Consumer Complaint: Below is my validation request from Capital One Bank. To Whom It May Concern : In conformance to my rights under the Fair Debt Collection Practices Act ( FDCPA ), I am requesting you to provide me with a validation of the two debts that are listed on my credit report. Please note, this is not a refusal to pay, rather a statement that your claim is disputed and validation is demanded. ( 15 USC 1692g Sec. 809 ( b ) ) I do hereby request that your office provide me with complete documentation to verify that I owe the said debt and have any legal obligation to pay you. Please provide me with the following : Agreement with the creditor that authorizes you to collect on this alleged debt. The agreement bearing my signature stating that I have agreed to assume the debt. A complete and correct social security number that may help identify me as the party you are collecting from. A copy of the government issued Identification presented to incur this debt. Valid copies of the debt agreement stating the amount of the debt and interest charges. Proof that the Statute of Limitations has not expired. Complete payment history on this account along with an accounting of all additional charges being assessed. Show me that you are licensed to collect in my state ; and Your license numbers and Registered Agent. A purchase agreement or assignment from the original creditor to your company. Proof that this debt has not been written off as a tax liability and no 1099-C form received by the original creditor. If your office fails to reply to this debt validation letter within 30 days from the date of your receipt, all instances related to this account must be immediately deleted and completely removed from my credit file. Moreover, all future attempts to collect on the said debt must be ceased. Your non-compliance with my request will also be construed as an absolute waiver of all claims to enforce the debt against me and your implied agreement to compensate me for court costs and attorney fees if I am forced to bring this matter before a judge.

Consumer Complaint: on or about XXXX I called Capitol one to get advise to have XXXX XXXX added as an account manager to aid me when I was out of the country. Capitol one tried to get me to add XXXX XXXX to my account and give him a card. While talking to Capitol one on speaker phone with XXXX XXXX with me I refused to had him to my account or have him have a card. At that time XXXX XXXX already had 2 credit cards under his name with Capitol one. The person acknowledge it he was authorized to talk to Capitol one when I asked him to to resolve any issues just as someone at a company would have that option to clear up any matters. Where I go cell phone service it weak to none, landline are far and few. In fact I had an issue prior to having XXXX XXXX added as an account Mgr Capitol one would not talk to him they advised him to have me call collect. That does not work in the XXXX I tried I got the look go away they think I'm scamming them to make a call to the XXXX make them pay, THEY DO NOT UNDERSTAND THIS CONCEPT.. was stuck and screwed over by Capitol one. I also found out from XXXX XXXX that YOU CFPB Refused to help him out and Colluded with Capitol one helping them cover up their Gross Error and their Lies. XXXX. Capitol one has NEVER mailed anything OR called OR Left any messages of any sort to XXXX XXXX Per your report that you closed on him. Because of this Capitol one is still screwing up his credit report with my Credit Card that HE IS NOT AUTHORIZED TO USE. You sit there and tell him he is lying and so am I, when both of us were with the Capitol one rep as witnesses to their Fraudulent lies to force themselves on to his credit report. You get this fixed or I'm going over Your Head. XXXX XXXX is only an account manager to assist me when I can not. Do you get my understanding? this is my ONLY and FINAL WARNING. Capitol One Rep Steve over the phone told XXXX XXXX they unlawfully added him to my account without my Knowledge and forced a credit report under his name, that is FRAUD and ILLEGAL. Fix or or else. YOU WORK FOR ME NOT CAPITOL ONE.

Consumer Complaint: The creditor has not updated the information nor has provided proof, or documentation in regards to any late payments. They have not supplied this information and they must delete the alleged payments on my credit report. Under 15 USC 1666b, Timing of Payments, a creditor may not treat a payment on a credit card account under an open and consumer credit plan as late for any reason. Also 15 USC 1681e - compliance procedures, which clearly states maximum possible accuracy.

Consumer Complaint: My XXXXbranded credit card was moved from XXXX XXXX to CapitalOne last XXXX. I was signed up for auto payments. My XXXX statement clearly said that my XXXX bill would be paid in full by auto payment. However, no autopayment was withdrawn and my account was reported as " late payment '' to the credit bureaus. CapitalOne agreed to waive all late fees. Later, they realized the XXXX statement was not sent as it should and they further waived late charges and agreed to fix the credit report for issues relating to the XXXX statement. However, they never did correct my late payment ding on my credit report. When I wrote to them to ask that they fix it as they said they would, they simply said they were unable to approve a courtesy correction to my credit report. I do not believe that the late payment was any fault of my own. Rather, this was due to a CapitalOne error.
