Pursuant to 15 USC 1666b - A creditor ( Comenity Capital Bank ) may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date.

Consumer Complaint: XXXX XXXX purchased a fraud account from Community XXXX. Date unsure. Recieved my first collection letter from XXXX early 2021. Collection call from XXXX explaining fraud. Sent a certified letter to XXXX XXXX explaining my ID theft after XXXX threatened a court case; included was a victim restitution form from the city of XXXX Colorado. I have the Receipt of the certified mail i sent to XXXX XXXX XXXX continues to call me almost every day. Im am be harrassed by their incompetence to receive and properly read a letter sent almost a year ago. Now as of this date my credit score is being impacted by their negligence.

I called the company that reported this missed payment on my credit report to tell them about the error. Then I was informed that they no longer owned my account. That is was sold to the current owners which is Comenity Capital Bank. I contacted this bank. They told me to write them a letter explaining the problem. I got a response from them telling me it was nothing they could do about it. I wrote them this letter on XX/XX/XXXX and got a response on XX/XX/XXXX.

Consumer Complaint: On XX/XX/2020 we mailed XXXX XXXX a cancellation letter for the contract signed on XX/XX/2020. We were not able to certify the letter due to COVID lock- down. We even spoke to their representative - XXXX at ( XXXX ) XXXX to notify him of the cancellation. To this day, both XXXX XXXX and its representative deny receiving the notice of cancellation. The contract was process and Comenity Bank paid XXXX XXXX {$12000.00} dollars for the timeshare. Which now results in a credit card debt with Comenity Bank. We have attempted to resolve this by emailing XXXX XXXX and Comenity Bank both say we owe. We tried to give XXXX XXXX our paid in full timeshare through XXXX XXXX in XXXX, MO ( which XXXX XXXX now owns and we paid {$10000.00} ) and XXXX XXXX said they would not accept it to paid back Comenity Bank and close our accounts with them both. We have not paid anything towards this debt with Comenity Bank because XXXX XXXX fraudulently processed the contract after being notified of the cancellation. We have enlisted the help of the XXXX Attorney General office and nothing has been done to resolve this issue. XXXX XXXX has received monies fraudulently on our behalf and refuses to correct the issue by simply canceling the contract and refund the funds back to Comenity Bank. We have not taken a vacation since this issue. This could have been a simple fix, but XXXX XXXX refuses to do the right thing. No monies have been paid on this debt with Comenity Bank. This debt continues to draw interest and have a negative effect on our credit. Please help us to resolve this issue with XXXX XXXX vacation and Comenity Bank.

Consumer Complaint: Lane Bryant is a store credit card that is financed through Comenity Bank aka Bread XXXX. I have had this card for some time now so I am saavy about reading my email, letters that come through U.S. mail and communications sent to me electronically on the store credit card website. I was checking my account balance recently and started to go back and review my bills. I receive my bills paperless and generally just go on the website to pay the bill. When I saw that my balance was not really going down like it normally does, I started digging into previous bills and noticed that at some point, I started receiving DOUBLE finance charges from this company. I called in XXXX times to try and have the issue resolved however always received the runaround. The last time I started asking questions about terms and conditions and it was noted that they did not send me a copy of the terms when they changed them. There were no terms in my electronic communications nor had I received any via XXXX. Therefore XXXX Lane Bryant broke their original contract with me, did not properly notify me of the change in terms that would impact my account, and consequently, I am asking that these DOUBLE finance charges be removed from my account. I should have ONE finance charge for EACH billing cycle. This conversation about change of terms took place about XXXX months ago. I am a XXXX XXXX, so was really busy trying to XXXX XXXX in the pandemic. Now I am on summer and want to pursue this issue of non-compliance on the part of the credit. It appears that Comenity is making these changes on all of their accounts gradually. Thank you!
