Consumer Complaint: In XX/XX/XXXXXXXX I went to XXXX to purchase a pair of dress slacks. I chose a pair and was offered a {$25.00} discount if I were to open a charge account. ( Having had one previously with them for years - while still working- I consented ). A time later, the bill arrived, and not noticing a way to pay on line I set it aside for attention at another time. In late XXXX a second bill arrived and I paid the new amount with a late fee, and an interest equal to 46 % by mail. My check was XXXX by Comenity, a day late, and a second interest was charged, this time at 1120 %. Believing that I had fulfilled my obligation to Comenity, I didn't bother to open the XXXX and XXXX billing statements. On XX/XX/XXXX, I sent a check for the two interest payments and a {$2.00} late fee totaling {$6.00}. Again the accrued interest was {$0.00} but the charge was {$2.00}. I wrote on the check, and the tear off portion of the statement that this was my LAST, final check to that account. The bills continue. On the XXXX of XX/XX/XXXX, I spoke with an agent, and then with a supervisor, XXXX, confiming with her that I would not be making any more payments. She informed me that she would mark my account as " Refusal '' and that it would continue to accrue charges. Because of the frequent calls to my cell phone, I blocked each new number from Comenity bank. Near the end of XXXX, XXXX, I started an XXXX spread sheet recording the missed calls, and the messages left by Comenity bank. See attached.

Consumer Complaint: I specifically signed up for a AAA Comenity Visa Travel Advantage Card during a valid promotion for a {$100.00} bonus credit after spending {$1000.00} in the first 90 days, which I successfully completed a while ago. Never got my credit, called and a woman told me it would be issued on XX/XX/XXXX. I now got a letter in the mail from Comenity denying I am valid for any promotions. I want my credit.

Consumer Complaint: Big Lots Credit Card administered by Commenity Bank filed a 30 day late payment with m y XXXX bureaus. It dropped my credit score by XXXX points in one day and caused XXXX credit card called XXXX to close my account when they inquired. I lost a line of credit. I called them and told them I had all the statements and checks where I had paid them for the past XXXX years and I even sometimes paid them twice in one month. They told me they would write to the XXXX bureaus and fix the erroneous information and they believed the error happend due to a system upgrade last year. They wrote to XXXX which updated the card to zero balance and removed the 30 late payment ( fraudulent info ) but XXXX and XXXX still show this info and I have filed multiple disputes with both. I can not get them to remove it. I am so upset with this as I will never do business again with Commenity Bank.

Consumer Complaint: On my consumer report, Comenity Capital/Smile Generation is listed as a charged off account. This is illegal and should not be on there at all. I did not receive a 1099-C form from them for this debt, as I should be able to claim this on my taxes as income. Income is not to be reported on a consumer report. So why are they reporting this inaccurate information? I disputed it with them AND the three major reporting agencies ( XXXX, XXXX, XXXX ) and they ALL failed to accurately verify, investigate AND report this alleged debt. Why are they still furnishing third party entities with my private and confidential information without my consent? They are purposely providing inaccurate information to third parties and as such should be exposed for their failure to uphold consumer rights as stipulated within the Fair Credit Reporting Act and Fair Debt Collection Practices Act. This alleged debt needs to be deleted from all of my consumer reports immediately.

Issue: Closing your account
Subissue: Company closed your account
Consumer Complaint: In relation to my previous complaint, XXXX, I have encountered further issues with Comenity Bank 's handling of my Express Credit Card account. Despite multiple attempts to resolve an identity theft issue that resulted in over {$7500.00} in fraudulent transactions on my account, the bank has failed to address the root of the problem : their lack of robust security measures. After the resolution of my previous complaint, which concluded with Comenity Bank closing my account without notification, I attempted to contact them for further discussion. When I called their customer service line and entered the last four digits of my social security number, I received an automated message that my account was closed and there was no further action I could do. This action was taken without my consent and without proper notification, and will cause a negative impact on my credit score. The lack of security measures in place to protect customers, especially those who have had their social security number stolen, was not addressed in their response to my previous complaint, nor was any XXXX given that measures would be put in place to prevent similar fraud from happening to others.
