Consumer Complaint: I opened a dispute against Comenity Bank regarding the violation of my federally protected consumer protected rights and the requirements of the FCRA, that the company failed to comply with. As per the company 's own arbitration agreement, in instances where a dispute arises, this must be handled through binding arbitration, the company did not do such a thing. As per the company 's own terms and conditions, they will not sell my information to any third parties, which they did when they sold my information to the various consumer reporting agencies, without my written consent. I did not receive the Gramm Leach Bliley Act disclosure, as necessary by Federal Law. I requested all accounting history related to this account, from account opening until account was closed, which also is a federal violation, related to committing adverse action against a consumer.

Consumer Complaint: Purchased item XXXX and charged to my XXXX XXXX XXXX XXXX. Received item on XX/XX/XXXX and the quality was poor and color off. Within the hour I returned through XXXX. I have proof of receipt and delivery back to XXXX XXXX XXXX on XX/XX/XXXX. XXXX XXXX XXXX admits they have the item back. Policy online states that refund within XXXX business days. Now they are saying they are backlogged and dont know WHEN they can process. Meanwhile bill/payment due and I shouldnt owe anything, since I had a XXXX balance before purchase. If the business admits to having their merchandise back, then how can they hold funds XXXX and require the customer to pay for NOTHINGbecause I have nothing. Comenity is playing crazy and has the oh well attitude. They are in cahoots. They are scammers and I feel like Im being robbed. Its XX/XX/XXXX and I keep getting hung up on or transferred back into cue by several reps. If I would have used my bank card then this would have been resolved because I have all my documentation. They get people to open these store cards so they can mistreat and rob people. What is my recourse??!

Consumer Complaint: On XX/XX/XXXX I received a phone notification that indicated my account was past due. I was not using the account and had paid the balance in full. After looking into the account I found on XX/XX/XXXX that I had, in fact, paid the balance in full of XXXX. When I inquired in XXXX, I was told there was an interest charge of {$2.00} that had been added to the account and then assessed late fees several times. The representative for the company informed me that these fees would be removed from my account by the next billing cycle and the late payments would be removed in 45 days from my credit report. The fees were removed from the account, however the credit report is still affected showing two back to back late of 30 and 60 days. I called the company again on XX/XX/XXXX after finding out that the status of the credit report had not changed reflecting that there were no late payments. I was told first that Express/Comenity Bank would not do anything further to help. I asked to speak to a supervisor and was then told that the documentation necessary to address the credit report was not submitted in XXXX when I first called and was being submitted now on XX/XX/XXXX and would take another 45 days. I am in the process of purchasing a home and put off continuing the process in XXXX as this error had dropped my credit limit on the card and my credit score. Now I am being further penalized by this predatory practice and being told possibly another 45 days. I have nothing in writing and no idea if anything has actually been submitted due to the company 's unethical practices and unwillingness to address the error in a timely fashion.

Consumer Complaint: Zales Jewelry is reporting my late payments to third parties agencies which in this matter are the three credit agencies which are XXXX, XXXX and XXXX. Pursuant 15 U.S. Code 1666b - Timing of payments ( a ) A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. Zales Jewelry is in clear violation of this law. Zales Jewelry is also reporting my transactions or experiences which is another violation of the Fair Credit Reporting Act 15 USC 1681 ( 2 ) ( a ) ( i ) Exclusions from a consumer report clearly states ( 2 ) EXCLUSIONS- Except as provided in paragraph ( 3 ), the term " consumer report '' does not include ( a ) subject to section 1681s-3 of this title, any- ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; which in this matter is my Utilization.
