Consumer Complaint: Case Number : XXXX Filed a dispute with Capital One regarding the merchant XXXX XXXX sending me SPOILED perishable items which were damaged and unusable. Capital One made me jump through several hoops to provide evidence which clearly establishes I tried to resolve issue prior to filing a dispute. Capital One received several documents via USPS Certified Mail, including an email directly from the merchant, stating the merchant XXXX XXXX would provide me a full refund. This alone should be a slam-dunk case. I have an email from the merchant promising a full refund! This letter was not good enough for Capital One. They insist I provide additional documentation showing I made the spoiled items available to the merchant for return. The merchant already agreed to provide a full refund. I have a letter directly from the merchant stating they would offer a full refund, which was never granted. Capital One is not acting in good faith to honor the consumer protection laws established by the CFPB and the dispute process. I would like my account credited in the amount of {$110.00} Why would any merchant want their spoiled products returned to them? The merchant already agreed to provide full refund, and the merchant never asked for their spoiled products returned. The merchant never honored their promise. I requested Capital One to escalate my case to arbitration, and they refused. I provided all documents requested. I spent hours of my time gathering emails and documentation, only to be told Capital One wants additional proof I offered to return the spoiled items. Meanwhile, the only thing the merchant had to provide was proof of payment, shipping, and tracking number. None of this was ever disputed. All the items arrived spoiled, yet I have no remedy from the dispute process. The burden of proof is on the merchant, not the consumer, to establish their items were delivered undamaged. I would like a credit to my account int he amount of {$110.00}

Consumer Complaint: I have had an account with Kohls for over 10 years. Went online to pay my bill only to discover after two days of trying that I could not link my card for payment ( something I have never had to do in the past ). When I called they could not find my account because I was one of the accounts selected for an upgrade to a Capital One Visa. They provided me with the Capital One # so I could pay my bill. I asked repeatedly how my information could be given to another company without my permission with no good response. When I called Capital One they stated that they had sent me a new card in the mail. At first I told them I did not receive it but realized I likely did and threw it away. As I have no known account with Capital One and receive a disgusting amount of credit offers daily. I did not give Kohls permission to give my personal information to Capital One, nor did I accept a new account with XXXX. yet I am being told that is who I now have to lay my bill to. I will be trying again to pay online and at the store as my due date is tomorrow XX/XX/17, since I feel like this payment to Capital One will be some kind of underhanded way to show I accepted the new account. The Kohls account represented my longest credit history account at this time and if it has been closed and reopened under Capital One then it is now useless in that regard and I will be paying it off and closing the account. I have had a previous dispute with Capital One that resulted in a judgement on my credit and I refuse to do business with them again- another reason I would have not even opened what I thought was a credit account offer.

Consumer Complaint: For the past year, I had a fixed amount automated payment and in the month of XXXX the payment didnt meet the minimum by {$8.00}. I was never notified by Capital One and they continued to charge {$40.00} every month since XXXX. I called Capital One today, XX/XX/XXXX and was told that capital one does not have the capability to notify consumers that the automated payment doesnt meet the minimum due. Capital One has many resources and I believe they purposely dont notify consumers in order to continuously charge the late fee, completely unfair.

Further, Capital One c/o Kohl 's , failed to notify the consumer the account was in jeopardy and would be reported as 30-days past due via telephone as standard and customary procedure. This has been verified with Kohl 's Credit Customer Service. Had a phone been made, as normal and standard procedure would stipulate, the payment would not have been past-due and immediately paid in full. As evidenced in the supporting documents, as soon as I became aware of the balance outstanding the total balance was paid in full.

Consumer Complaint: On XX/XX/XXXX, when monthly payment is due, I made a payment of {$2700.00} to one of my XXXX XXXX cards. The payment was made on XXXX XXXX EST presumably after their " cut off '' time of XXXX XXXX EST that I was not aware of. The payment was scheduled to be posted on XX/XX/XXXX because of it. The bank would have posted the payment on XX/XX/XXXX anyway even if the payment was made before XXXX XXXX EST because it was a US holiday " XXXX XXXX XXXX ''. I called customer service that same night on a recorded line and the lady said she would waive the late fee. Upon checking today, the late fee of {$40.00} was never waived. So I called again tonight and spoke with two senior account managers to let them know this is misleading and violating UDAAP regulation. They refused to escalate for a manual override to waive the late fee. I need the late fee to be waived.
