Consumer Complaint: I sent a Consumer Notice of Fact to XXXX in regards to a collection account showing on my credit report. I have tried disputing this with them to get it removed pursuant 15 USC 1681b ( a ) ( 2 ) but they have blatantly disregarded my concern stating they can not remove it per their company policy but also claim to be in compliance with the FCRA. There is no law that states XXXX is able to or required to furnish a consumer report in my name without my permission. It is a violation of my federally protected consumer rights. Pursuant 15 USC 1681b ( a ) ( 2 ) of the FCRA states, any consumer reporting agency may furnish a consumer report under the following circumstances and no other : In accordance with the written instructions of the consumer to whom it relates. I did not give XXXX or its affiliates written permission to furnish a consumer report. The debt collector, XXXX also sold my information to a third party and shared my information without my consent. This is a violation of 15 USC 1692c ( 3 ). It states, Except as provided in section 1692b of this title, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a post judgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector. Pursuant 15 USC 1692a ( 2 ), The term " communication '' means the conveying of information regarding a debt directly or indirectly to any person through any medium.

Subissue: You never received your bill or did not know a payment was due
Consumer Complaint: Hi CB/Victoria Secret Card XXXX I'm personally writing you here because i've tried every channel to resolve this plus i had paid off this account since XX/XX/2021. Why are there so many lates on my accounts during covid19? COVID19 and you still ruin your clients credit? Wasnt there a special accommodation set in place for this not to happen when I called? Listen, I was protected under Mr. Trump Cares Act and i've called you guys before to make proper accommodations because of the COVID19 pandemic. Basically, I was reviewing my credit report and noticed a late payment reported on my credit report by your company. I was told that Congress had passed the Coronavirus Aid, Relief, and Economic Security Act ( CARES Act ) to minimize the impact of the COVID-19 pandemic, In particular, The CARES Act places important requirements on companies that furnish information to consumer reporting agencies about consumers affected by the COVID-19 pandemic. Basically, during a pandemic creditors can not report payments as past due, and make proper accommodations to consumers. Also, I am not sure how this happened, I believe that I had made my payments to you when I received my statements. My only thought is that my monthly statement did not get to me, or the payment was not applied as fast as expected. I checked my bank account and notice that you deducted the money out of my checking account on the month that you marked me late on my credit report.

Consumer Complaint: I, XXXX : XXXX, am a federally protected consumer submitting this complaint against Comenity Capital Bank without any influence from any third party or agency. I advise you to see the attached documentation as it contains my full complaint and requests/demands. On XX/XX/2022 ( Exhibit A ) Comenity Capital Bank discriminated against me for exercising my right to extend credit ( credit is a right granted, not a privilege to ask for ) which is a violation of Federal Law. I gave something of value ( access to my consumer credit ), and now Comenity Capital Bank needs to give me something of value in return. Since I have received no benefit, that calls for an unauthorized use of my credit card ( SSN ) and is proof of fraudulent activity. If Comenity Capital Bank believes otherwise, then Comenity Capital Bank should provide the Federal Law that opposes what I am stating. Upon the receipt of the documentation herein and of this notice, you are hereby notified pursuant to UCC 1-202f. Your prompt attention and response is required.

Subissue: Debt is not yours
Consumer Complaint: Went to XXXX XXXX XXXX for a specific toothache. After my visit they found issues that needed to be taken care of. However their plan would cost more money then I had. I have dental insurance. They said it would not be enough to cover so they had me sign paperwork and sign a form for XXXX XXXX. That got denied. I guess they found XXXX XXXX patient services. I dont recall signing an authorization for this particular institution but notified me that I had been approved for {$5000.00}. I told the dentist that we had to exhaust all other options first. I never received a notice of approval nothing. So I never used this credit line nor did I know how. I explained to the dentist that we would have to treat every appointment separately Because I could not get into debt for XXXX during an epidemic, I was losing my job and I knew I could not afford the payment. So I would pay as I go weather its with insurance or my personal funds. Next thing I know Im getting collection calls. The entire XXXX k was sent to the dentist. How is that even legal. I never received anything regarding this credit line I didnt know what payments were going to be or when they would be due. I talked to the dentist I told them I never said to use that credit line and you guys have not even fixed my original toothache. So I never returned. Now my credit is showing late payments for months the balance is over XXXX with late fees. I was working so hard rebuilding my credit and now they have put me in a even worse spot. I dont know how they can get away with 1. Releasing funds to a dentist who did not have my authorization to use funds. 2. I did not sign paperwork this company. I had no idea of the terms or how to use the credit line. I dont know who XXXX XXXX is I dont even think I have an application with them or signed an authorization for them. They want me to make payments I cant even afford. Ruining my credit. I dont know what more to do.

