Issue: Problem with a credit reporting company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: If you look at my credit file from this creditor the balance was paid on XX/XX/2022. XXXX continued to charge interest on a {$0.00} balance. I made the final payments, account was showing as closed. when I disputed, they randomly re-reported the account as opened in XXXX and charged fees from {$0.00} up to {$270.00} dollars, reported it as 6 months past due, and the charged off this account. This has greatly and negatively affected my credit report on a huge error. XX/XX/2022 - {$750.00} balance paid in full XX/XX/2022 - {$2.00} balance, paid because I guess outstanding interest. XX/XX/2022 - {$4.00} balance, this should not exist, why after 2 months after payoff I being charged at all? XX/XX/2022 - {$11.00} balance, this should not exist, why after 3 months after payoff I being charged at all? XX/XX/2022 - {$24.00} balance, account now shows as closed no credit reporting for 6 months after this. XX/XX/2022 - {$270.00} balance, {$270.00} of which is fees is now shown and shown as 6 months past due. This is entirely predatory to charge {$270.00} on a {$2.00} balance.

Issue: Attempts to collect debt not owed
Subissue: Debt was result of identity theft
Consumer Complaint: In XXXX, someone stole my identity and opened an XXXX XXXX account in my name, at my old address, after I moved in XXXX. I contacted XXXX XXXX and they couldn't even find an order, so I don't think an order was ever placed. All the correspondence looked fake. Comenity Bank was the bank listed, and I contacted them. They sent a letter saying they were investigating my claim, back in XXXX. I continued to receive bills from Comenity for a while, then it finally stopped. I never opened this account and never purchased anything from XXXX XXXX. Comenity wanted my social security number and I refused to give it to them. I don't even know if this is Comenity or an impersonator. At XXXX point, they even called my nephew. I consider that a breach of privacy and an harassment call. I reported all this to the FTC ( which later closed my account ), to the 3 credit bureaus ( XXXX, etc. ), to the XXXX XXXX, and to the FBI. No one has done anything, so I thought the matter was closed. Yesterday XXXX, I received a letter from Comenity saying they had turned my case over to a collection agency, XXXX XXXX XXXX in XXXX, GA. I never opened this account and don't owe anyone any money. I never lived in XXXX but found this address on my credit report : XXXX XXXX XXXX XXXX XXXX XXXX, NY XXXX and told them it wasn't me.

The notice shall include all relevant information regarding the dispute that the agency has received from the consumer or reseller. This Dispute is going on Four months old without resolution and is causing me mental and financial stress. The Law states that these companies 's procedures have to be reasonable, impartial, and fair to preserve the rights of ME!!! The Consumer. On XX/XX/XXXX my notice of dispute was received by an agent of COMENITY BANK Named XXXX XXXX and signed with a return receipt request # XXXX. After 60 Days of no response or acknowledgement from COMENITY BANK I submitted my dispute through the CFPB portal Complaint # XXXX on XX/XX/XXXX which was sent to COMENITY BANK And on XX/XX/XXXX the company responded that it needs more time which violates my rights as a CONSUMER and violates Federal Law. As of today XX/XX/XXXX its been 113 days since i sent my Lawful request for validation of this account that is also violating my rights to privacy in accordance to 15 U.S.C. 1681 section 602a and 604a section 2 because i never gave written permission to furnish this account furthermore i obtained a recent copy of my consumer report and COMENITY BANK Failed to mark my account as currently in dispute with experian which is another violation of my rights. I am enclosing my updated consumer report showing where the account is not notated as currently in dispute also says my information was sold to another creditor which i just found out upon checking my report so that means my information was sold unbeknownst to me and without my permission. I am also including again the return receipt signed for by XXXX XXXX an AGENT of COMENITY BANK on XX/XX/XXXX This is of the most important and urgent matter because of the affect it is having on my life and ability to move forward. The statue of limitations on the time allowed for Comenity Bank to complete the investigation into my dispute has very well exceeded the threshold and they are in VIOLATION of the FCRA and FDCPA with the assistance of XXXX.

Consumer Complaint: On XXXX, I was contacted by an individual stating that his name was XXXX XXXX, claiming to be from XXXX XXXX with a phone number of XXXX. He stated that he worked in a law office and was reaching out before this complaint was filed in court ; he further stated that it was previously with a debt collection agency and that they had been contacting me and sent letters ( to an old address ). He said that he was trying to collect on a delinquent credit card account ( XXXX ) for {$590.00}. I told him that I never received any letter. I asked him for a copy of what was sent by the previous collection agency, along with the detailed account information including when and where it was opened and the detailed charges. He stated that he didn't have that, and I would be given everything once the civil suit is filed. I monitor my credit regularly and nothing for this account has ever been reported. Furthermore, I contacted XXXX, and they did not have an account on file ( current or past ) and I also spoke to their collections department, and they did not have anything reported on my account. I was looking things up online and it looks it is a scam. There was a live chat online for assisting in instances of potential scams and the agent told me that it sounded like scam. The phone number came back as a VOIP # when I reversed looked it up. XXXX XXXX, XXXX XXXX ( XXXX ) is a scam!

