Consumer Complaint: I am a victim of aggravated identity theft, On XX/XX/2022 I have submitted the supporting documentation that the credit Bureaus asked of me certified mail the account was then removed then Re-Inserted without properly notification. Since then I've been constantly disputing this account and going back and forth with the creditor as well and still remains after asking for and not receiving verifiable proof with my signature on it.

Consumer Complaint: I contacted the customer service department to request a reversal of the {$10.00} interest fee that was charged to my account. According to my understanding, I should not have been billed any interest fees since I paid off the balance and consistently paid the statement balance each month. Unfortunately, my request was declined. Here are the details of my account activity : In XX/XX/2023, my statement balance was {$1100.00}, and the due date was XX/XX/2023. On XX/XX/2023, I made a payment of {$650.00}, which covered the required minimum payment of {$25.00}. Additionally, on XX/XX/2023, I made an additional payment of {$810.00}, totaling {$1400.00}. This payment exceeded the statement balance for XX/XX/2023, and I made it before the cycle ended on XX/XX/2023. When the XXXX cycle ended, my statement balance was {$530.00}, due by XX/XX/2023. Since my account is set up for auto payment of the statement balance, I expected not to be charged any interest fees. However, I discovered that Capital One billed me {$10.00} in interest. During my conversation with the representative, I was informed that because the full balance of {$1100.00} was not paid by the XX/XX/2023 due date, it broke the grace period, resulting in the interest fee. However, I explained to the agent that I paid off the entire balance before the cycle ended and that the transactions made during that cycle should not have accrued interest since they were part of the current cycle and did not exceed the 25-day grace period. I urge you to thoroughly investigate this matter as I strongly believe it to be a systemic issue. It is possible that other consumers are also being billed interest fees when they should not be, particularly after paying off their balances before a cycle ends. This practice appears to violate Regulation Z, as it involves overbilling consumers with unjustified interest fees. I kindly request a comprehensive investigation into this matter and a resolution that ensures the accurate and fair billing of interest fees.

Consumer Complaint: Back on XX/XX/2021 i traveled out of the country to assist my mother who contracted XXXX XXXX and died a months later. After I returned to the US i noticed of a late payment fee from Kohls, I immediately paid it off, and then I questioned Kohls stating that it should be a problem with my automatic payment. A representative from Kohls told me that it should be fixed in 30 days. They came back days later to say that they would not reverse the late fee. Weeks later I realized that I did not have autopay set for this account since I did not use the card for several years and I only have it set for all credit cards that I use routinary and on top the purchase was made while I was out of the country between XX/XX/2021 and XX/XX/2021. I called Kohls again and I told them that I did not make that purchase, and I went into the same routing, they promised to investigate and get back to me in 30 days. I got a letter from them stating that the charge was valid, without any kind of proof on how the validated it. I requested a copy of the investigation and I never get one. I started opening disputes with the credit bureau and they had the same outcome, a letter or electronic confirmation without any proof other than a written letter. I asked the credit bureau how I could get a copy of the actual investigation, what are the proof or documents that support that purchase, and they told me that I had the right to request that from Kohls and to have a copy of every document and investigation they made. I been unsuccessful on getting anything from them from them. I did not made that purchase and they are not acting in good faith.

Consumer Complaint: FCRA 611 ( 15 U.S.C. 1681I ) 5 Treatment of inaccurate or unverifiable information ( A ) If after reinvestigation under paragraph 1 of any information that is disputed by consumer, an item of the information is found to be inaccurate or incomplete or can not be verified, the consumer reporting agency shall ( i ) promply delete that item of information from the file of the consumer, or modify that item of information as appropriate, based on the results of the re-investigation. ( ii ) promply notify the furnisher of information that the information has been modified or deleted from the file of the consumer. When an account is charged off, it means that the creditor has declared the debt as uncollectible and has written it off as a loss. At that point, the account balance should show as " charged-off '' or " written off '' on the credit report, and the outstanding balance would typically be listed as $ XXXX charge off account should not show a charge off every month on a credit report. When a creditor determines that a debt is unlikely to be collected, they may charge off the account and report it as such to the credit bureaus. This typically occurs after a certain period of delinquency, usually around 180 days. Once the account is charged off, it will typically remain on the credit report for seven years from the original delinquency date. Again, once an account is charged off, it should not continue to be reported as a charge off on a monthly basis. It should be reported as a singular event on the credit report. If the charge off account is being reported as an ongoing charge off every month, it may be an error that should be disputed with the credit bureaus. I am disputing the Capital one credit card XXXX which was reported in XXXX XXXXXXXX bankruptcy as of XX/XX/XXXX. On the credit report that account shows as charged off every month since XX/XX/XXXX up to current day and year XXXX. Also, there is a statement balance reported of {$5700.00} and updated balance of {$6000.00}. With this account being charged off, there shouldn't be a balance reporting at all and there should only be one charge off event as of XXXX. With this account showing a balance of {$6000.00}, it's impacting the utilization of my credit report. Currently in the account totals, theres a utilization of 63 % and the total amount of open debts is {$17000.00}. My total open debt ratio has increased by {$6000.00} on the reporting as a result of this charged off / closed account. This inaccurate information has caused my credit score to drop over XXXX points. This has impacted me in loan denials that I probably would have qualified for. More importantly, it voliates the Fair Credit Reporting Act. I've tried on numerous occasions to dispute this with Capital through XXXXXXXX. In the XXXX XXXXXXXX bankruptcy, this account is listed as account ending in XXXX. The creditor hasn't accurately updated this account. If I can't get a resolution here, the next step is to report this incident to the Attorney General of my state.

It has been 30 days and you are in violation of this law because I am a victim of identity theft. Please delete theses items as soon as possible. These accounts can not be furnished on my consumer report as they are in violation!!! Under, 15 U.S code 168 lb permissible purposes of consumer reports ( a ) IN General subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances an no other ( 2 ) in accordance with the written instruction of the consumer to whom it relates. I never gave any consumer reporting agency written consent to report anything on my consumer report which violates my rights as a federal protected consumer. No consent is identity theft. As a consumer I am demanding the deletion of the accounts listed immediately.

Clear evidence showing that card holder demanded merchant to pick up and return merchandise and that merchant refused stating it had no address for cardholder to ship it back to. Despite uploading all of this evidence to the Capital One Portal on XX/XX/2023, Capital One only 3 days letter puts these wrongful charges back on my account. Consumer Complaint: The Fair Credit Reporting Act ( 15 U.S. Code 1681 ) says ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. So whenever there is a violation under the FCRA, it impairs the efficiency of the banking system. This is a violation of my privacy with my consumer report, since I control what is listed and what is not. In the event that any accounts are reported without my written consent, that is considered identity theft. This is a violation of both 15 U.S. Code 1681b ( 2 ) and 15 U.S. Code 1681c-2. This leads way to civil liability against the credit reporting agency for negligent and willful noncompliance under 15 U.S. Code 1681n, which allows for {$1000.00} per violation, for account listed without my expressed written consent.
