Consumer Complaint: The company is reporting a 30 day late payment for XX/XX/2023. The reporting of this late payment violates the Fair Credit Reporting Act because experiences and transactions between the consumer and the person making the report are excluded. Also, a creditor may not treat a payment on a credit card account under an open-end credit plan as late for any purpose unless the creditor has adopted reasonable procedures under " Consumer Credit Cost Disclosure '' and those procedures are mailed. I also never provided any expressed written consent for a late payment to be added to my credit report.

Consumer Complaint: I had a charged off account with Capital One dated back in 2018, after several attempts both Capital One and I had agreed to settle the account for less than what was charged off. Capital One had a law firm by the name of XXXX XXXX XXXX representing them. It was agreed upon payment that once I paid the balance that they would remove the negative account from my report. I have tried several times to communicate with Capital One and let them know this negative account was still reporting on my credit report after I had paid the agreed balance. Now Capital One is telling me that they do not do pay for deletes, but it was agreed upon with their lawyers and sent that agreement to me as well. Capital One was willing to work with me and help me remove this negative item, now years later they are saying that they will not do such or that they can't " find '' that agreement that would remove this negative account.

Consumer Complaint: I have three credit card accounts with Capital One that have been closed. I believe this adverse action is a retaliatory act against me exercising my right to accept my remittance coupon and instruct it to be applied to my account for payment. For account one, On XX/XX/2023, I sent Capital One an accepted payment/remittance coupon for {$3000.00}. I also provided them with a notarized Power of Attorney ( attached below ) acting as agent to my principal 's account. I included instructions ( attached below ) to apply the principal 's balance to the principal 's account for set-off each cycle. I also included the Federal Reserve Act Section 16 as support that my instructions were lawful, with all notes being obligations of the United States. On XX/XX/XXXX, I received correspondence from Capital One Customer Care Team ( attached below ) addressed to the principals account, and not the natural person/agent who requested the written correspondence, and provided the Power of Attorney over the principals account. Capital One made the claim that You are currently listed on this account as primary account holder. As primary account holder, you have full access to the account. I believe this to be a deceitful attempt to ignore my Power of Attorney stating that the natural person is acting as agent to the principals account, by sending correspondence to the principals account and stating that the principal does have full access to the account. On XX/XX/XXXX, Capital One sent correspondence ( attached below ) to my principals account stating, We are closing this account because activity on this or another account is not consistent with our expectations for account usage and violates the Capital One Customer Agreement. Please stop using this account immediately and destroy any cards and checks associated with it. Also, you should update any recurring payments you have set up using this account You are still responsible for paying the full amount of any remaining account balance and youll continue to receive billing statements until the balance reaches XXXX. On XX/XX/XXXX, I mailed a reply to Capital Ones correspondence ( attached below ) clarifying the definitions of capacity I was acting in with the Power of Attorney I submitted. I also enclosed multiple supporting documents such as the FDIC Revised Policy Statement on Securities Lending to support my claims. I also noticed in my portal for Capital One App that the subject line for one of their letters they mailed me was Generic Letters, which led me to believe they found my instructions to be generic, so in my letter mailed on XX/XX/XXXX, I wrote a handwritten letter and clarified any confusion regarding generic letters. I requested a written explanation for my account being restricted, and informed them that I believed they were in violation of 42 USC 12203- Prohibition Against Retaliation and Coercion. I also requested proof of accounting. I concluded with giving Capital One five days to provide remedy by following my original instructions of transferring the principals balance to the principals account each month for set off. On XX/XX/XXXX, I received correspondence from Capital One stating Thank you for contacting us about the terms on your Capital One Walmart Rewards Card account. Your current terms are listed below on the following pages : Capital One failed to provide me with a specific explanation as to why my account was restricted, or proof of accounting. For Capital One account two, on XX/XX/2023, I mailed them a written letter stating there was a billing error in requesting me to send a portion of my statement and a check or one money order I went on to express that, Once I have enclosed and accepted my payment coupon, it should act as the payment/tender/financial instrument itself. Before I had an opportunity to mail this letter to Capital One, on XXXX XXXX they had already taken adverse action against me and closed my account ( letter attached ). They also closed my third account and sent written correspondence that was written on XX/XX/2023.

Consumer Complaint: This is a repeated complaint regarding CapitalOne 's annual fees and resulting lates fees, finance charges, and negative credit reporting. I have several cards, most of which I've had for many years, maintain in good standing, and most I keep completely paid. When I don't use the cards for an extended period of time, I should not be charged and annual fee. If I am using a card, and receiving the cash back benefits, then paying the fee is not unreasonable. Contrary to policy several years ago, CapitalOne now " automates '' the process of waiving annual fees and late fees, instead of allowing and empowering the individual phone agents with the ability to view the accounts ' history and offer the accommodation ( s ). The specific card is one of several I have not used for many months, yet is being charged an annual fee, subsequent late fee, and related finance charge.

Consumer Complaint: I made a charge on my Capital One Venture Credit Card in XXXX. The exchange rate was 12 % less than what was advertised by Visa. Per Capital One : They do not charge any bank fees on foreign transactions and the Visa rate should be the rate reflected on my transactions. MY charge is currently being disputed and took some pushing on my side for them to understand what was going on and even dispute the charge. But given the size of Capital One and Visa this could either be a honest mistake, that needs to be rectified quickly for many card holders. Or possible intentional fraud that can push millions in profits towards these companies that needs to be investigated and rectified.

Consumer Complaint: I opened two Capital One Accounts two years ago. I have remained in good standing with both accounts. I was never late on any payment with Capital One. In the beginning of the XXXX billing statement I contacted Capital one and informed them that I was getting a promotion and the XXXX XXXX XXXX at my employer would be changing my direct deposit date. Consequently, I would be paying my credit card bill a week late. I was pro-active and extremely diligent in my efforts to remain in perfect standing with Capital One. Unbeknownst to me, Capital One continued to process my payment via. my XXXX XXXX XXXX account and the payment was declined. They tried again to process payment a day later and the payment was declined once more. On XX/XX/2023 Capital One closed both of my Credit Card accounts. I was extremely disappointed and tried my best to remedy the situation. Unfortunately, my accounts remained closed. Capital One couldn't give me any reasonable reason except it was system generated. I would like both of my credit card accounts reviewed and re-opened.

Consumer Complaint: I was running a credit of {$15.00} with my Capitol One credit card for over 10 months and knew I did not use the card so was not worried about my statements. Then when trying to buy a house I learned from my lender that my credit score tanked because of delinquent payments. Upon review, Capitol One added a membership fee of {$39.00} in XXXX of XXXX, because of the credit on the account that brought my balance to {$23.00}. Not knowing of the membership fee I did not pay the balance. In XXXX the amount I owed climbed to {$38.00}, in XXXX to {$73.00}, in XXXX to {$110.00} and that is when my lender discovered what I owed and I immediately paid it. However, the damage had been done and now I am unable to purchase a home. It was not because of a line of credit the company gave me but because I did not pay a membership fee. No additional outreach was done to me to let me know the fee was accruing interest and my credit score was being destroyed even though the company had my address and phone number. When I reached out to Capitol One yesterday ( XX/XX/XXXX ) I was told to write a letter and they would review it but it would take up to three months to resolve if it was resolved at all. In the meantime, my credit is ruined over a {$39.00} membership fee.
