On XX/XX/2023 there was a check cash by Capital One that clearly states ( Endorsement Of This Check Is Accepted As Paid in Full On This Account and another money order sent XXXX XXXX for account ending in XXXX therefore Capital One should have written on credit report ( Paid In Full and not Settled ). Capital One has agreed to settled the debt upon cashing both instruments of payment and a binding contract to accept ( Paid In Full and not Settled on credit report ).

Consumer Complaint: Capital One has been negligent with my security and provided false information that indicated charges had been dropped due to fraud. Two months later all charges were reestablished which caused me over {$30000.00} in damage. In XX/XX/2020, Capital One granted a request made by my separated husband at that time, to be an authorized user from my credit. He received a credit card in his name on my account. I had no awareness of this transaction as I had not used my account in over a year. He was able to make this transaction online by changing the phone number to his. He and I were going through a divorce, and I was no longer living at the residence. I did not request nor give permission for anyone to be an authorized user of my credit nor receive a credit card in his name. I gave no verbal permission with Capital One, and signed nothing. I requested to hear any audio recording of my granting permission for my ex to become an authorized user. I was informed it had been established through a computer transaction and he had changed my phone number to his. I discovered this in XX/XX/2020 during a credit check, demonstrating that my credit rating had fallen from excellent to good. Within 4 months, he had charged {$25000.00} on this account, including a {$4000.00} guitar, and daily maximum cash outs. This in no way reflected my trend in credit card use. He made a request to Capital One to increase credit and was denied. Once aware, I attempted damage control and handled the credit rating by using a debt management program to stop the XXXX % interest. As he and I were undergoing a divorce, this was another item of dispute for which I was charged with extensive hours with my lawyer and was charged with over {$6000.00} in lawyer fees. I contacted the Fraud department and made a complaint. I received Capital One statements that indicated charges were eliminated due to fraud. My XXXX case continued with this no longer being a discussion point. Later, I was later informed that the Capital One Fraud department had investigated and determined that this was not a fraudulent case, rather a marital divorce case. At that time all charges were reestablished. I had divorced and had responsibility for my credit. The Capital One Fraud department refused my request for an appeal of their decision. Capital One acted in their own interest rather than investigating the lack of my personal security which led to my cost of over {$25000.00} debt and {$6000.00} in lawyer fees, as well as over 10 hours of dispute with Capital one over my security and fraud. Consumer Complaint: I paid my Kohls charge of {$72.00} one day late on XX/XX/XXXX ( was due XX/XX/XXXX ). Kohls charged late fee of {$29.00} so next payment was {$100.00} due XX/XX/XXXX. I called to ask if they could remove the late charge since it was only 1 day late, and they said they could. So I paid my usual monthly charge of {$72.00}, assuming the late fee had been removed from my XX/XX/XXXX amount due. Received my bill for XX/XX/XXXX, which said i owed {$140.00}, for $ XXXX monthly payment, plus XXXX late fees- {$29.00} and {$40.00} for second late fee. I called to ask what happened, spoke with rep who said the late fee isn't removed from the current payment due, which is how every other credit card i know of does it, but instead they take it off your " balance. '' So they said i had still owed the {$29.00} late fee when i made the XX/XX/XXXX payment. And because i hadn't payed the " total amount due '' of {$100.00}, they added another late fee of {$40.00} so I now owed {$140.00}. I asked to speak with a manager, the rep assured me he could help, and i had to ask 3x before he put me on hold. Then i was cut off. This was a few days prior to XX/XX/XXXX. I looked up Kohls late policy online, and they do not describe how if a late fee is removed, you still have to pay it and it's taken off your total balance. I left a message asking for a copy of their late fee policy to be sent to me, never received it. I called back on XX/XX/XXXX, talked with rep who again told me I owed all these late fees, i asked to speak to a manager, but after answering a few questions he said ok and hung up. I called back again, asked immediately to speak to a manager, was dissuaded by rep who assured me he could help me. He told me the same info about owing the late fees, i explained my side, he told me if i paid the {$29.00} late fee that would bring my account " current '' and he could then help me. So i paid the {$29.00} late fee, and he told me i still owed the {$72.00} + {$40.00} late fee. I asked to speak to a manager again, he put me on hold and then said that no manager was available but he understood my frustration and if i paid the {$72.00} he could wipe out the {$40.00} late fee. So I paid {$80.00}, and he assured me that took care of all that was due and my next months payment would be just {$72.00}. But now I received my bill due XX/XX/XXXX and it's showing that I owe {$140.00}, and it shows they refunded me {$20.00} but it should have been {$29.00}. And they're charging me another {$40.00} late fee although i was not late on my payment, and I'm not sure why i owe {$140.00} as my monthly charge of {$72.00} + {$40.00} ( which i shouldn't owe anyways ) would only equal {$110.00}. To be clear, i haven't bought anything with my kohls card, i've just been trying to pay it off, making my monthly payment every month, which is {$72.00}.

No response either time I also simply can not refinance now because the interest rates now are higher than when I first purchased my home. This Capital One Auto company has called every single day sometimes more than once a day looking for someone im assuming who used to have this number. Ive tried to contact them back but its not allowing me to speak to anyone unless I have an account with them. I do not have an account with this company so there isnt anyway to let them no im not who they are looking for. Im usually working and cant answer when they call. I have blocked this number but they are still calling leaving voice messages. This company needs to remove this number from their call list they are a very annoying company!
