Consumer Complaint: I purchased a XXXX XXXX XXXX from XXXX XXXX XXXX XXXX XXXX XXXX XXXX at XXXX XXXX XXXX XXXX XXXX XXXX XXXX CA XXXX XXXX and financed it through Capitol One Auto Finance through their loan # : XXXX. In their letter XX/XX/XXXX, I was instructed to complete and return to Capitol One the Fraud Questionnaire and Affidavit of Fictitious Account. I did not return these completed items to them. This vehicle was repossessed from me while I became XXXX, with my personal belonging in the vehicle from XXXX XXXX on XXXX XXXX XXXX, XXXX, CA. XXXX. A view of the property security footage with the motel XXXX showed that my vehicle was towed away at night by a tow truck by multiple men. My location and vehicles were discovered by Capital One the evening before because my niece, XXXX XXXX XXXX ( XXXX ) asked me about my well-being and location on XXXX. I filed for XXXX XXXX bankruptcy relief in XXXX, Nevada through my Attorney, XXXX XXXX under case # ; XXXX. I received my XXXX XXXX Bankruptcy discharge on XX/XX/XXXX. Capitol One was listed as a creditor. I held Capital One banking accounts, secured and unsecured credit cards, that were closed because of the fraud XXXX 's suspicions of towards me and my accounts. I was a student at the University XXXX California, XXXX during XXXX and my student accounts were affected. I fell into financial hardship when my place of employment suddenly closed, XXXX XXXX XXXX causing me to file a California Unemployment Insurance Claim. The claim benefits were deposited into my accounts at XXXX XXXX XXXX and XXXX XXXX, they were often placed on hold or otherwise made unavailable until my accounts were closed or afterwards. I was also experiencing health problems at this time, I was a patient of XXXX XXXX XXXX. I was diagnosed with XXXX XXXX Disorder on XX/XX/XXXX. The riverside Police Department directed me to contact the FBI because of my Identity Theft and file a IC3 report. I appeared at the FBI XXXX, California XXXX and was told by XXXX Agents that my case did not meet the FBI threshold and filed my complaint with XXXX, spoke with the XXXX XXXX XXXX Attorney 's victim 's services XXXX and filed for their services.

Consumer Complaint: On XX/XX/XXXX, I received an email from Capital One stating that the fraudulent activities I reported in XXXX from XXXX XXXX ( app off XXXX ) CLAIM # XXXX for my checking ending in XXXX was reviewed and the outcome resulted in some of those transactions being labeled as fraudulent and the rest labeled as valid transactions ( listed after this paragraph ). They stated my previous credits will be removed totaling {$830.00} on XX/XX/XXXX. As you can see below all of these unauthorized transactions were done by the same merchant and person. I not only had my XXXX XXXX account hacked, they successfully removed monies from my account over a period of 3 to 4 weeks. When my bank account was low - I had to go back and check why, this is when I discovered all of these XXXX XXXX transactions. I called Cap One immediately and they promised they would fix the issue. The issue I have with this is that I not only contacted Cap One but also the merchant. They said they couldn't do anything as far as returning my funds and labeling these as fraud - so I immediately shut down that XXXX XXXX account and contacted Cap One. Cap One is stating that they had sufficient evidence to prove that some of these transactions were fraud and some were valid. How in the heck can some be fraud and others not when they are from the same merchant/person and even as the merchant stated - the transactions occurred through the APP on the same IP every time!. These are ALL fraudulent not just a few! My response to Cap One : XXXX XXXX XXXX Attachments Sat, XX/XX/XXXX, XXXX ( 12 days ago ) to cardinvestigations Please reopen this claim. This merchant does not prove that this isn't fraudulent activity they only indicated because of the many times my money was taken by his individual that it must not be fraud. I disputed this directly with the merchant before and they said they don't handle disputes and can't issue my money back and if I believe it's fraud I need to go to my bank and dispute it. All these documents show are the transactions and the many times my money was stolen and it proves it was done by one individual sometimes in the same day sometimes weeks or days apart. It's fraud. My account has been hacked and that is why I discontinued use of it. I no longer have it because it was hacked! On XX/XX/XXXX & XX/XX/XXXX I loaded a total of {$640.00} cash onto my CAPITAL ONE 360 CHECKING debit card at XXXX so that I could pay down my CAPITAL ONE PLATINUM SECURED credit card. On XX/XX/XXXX I initiated a transaction to pay CAPITAL ONE 360 CHECKING credit card in the amount of {$290.00}. This transaction was " Rejected '' on XX/XX/XXXX by my bank CAPITAL ONE 360 CHECKING when, according to my bank statement, my balance was {$310.00}. I have spoken to both the credit card and debit/bank departments in an attempt to have this matter rectified. Although CAPITAL ONE claims to have no fees, this erroneous returned payment resulted in my CAPITAL ONE PLATINUM SECURED credit card being " overmaxed out '' way past my credit limit.
