Consumer Complaint: Attn XXXX : NOTICE TO AGENT IS NOTICE TO PRINCIPAL AND NOTICE TO PRINCIPAL IS NOTICE TO AGENT 15 U.S. Code 6802 - Obligations with respect to disclosures of personal information CAPITAL ONE it has come to my attention that you illegally reported my information to unaffiliated 3rd parties without giving me my disclosures. Pursuant 15 USC 6802 you are required by law to give me 3 disclosures I have checked all documents from your institution given to me and none of these documents contained any of the required disclosures pursuant 15 USC 6802 ( b ). ( b ) OPT OUT ( 1 ) IN GENERAL A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option. Consumer Complaint: I disputed two charges with XXXX after XXXX refused to help. Capital one asked me for proof of return, so I sent them the XXXX tracking numbers that XXXX provided to me which shows both were received by XXXX. That should be ample proof, yet Capital one, without even reaching out to me to ask for more detail, closed the disputes stating they didn't have the information I asked for. I wasted 40 minutes of my time today talking to an incompetent Account manager who didn't seem to understand what I was saying and not once did she say I needed to send screen shots of the XXXX site showing it was delivered. Why can't Capital one plug the tracking number into the XXXX tracking site and see that themselves? Takes seconds. I sent the screen shots today but have no faith after this they will handle accordingly an dthis is a prepaid account so that's my money. Not happy with how they have handled this nor their lack of decent service agents I will attach documents for more information.

Consumer Complaint: The purpose of the letter is to bring to your attention how the Capital One is Violating my Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681 Capital One bank is reporting unlawful information on my credit report under fair credit act law 15 us 1681eb. From my understand The Cares Act, which was signed into law on XX/XX/XXXX, Act amends the Fair Credit Reporting Act ( FCRA ) to stop adverse credit reporting during the COVID-19 crisisbut only under specific circumstances. ( See 15 U.S.C. 1681s-2 ( a ) ( 1 ) ( F ). ) Under the amended FCRA, if a " furnisher '' makes an accommodation because you were affected by COVID-19 during the covered period ( see below ), that furnisher must report your account as current to the credit reporting agencies, so long as you weren't already delinquent on payments. Capital One Bank had also reported card # XXXX as a charge off lost with the IRS in the amount of {$540.00}. When we had a mutual agreement for a settlement in the amount of {$270.00} which I paid to them XX/XX/XXXX. ( See Attachment ) Capital one is damaging my credit and trying to collect to still collect the full balance. The company had also reported a second card # XXXX as a full charge off with the IRS in the amount of {$460.00}. I refuse to pay the balance or do settlement because they didnt keep their or honor their word on the first credit card settlement. On XX/XX/XXXX, I called and spoke with a Customer Services Agent by the name of XXXX ID XXXX asking her what the charge off date was. She responded that she didnt know the charge off date and couldnt look it up. She then transferred me to an Account Specialist by the name of XXXX ID # XXXX. I asked him what the charge off date with the IRS was and he stated it was not charged off with the IRS. I explained they were reporting a write off to all 3 major credit bureaus ( XXXX, XXXX, or XXXX ). He then transferred to a Collection Account Specialist by the name of XXXX ID # XXXX. I asked XXXX what the charge off date with the IRS was and she stated it was charged off on XX/XX/XXXX. She then proceeds to tell me that I did not owe Capital One anything at all and they will mail me a letter within XXXX Business days. Hence, this conversation was recorded by Capital One in which they record all their conversations with their customers. As of today XX/XX/XXXX, I have yet to receive that letter from Capital One Collection Department as promised by Employee XXXX. Im requesting an investigation into the Capital One Bank business practice when it comes to the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681. And under Fair Credit Reporting Act 15 U.S. Code 1681e - Compliance procedures. ( a ) IDENTITY AND PURPOSES OF CREDIT USERS Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. These procedures shall require that prospective users of the information identify themselves, certify the purposes for which the information is sought, and certify that the information will be used for no other purpose. Every consumer reporting agency shall make a reasonable effort to verify the identity of a new prospective user and the uses certified by such prospective user prior to furnishing such user a consumer report. No consumer reporting agency may furnish a consumer report to any person if it has reasonable grounds for believing that the consumer report will not be used for a purpose listed in section 1681b of this title. ( b ) ACCURACY OF REPORT Whenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates.

The charge was for XXXX and glasses, the XXXX XXXX result was incorrect as I later went to another doctor, the fee also include an pair of glass which I was told to be ready in 2-3 Weeks and they will contact me once it's ready. 40 day passed by no call, then I tried to contact Bjs they told me it was ready but I never got the call ( They said they have contacted me mutiple time already ). They refused to refund. I have proof of phone call history where bjs never contacted me once!

I had a total of USD {$4800.00} in that account Theyve said that they will send out the money once the last pending transaction clear ( which already has ) and once they conduct their investigation but have given no time frame as to when that will be. This is all very frustrating because its my hard earned money and its not right that there keeping it hostage with out definite time frame as when the account will be fully closed and the money will be sent out.

Consumer Complaint: On XX/XX/XXXX, I was in XXXX XXXX, XXXX trying to get a XXXX XXXX parking ticket from a ticket machine. I do not read French very well. A guy offered to help me and I accepted. He fumbled around the machine, but he must have had a chip reader on his person, because he ended up charging a total of XXXX XXXX to a XXXX account, which I learned is like XXXX. Although I received a text from Capital One and I replied no, I didn't authorize such a charge, and I called Capital One immediately after realizing what had happened, Cap One insists that it is my fault, that it is a merchant dispute, that I owe them over {$5000.00}, plus interest, because I have not paid this unauthorized charge. Tow Capoital One cards were involved - one, with a small credit card, was absolved of the charge, but the other card, which had a much larger credit card, is the problem. I disputed the charge. Cap One took charges off a couple of times and then finally put them back on XX/XX/XXXX. I have emailed several times and sent a registered letter to supposed merchant and have not received a reply. The merchant is a midwife in XXXX. The fraud happened in XXXX XXXX. I am XXXX XXXX XXXX and do not need a midwife. Cap One doesn't care. They say a scam is not fraud. They say because I did not lose my card, it is not fraud. Why did one Cap One entity ( Spark ) acknowledge it as fraud and the other ( professional? ) not? Do they not care about their zero fraud poIicy? I want the charges and interest taken off my card and I also want Cap One to write the credit agencies to restore my credit rating.
