Consumer Complaint: My business name is XXXX XXXX XXXX. The case number I was given by Capital One Bank about my case is XXXX I opened a business checking account ending XXXX with Capital One Bank in XXXX. I have used this account many times for my business. On XX/XX/XXXX, I wired {$100000.00} to another construction company that I do investment with. On Capital One bank online banking I did the wire transfer. After the wire transfer, online banking system showed that my wire transfer was successful. I have a screenshot of the notice. However, on the 2nd day, XX/XX/XXXX, when I logged in to my online banking, the system showed that ALL OF my money is not available, I needed to call XXXX. I started to call this number On XX/XX/XXXX, that day from XXXX XXXX until XXXX XXXX., Capital One Bank transferred me many many times to many different departments back and forth, but nobody could explain to me why my money was not available to withdraw. I stayed with them on the phone for 6 hours on that day. On the second day XX/XX/XXXX, my checking account was not available. I called the same number again. I was TRANSFERRED by them many times to different departments back and forth again!! Many times I was transferred to the wrong department and the wait was a very long time. I answered all the questions they asked and did whatever they asked me to do, but the result was the same, my money still showed as NOT AVAILABLE FOR ME TO WITHDRAW. I am doing business with my money I am losing money each day because they are holding my money. I did not call them on Monday XX/XX/XXXXXXXX because I thought they might work on my case. But the answer is NO, the restriction is still on my account. Today XX/XX/XXXX, Tuesday, I called the same number shown on my online banking from Capitalone Bank Again. I have been transferred 3 times. The last manager I spoke with was from their business account customer service department, he told me that theres NO restriction showing on my account, but a specific agent from the Fraud department also called the customer protection department which I or they are not able to call, that agent put the restriction on my account and it has to be that agent to take off the restriction from my account. Also, they have emailed that agent about my case many times since XX/XX/XXXX, but no one knows why theres still a restriction on my account. Sounded like The only thing they could do was just wait and hope that agent checks the email. But if that agent does not check email, my money will be held by them forever!! I am losing money because Capital One is holding my money and also wasting time. I need help to get my own money out of Capital One Bank!!! I have saved many managers ' names and ID I spoke on the phone I am happy to provide the information.

I have tried with both the credit agency and XXXX XXXX to have the inquiry removed, but neither has done so. The credit agency says only XXXX XXXX can remove it. XXXX XXXX has been unresponsive to multiple phone inquiries and to a XXXX complaint.

Consumer Complaint: I was solicited my mail with a Pre-Approved credit card offer from Capital one. The offer was for 0 percent APR for on purchases until XX/XX/XXXX. The offer included a reservation number and access code. Capital begin charging interest on my account in XX/XX/XXXX. When I inquired about the charges, they said my 0 percent interest promotion ended in XXXX of XXXX. I Explained that the XXXX date was different from the promotion I was approved for. However, the rep insisted that I was only approved for a 9 month 0 % APR and 29 % APR thereafter. This is represents deceptive marketing - bait and switch. Nothing alerted me when I received the online approval, that I had only been approved for 9 month 0 % APR.

I called all credit Bureaus and capital one to report the fraudulent transaction. I requested capital one to send me a copy of that application so I may take it to the police to press charges but they explained to me that they can not do that. Consumer Complaint: I never received any documentation regarding the reason for improper reporting from any agency. In fact according to the Fair Credit Reporting Act 15 USC 1681 section 602 states, " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, as well as respect for the consumer 's rights to privacy. '' XXXX, XXXX, and XXXX are consumer reporting agencies and I am the Consumer. I have the right to to make sure my private information isn't shared which is in fact backed by 15 USC 6801 which states, " It is the policy of Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its consumers as well as to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of the information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 section 2 states, " In general subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : In accordance with the written instructions of the consumer to whom in which it relates. '' ( Furnisher of information to credit agencies ) the financial institution as well as the consumer reporting agencies XXXX, XXXX, and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, and XXXX ( XXXXurnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states, " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless- the consumer is given an explanation of how the consumer can exercise that nondisclosure option, '' ( Furnisher of information to credit agencies ) I have never been informed of my right to exercise my nondisclosure option. In fact not only that, 15 USC 1681C ( a ) ( 5 ) states, " Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information as well as any adverse item of information other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code1681s-2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer or to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states, " Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purpose listed under section 1681b of this title. '' XXXX, XXXX, and XXXX are not maintaining reasonable procedures. Lastly 12 CFR 1016.7 states, " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services. ''

Consumer Complaint: On XX/XX/XXXX, I noticed unfamiliar accounts on Credit Report with Capital One that were going to XXXX ( somewhere I have never lived ). I called Capital One and was told they already flagged the accounts and had a specialist assigned to them who would reach out to me. They did not reach out, so I sent them XXXX certified mail with tracking number XXXX, which they received XX/XX/XXXX. I still have not heard back from them. The negative impact to my credit score has been harmful, and I'm struggling to set up my medical insurance account now since the identity verification requests keep asking what XXXX address I am associated with, and I have no clue what it is.

Consumer Complaint: My father and I had an account that was closed XX/XX/XXXX for {$700.00} over a dispute that was due to XXXX, also a fraud company that did not provide services to us. Capital One charged us $ XXXX for the services and we settled for {$700.00} because it was back and forth of calling them over 30 times in the last year from XXXX over this issue that we no longer wanted to deal with them anymore. After settling the account, they continued to hassle my father with snail mail asking for {$900.00} more continuing for the following two months after we settled every week, even though balance had already been paid. I am asking that they stop sending snail mail and emails to my father who is a XXXX and does not need the anxiety of having to deal with the terrible and poor customer service weve received since using the card over the last year. Every time I call them they say I dont have authorization because Im not the primary cardholder and even when my father calls they say that he cant do anything because its a closed account and they continue to send him mail to try to get more money! This has to be stopped! Please help us by getting Capital One to stop sending my father charges for accounts already settled. No more emails and no more snail mail! I would even ask for the {$700.00} back that they took from us to settle the account for services not rendered!
