Consumer Complaint: I purchased a car XXXX XXXXXXXX XXXX finance through Capital one Auto Finance XXXX and i also purchased the gap insurance thinking if i get into a car accident the car would be paid off. XXXX month later i got into a bad car accident the car was totaled. My insurance told me that they could pay the car off but i would still owe a balance of XXXX found out that Capital One over charged me for the car and now i still owe them a balance {$1000.00}. When i was out do to the car accident i got behide on my bills. The account went into Collection now it's on my credit report and i need it removed. Due to Section 602 and Section 604 A Capital One Auto XXXX Account ending XXXX

All my checking account was withdrawn by someone.Let me talk about capital one bank explain.All the explanations dont make sense. Second because I asked for statements to report police and sent me to XXXX that address.Your bank workers just added to account which is identity theft opened.After XXXX, your bank just send me mail about statements.Thats why my true address is linked to this fraud account. Third, On XXXX, I never said its my account. I have said many time I dont have capital one bank mobile app because someone open that under my name.My phone number is XXXX, Never use that phone number begins XXXXPlease confirmed the right number called capital one bank on XXXXif it was XXXX, I called your bank said it was not my phone number Since XX/XX/XXXX. The only one time I sent a copy of Id and social security copy and police report on XXXX XXXXAt last, My ID was stolen by someone, they have my social security number, too.So they do everything.So you confirmed all information is mines. I report police my id and social security was stolen by someone.Even those information can not be reason to prove it is mine open the fraud account, too. I am a pity victim. I have closed all my checking account, and my credit score dropped down. I have so tired to solve identity theft which cost a lot hurt and money. You are such a company which have so many customers.You dont care one consumer just like me. I am one hundred percent doubt about when identity theft open account, your bank check address and phone number or not.Because my credit report did not have this address ( XXXX XXXX XXXX ) on there. I totally think about this was your banker problems.Because of your negligence, I become a victim of identity theft.When this happened, capital one bank attitude totally hurt me.When things happened, they put all liability or responsibility to me.All the time you dont trust me, and never tell me how can I dispute all charges and always refuse to let me provide any evidence.Even capital one workers talked about beneficiaries about this fraud account, capital one refuse to tell me. If I am owner of this fraud account, I dont have right to know, too. Consumer Complaint: 1st. I received a summons to appear in court. I had received no notice of closure of the account. I received no other contact via mail. I did not receive a notice 15 USC 1692g ( d ). This is a clear violation of my rights and I expect it to be properly investigated and prosecuted. 2nd. The sum being requested for repayment far exceeds any credit account that I ever have had in my life. No amount of garnered interest can account for the inflated demand of the litigation. ( {$9400.00} ) 3rd. The suit is being brought forward by XXXX XXXX XXXX in XXXX registered XXXX XXXX Nonclassifiable Establishment. This seems like an obvious deception attempt. Wouldn't a Law Firm that was providing strictly legal services register as NAICS 541100 - Legal services. They can't register as a legal service because they are providing ( financial services ). But they can't register as a ( Financial services ) because that would make them a junk debt buyer and then they couldn't sue on behalf of there clients if you guys actually put 2 and 2 together. 4. Also lets take a look at this " Nonclassifiable Establishment '' XXXX registration because XXXX XXXX XXXX is where they lawsuit was filed. In XXXX they have registered agent with a company called XXXX XXXX XXXX XXXX Who also has a registered agent with a company called XXXX XXXX XXXX out of XXXX XXXX XXXX Now here is the kicker, XXXX XXXX XXXX has a registered agent of XXXX XXXX XXXX XXXX XXXX who has listed XXXX XXXX XXXX as there registered agent. This means that those entities loop back onto each other. I'm sure there is nothing illegal about that right. I also noticed that the cfpb seems to not take the side of the consumer even if that is directly in the name. How do I know this well i have looked and seen all the complaints that have been brought forth to you about this company and it appears all they need to do is just say hey guys we did our job right and you all brush it off. So I will be including a copy of this notice to a large panel of our elected officials. Your boys club protecting the debt collectors is over.

Consumer Complaint: Hello, my name is XXXX XXXX XXXX, I am filing this complaint against Capital due to these reasons : In XXXX, I applied for a Walmart card and was given my Walmart card by XXXX XXXX XXXX. As soon as I received it, I set up auto-pay with XXXX XXXX In XXXX, the card was transferred to Capital One Bank without my knowledge. I wasn't even using the card at that time and never activated a new card with Capital One. Now, in XXXX, I went to the Walmart store and used my Walmart app to make a purchase. I was under the impression that I was paying with my XXXX account and that the auto-pay I had set up was still active. Months later, I saw late payments being reported by Capital One. When I reached out, they said I had a new card and that there was no auto-pay. I feel this is really unfair since I never activated a Capital One card, let alone used it. Also, I am a frontline worker and was traveling during XXXX to service IT accounts of hospitals. I want to clarify that I am a person who has always paid on time, I even have two accounts with Capital One Bank National. One opened in XXXX and the other in XXXX. In both I have an exceptional payment history, I have never been late, I am a responsible person and I have tried to build a good credit record. This situation affects what for many years sacrifices I have tried to build with my payments on time. Please see attached proof that I was on autopay with XXXX XXXX Thank you!