Consumer Complaint: I have a Comenity-Carters credit card. ( Comenity Capital Bank ) I owed XXXX that was due on XX/XX/22. I paid through the billpay section of my bank. They sent an echeck for {$73.00} that Comenity endorsed and cashed on XX/XX/22. When I got my next statement, it said I did not submit the payment and was charged late fees. I called and opened a dispute. I sent a letter with a cop of the canceled echeck, they said it can take 90 days to investigate. I called over 20 times and was put on hold and transferred to many different people and was disconnected many times. The agents always said if we get disconnected, they will call back, but they never did. I finally got an agent in XXXX saying my next statement should say {$0.00} owed. The next statement showed I owed {$110.00} and I got a letter saying I had to open another dispute and send more documentation. I wrote the second letter and enclosed more copies of payments that I sent that they did credit to my account in the past. I then contacted them on their facebook page after being not helped on the phone. They gave me a corporate number, and someone will take care of the situation. After explaining it to XXXX he said he couldn't help me and transferred me to someone who couldn't help me who transferred me to XXXX who said she was going to put me on with a supervisor. She said she has my number in case we get disconnected which we did immediately and there was no call back. I am very frustrated with this whole situation and our credit score is over XXXX, I do not want my credit score affected. It should not take over 4 months to take care of one transaction.

Consumer Complaint: I got a credit from XXXX XXXX company to buy a ring for my wife. I was paying that since we moved an I missed three payments. They called me from Comenity Bank debt collection department and mentioned that I have something like {$9300.00} out standing balance. I was furious about the balance and I asked if we can settle the debt if I pay the balance in 4 equal payments and they accepted. They also sent me a letter that your balance will be settled if you pay the balance in 4 equal payments of something like {$2300.00} which I paid without any delay or problem and the last payment was made on XXXX 2022. In XX/XX/2022, I received calls about an outstanding balance of {$270.00} for interest and late fee. I talked in two or three times with them that the account was settled and I paid the entire balance based on the agreed upon settlement. The supervisor mentioned that, she could see a settlement on the account and assured me that she will reach out to the respective department to resolve the issue. she also mentioned that you will not receive any bill till the dispute is resolved. However, they started sending me bills with late payment and pilled it up to {$760.00}. I called them and explained again, supervisor and costumer service confirmed that there is an open dispute. However when I asked why they are still billing me and ruining my credit, costumer service put me on a hold and then hung up. That is how they make you frustrated to get their unfair fees and balances.

Consumer Complaint: We had a credit card that was originally with XXXXXXXX XXXX and then in XXXX it was sold to Comenity. When we got a bill to pay our credit card in XXXX. We paid it using our online bill pay to XXXXXXXX XXXX ( we had until XXXX to continue to pay to XXXXXXXX XXXX and they would transfer to Comenity ). In XXXX I noticed we had late fees and interest charges so I called XXXX and they said the money would get transferred to Comenity and to give it 1 or 2 billing cycles to resolve itself. XXXX payment also got paid to XXXXXXXX XXXX and we had the same issue. We got our online billing system fixed to the new address, new company and new credit card number for the XXXX payment. So, our XXXX and XXXX payments from 2022 have still NOT BEEN APPLIED. We have been fighting with XXXX XXXX and XXXXXXXX XXXX to find someone who would help. We received NO help until I reported XXXX XXXX and XXXXXXXX XXXX to the CFPB. XXXX XXXX still would not cooperate and after much frustration they FINALLY sent out the " trace number '' so we could prove we sent the payment in XXXX and XXXX. XXXX from the XXXX 's office at XXXX has finally confirmed that XXXX XXXX did indeed receive the payment. They are saying they sent to Comenity but we are back to square one and Comenity is saying they didn't receive and need a " tracing number '' to track the funds. It has been several weeks and to this day I have not received the " tracing number '' nor has Comenity received the tracing number and Comenity will not credit our account and they continue to charge late fees, interest charges and have been affecting my credit report ( which was XXXX before this event ). It has been 7 months now since we made our first payment. This is insane and frustrating. I proved we made our payment to XXXXXXXX XXXX and they have yet to get Comenity to credit our account.
