bank accounts are insured per 15 USC 1681, I have not received any interest or payment. I gave them a security 16 CFR 444.1. There are Inquiries ( Promotional Inquiries ) 15 USC 1681 Permissible Purposes, {$1000.00} fine each occurrence. ( sent to the address listed above ) Lastly, I've been suffering tremendously because of these issues listed above. Ive been humiliated from being denied cars and homes, credit etc. Brokers/banks/lenders not accepting my applications. Telling me I need a XXXX deposit. I've been homeless because of this. For pain and suffering, humiliation, emotional damage etc. A {$20000.00} XXXX XXXX Dollars payment can be sent to the address above. Also, all negative reports should reflect good standing. Consumer Complaint: Restricted account with no reason Capital One credit card. They requested statement from my linked account. I did send it but there some problems. Ok. I went to the brunch and they give me 2 docs, I send it to them. 3 week no phone call from them. I have call them, so they just closed the case and account remains restricted. Consumer Complaint: I am filing this complaint in regard to deceptive practices of the Capital One Financial Corporation and request you conduct a full investigation of possible Servicemembers Civil Relief Act, Military Lending Act and Truth in Lending Act violations. When I applied for the Capital One Venture Card I was told that annual fees were waived for military, no additional stipulations were mentioned. This is still reflected on their website, please see attachment Capital 1 ad. On Sunday XX/XX/2023, I called Capital 1 customer service to ask about a pending annual member fee for {$95.00}. I was transferred to a supervisor, XXXX XXXX ( Employee ID XXXX ) who told me that fees waivers were no problem but that fee waivers were only available after the charge had been applied to the account. After the annual fee when through I called back on the evening of XXXX XX/XX/2023, I was told by XXXX ( Employee ID XXXX ) that no fees waivers were available and that they could not and would not waive my fee. I informed them about my rights under the SCRA, MLA and TILA acts and that there should be no annual fee assessed based on those and on their advertising. All these conversations were on a recorded line, according to their disclaimer. I mentioned I wanted to take my complaint to the Consumer Finance Bureau and requested all records and account notes taken. XXXX refused my request to obtain records, refused to confirm she would preserve records, explain the discrepancies between capital one ads and the fee waiver refusal and refused to evaluate my fee waiver request under the MLA participation fee clause. I ask the Consumer Finance Bureau to conduct an investigation, I suspect they are victimizing thousands of military members who sign up for their credit cards believing there are no annual fees and lower interest, pulling a classic bait and switch. I would at a minimum like a refund of my annual fee of {$95.00}.

Consumer Complaint: Capital One has continued to call after multiple requests asking for them to Cease and Desist. Every time they call, Im told that there is no note or no record of anyone entering a cease and desist. Im still getting calls almost two months after the initial request was completed. Each person says theyre going to file it, but no one does. Ive told them of my hardships and they continue to send me notices saying they will help with payment options, but when I try to, I dont ever qualify for anything that will help. What they are trying to do is make sure that I dont eat or lose my electricity or anything they can do to get their money back. They lie to consumers about abilities to reduce APR and other customers get APR reductions when asked, but anytime I call, they say that it is not something that Capital One does. They have also violated CFPB regulations by refusing to escalate complaints on these things to their Level 3 escalation team or their Executive Office. Im told that I cant speak with those levels and they dont take complaints.

Consumer Complaint: The charge on the account was fraud. I never used the account. Capital One refuses to take a fraud report and refuses to close the account without me sending personal information such as bank statements. They also are refusing to close the account until I provide them with payment for the balance. They continue to charge interest and late payments and report to my credit union.