Consumer Complaint: I'm a victim of identity theft. I've been attempting to recover the damage and resolve the issues on my credit report by calling, faxing, and uploading the required documentations to the bureaus as requested by their agents. Even after disputing these fraudulent accounts with these bureaus and the creditors for well over a year, the creditors have constantly ignored all requests for proofs used to validate these fraudulent accounts on my file and yet the creditors keep validating fraudulent information and accounts on my credit report without proofs. The bureaus have been notified of this and yet the creditors are freely allowed to report fraud information without any consequences for violating the federal law and my FCRA rights.

Issue: Closing your account

Consumer Complaint: Comenity Bank has closed my Victorias Secret credit card account without my consent. The due date for the attached bill statement has not arrived yet and this is my very first statement. Pursuant to 15 USC 1602, this account is an open-end credit plan. Also pursuant to 15 USC 1602, the closure of my account is unauthorized use of my credit card as I did not consent to nor request closure of the credit card account. I simply requested from a consumer reporting agency that the account not be communicated on my consumer report as this is my legal right. Upon contacting the customer care number on the back of my credit card on XX/XX/2022, I was told that my account was closed because I initiated a dispute with a consumer reporting agency. This response does not constitute a valid reason for closure of my account.

Consumer Complaint: Comenity Bank The account was paid in full in XXXX ( online ). Apparently, there were residual finance charges of a few dollars that were added after I paid the account in full and was unaware of these finance charges. When I became aware, I paid them. They have DESTROYED my perfect payment history by reporting historical 30 days late for XX/XX/2022. Technically, no payment was late and it is illegal to report late payments on residual finance charges. I have asked them to update and remove the 30 day late reference which they refuse.

Issue: Advertising and marketing, including promotional offers
Subissue: Didn't receive advertised or promotional terms
Consumer Complaint: I was in an XXXX Retail store on XX/XX/XXXX and during checkout I was told I could apply for an instore credit card and receive 20 % off my first purchase. I was not immediately approved and was told it had to go to secondary review. Roughly a month later, I received my card in the mail with promotional material advising that I would get 20 % off my first purchase. I made my first purchase on XX/XX/XXXX. During checkout, I said this is my first purchase, please make sure I get my 20 % discount. The store clerk advised they could not apply that discount for me and that I would need to call customer service for a code. I called customer service and was advised to go ahead and make the purchase and it would automatically be credited on my statement. I proceeded with the {$960.00} transaction. Then, I never received my first statement. I started receiving text messages and phone calls. I called right away and questioned my discount and now the assessment of late fees and finance charges. The phone representative said I needed to use a code in the store in order to get the 20 % off and that I should have received it by mail ... I paid my purchase balance in full and I was under the impression they removed the fees. This was not the case. Only a partial credit was provided and now there is an additional late fee and finance charge on my account. They have refused to remove the fees and have only issued a dispute on my initial purchase as of today, XX/XX/XXXX to get my 20 % off.

Consumer Complaint: I had two deferred interest plans on my Zales ( Comenity ) account. I paid extra every single month to make sure they were paid off in time. Comenity did not credit my payments correctly, so that they could tack on the accrued interest. I'm attaching a detailed description of exactly what they did. Now, the account has been sold off a few times and I'm taking a hit on my credit because of all of this.
