Bank XXXX XXXX, XXXX XXXX, XXXX XXXX XXXX, XXXX Bank Delaware XXXX department of education XXXX, XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX IS BEING REPORTED INCORRECTLY. ( Please see attached reports for account numbers ) After severe research and Accounting. I am a living woman. And need these matters resolve immediately. According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to ensure that consumer reporting agencies exercise their grave. responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX and XXXX are consumer reporting agencies, and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and XXXX are not maintaining reasonable procedures. Also XXXX XXXX XXXX states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting. services.

Consumer Complaint: On XX/XX/XXXX I received a text message from capital one automated text asking if I authorized a {$100.00} payment from XXXX. I replied back no. On XX/XX/XXXX I received a text saying it was charged. Upon further investigation on my part capital one has been paying XXXX for 5 years with a card that has been expired since XXXX, that they have on file. I have not been using XXXX as I have no reason to. I rarely use my home laptop and when I do it is for XXXX projects. I called the fraud department on XX/XX/XXXX and spoke with a rep and a manager. After discussing the situation thoroughly, I learned that XXXX only has to charge the expired card and get rejections 5 times and on the sixth time the transaction will be approved. At the conclusion of this call I was told that all of the charges would be investigated. Apparently the investigation has already been concluded and the previous years charges were not removed. I have never been able to any type of credit nor debit card passed the expiration date and I do not believe that I should be responsible for Capital Ones faulty system. I filed a complaint with capital one 's complaint department and the XXXX XXXX XXXX I was told by capital one that master card would provide XXXX with new cards credit card numbers when customers cards expired. I do not think I should be liable for the following charges : XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX. Each charge was XXXX. My interest rate is 28.15 % so each year the charges totaled XXXX. The total for XXXX years was {$1800.00}. I don't think I or any customer should be liable for charges to an expired card that master card and capital one authorize.

Consumer Complaint: Capital One Bank- Deposited a large check to the account in person at the branch. Later flagged as suspicious. Called the number on the account to verify identity and was told everything is fine. Checked cleared and wrote out checks to disperse the funds. Account again placed on hold, checks were returned. Unable to acces the account. Spent 3 hours at the branch to resolve the issue. Was told nothing they can do, will escalate to their digital team and assured me someone will call me back. No one called me after 2 days. I called the bank again and was told it is not a digital issue, it has to be escalated to the executive team and we have to wait 45 days because it is first come first serve. Apparently there is a long waiting list of complaints to be resolved. Can not get anything in writing about the case number or who is working on the case. I was told I can write to the Executive office to file a grievance and it will only take 2 weeks. Funds are held up for no valid reason, due to their internal incompetence.

XX/XX/XXXX Opened XXXX mo CD with $ XXXX 4.1 % with annual distribution of interest by XXXX XXXX XXXX bank of {$8300.00} - totaling {$16000.00} at maturation XX/XX/XXXX. On XX/XX/XXXX funds did not transfer into bank account. Called CapitalOne, spoke with XXXX, could not be helpful because of weekend and was unable to provide information about CD amounts and interest- said it should fund on XXXX! XX/XX/XXXX or XX/XX/XXXX. XX/XX/XXXX still no electronic transfer. Called CapitalOne spoke with XXXX. She quoted the accrued interest for electronic transfer @ {$6100.00}!! Inaccurate!! She stated that the discrepancy in interest amount might be due to the fact that the interest was being transferred to another institution instead of re-invested at Capital One. If true, this WAS NEVER Disclosed when XXXX was opened in XXXX. XXXX stated that the electronic transfer would occur at midnight, tonight - XX/XX/XXXX. Capital One is committing fraud- has not fulfilled commitment to make electronic transfer of accrued interest {$8300.00} on XX/XX/XXXX, as stated in XXXX with representative when XXXX was opened. AND Capital One is withholding funds, collecting interest on my CD and customer service XXXX XXXX XXXX XXXX are unable to provide pertinent information because it is unavailable to them by CapitalOne. Filed complaint with FDIC on XX/XX/XXXX - which has been forwarded to XXXX XXXX Comptroller of the Currency. On XX/XX/XXXX, XXXX at CapitalOne initiated COMPLAINT # XXXX with the Bank XXXX XXXX XXXX. On XX/XX/XXXX - Funds still not transferred as promised, yesterday. Called Capital One and spoke XXXX, who transferred complaint to XXXX. XXXX stated " escalation was in process '' taking XXXX days. Advised her of FDIC complaint # and complained that the Capitol One website displays inaccurate information about the actual XXXX accrued interest. Website says {$6100.00} but should be {$8300.00} annually XXXX interest accrued during delay of transfer from XX/XX/XXXX and another display indicated interest amount of {$8100.00} which is a shortage of {$160.00}!!!! This is inaccurate and misleading to anyone not aware of the discrepancy or willing to take the time and effort to investigate. She indicated transfer should occur tomorrow on XX/XX/XXXX. Update : On XXXX {$8100.00} transferred into bank account. The shortage is {$160.00} and likely will be shorted again at term XX/XX/XXXX. That would total {$330.00}. To date, XX/XX/XXXX, XXXX, Capital One has NOT responded to my complaint or transferred the {$160.00} for which I'm requesting interest. This is XXXX. Consumer Complaint: I received an email from Capital One on XX/XX/2023 informing me that my account was closed. No reason no previous notice nothing. I had {$250.00} in rewards points that I was saving for a rainy day. When I called their customer service team, they thanked me for 11 years of loyalty but stated that they sent a letter to my old mailing address that I never received back in XXXX stating they would close my account if no activity in 3 months. I explained I moved during COVID and that I do all of my correspondence via email why would they mail out a letter of such importance. They didnt care, they didnt offer to reinstate my account and will not give me my {$250.00} in rewards. They are thieves! I spent hard earned money to earn those rewards and every correspondence is email except for this one! What a coincidence!
