Consumer Complaint: I had been living in the XXXX XXXX for a couple of months when I flew back to XXXX XXXX XXXX in XXXX of 2022 and opened an account with Bank of America. Everything was great, no issues. Then all of a sudden I was robbed and my card was stolen in the XXXX and I requested a new one. I tried activating it several times it didnt let me I tried having my mom call the number to be able to activate it, and it didnt let her because I later found out it had to be my number to call them to be able to activate the card. During that process she also tried to go to an ATM and activate it but she couldnt. Days after, I realized fake checks were being deposited into my account. I dont know if when I lost my card in the XXXX, the ones that stole it were able to get into my account. I have no idea. I tried to contact Bank of America, they said they couldnt help me because my number didnt match what they had on file and even after giving them my private information I was not being helped. The day after my account was suspended, I no longer had a bank account. I tried contacting Bank of America again and nothing. They did nothing to help me and there was nothing I couldve done since I was in the XXXX TAKING CARE OF MY SICK GRANDMA. I write that in caps to emphasize how frustrated I am that they are doing this to me when those checks were clearly deposited in the United States during a time I can easily prove I was in the XXXX. They did not bother to ask for any of that information. With all the stress and money problems I had while taking care of my grandma, I left it alone. Then I tried to open up a XXXX bank account and it wouldnt let me. Because of what Bank of America did to my record. If this doesnt get fixed I will be filing a lawsuit against Bank of America XXXX This is just unjust and extremely unprofessional. I thought banks took care of their customers instead of exiling them. Instead of sending me alerts of fraud, emails, or ANYTHING, they decided to just close my account. I hope this will be resolved and doesnt get any further in the legal aspect. But if it has to go there, I have receipts, screenshots, time stamps, locations, everything I need to take this to court and prove how unjust this bank has treated me.

Consumer Complaint: I was scammed in XX/XX/2019 by a phone call saying they were going to charge my checking account {$390.00} for my renewal for my support for my Computer and If I didnt want this done and cancel to call a number. I did, and explained that I did not order anything. They said Sure We can take care of that, thats when unbenowing to Me thats when it started. They had Me go to a site, which now I know better after reading my XXXX XXXX XXXX XXXX, not to open any unknown sites, They claimed they made a mistake and put all this extra money in my account, I said let Me calll the Bank, the guy said Please, dont If you do I ll lose my job, Because I made a Big mistake. They knew how much was in my account, by the site they had me open, so what they did was transfer my money that was in my own account from savings to checking, and kept Me on the phone to keep Me from contacting the Bank. They said it was their money that they had returned to Me, and I had to wire the {$35000.00} back to them by money transfer. By the time I realized It was a scam, I contacted the Bank, they had Me wire it overseas, A lady at the bank tried to stop the transfer but ot was too late, She informed Me because I willingly signed for the transfer, they were not responsible. I contacted the overseas bank, and they said it wasnt on them. I am a XXXX who thought I was up on things, but feel foolish because of how and what happened to Me, I still hear messages on my Phone from different people SS, Tech Support, etc, which I know now are scams so I don t answer. Little People it seems don t matter to Big Banks, so I guess Im one of thousands who have lost money forever to scam artists. Thank You

Consumer Complaint: On XX/XX/22, my company XXXX XXXX XXXX was debited {$4000.00} by Bank of America and those funds were sent to an unknown individual. I contacted Bank of America on XX/XX/22 to report the fraud. I was told by an employee of Bank of America that my funds would be recovered since the unknown party has an account at Bank of America. 45 days later, Bank of America sent me a letter refusing to refund my funds and to pursue the unknown party. I filed a small claims lawsuit to recover the funds from Bank of America. During mediation of the dispute the Bank of America representative finally gave me the name of the unknown party. He told me to call a department at Bank of America and they would provide the unknown party 's home address so I could file a police report. When I called the number I was told no information would be provided. Today at the small claims hearing the attorney representing Bank of America lied to the judge claiming I never told Bank of America the transaction was fraudulent. That has always been the case and I informed Bank of America in a timely manner of the fraud under Reg E.

Enclosed are the faxed documents received today by Bank of America, but amazingly are not acknowledged, likely due to the bias this bank is showing XXXX. The dispute dept. phone rep referenced a " non renege '' clause entitling the company to a 45 day delay on processing my {$72.00} debit card refund or at least a credit by this bank when my documents prove I returned the defective car part in damaged box that never should have been sold, which is why XXXX won't take back previous customer return. Consumer Complaint: On or about XX/XX/2022, I fell victim to a multi-layered scam operation run by XXXX which involved me making deposits for a total amount of XXXX USD from my Bank of America ( BOA ) account to a fraudulent investment firm ( s ). When I informed Bank of America of the fraud I was told that BOA had no responsibility for the process or for protecting my funds. I believe there is an issue of liability. I ask these questions : 1. Whether BOA did not take notice of any rule, law, or regulation, and/or possibly missed any material elements of the relevant bylaws or codes of conduct, that may have prevented them from protecting my financial safety? 2. Whether by virtue of BOAs custodianship over my funds or by its control over them, they owed a fiduciary duty to the me and if so, whether that duty was breached? 3. Whether BOA promoted the transaction ( s ) in question despite being aware of the nature of the transaction ( s ) in question? 4. Whether BOA was in compliance with its own policies and procedures? 5. Whether BOA owed duties to me, what the scope of those duties was, and whether BOA did not uphold those duties? 6. Whether BOAs conduct was unfair? Whether BOA has within its power the ability to, and should, compensate me for the harm that has befallen me. Upon identification of such unusual or suspicious activity, it is crucial that the relevant staff member adequately describe the factors making an activity or transaction suspicious, thoroughly depict the extent and nature of this activity and properly communicate to the customer that such activity meets the relevant criteria of fraud. In providing its services to a customer, a financial institution is required by law to exercise the care and skill of a diligent, prudent banker. In this case, this means that the payment service provider should not turn a blind eye to known facts pointing to a real possibility that their customer is being scammed. All of the evidence suggests that BOA did not foresee the fraud and disregarded even the most obvious dangers in this respect.

Consumer Complaint: Bank Of America is reporting derogatory information onto my consumer report that needs to be removed. I didn't give consent to Bank Of America to share my information with a non affiliate third party. The Gramm Leach Bliley Act 15 USC 6801 Says that a financial institution is not suppose to share nonpublic personal information to a third party. Bank Of America Bank are furnishing " Charge Off '' accounts onto my consumer report. The IRS definition of charge off is income. Income is not supposed to be furnished onto a Credit report. Bank Of America did not clearly and conspicuously give me the option to opt out of credit reporting as it states in the Gramm Leach Bliley Act. I am asking Bank Of America to Cease and Desist all communication through any and all mediums unless it is for a specific remedy that i am invoking. The telecommunication through any and all mediums would be telephone, email, social media and any consumer report. This Notice is pursuant to 15 USC 1692c. The Term communication pursuant 15 USC 1692a ( 2 ) means the conveying of information regarding a debt directly or indirectly to any person through any medium. This alleged debt directly onto my consumer report which is a form of communication and i need this charge off account removed. This is als a direct violation of 15 USC 1992d ( 1 ) as my consumer report is my reputation and because this derogatory is being reported and causing harm to my reputation i am entitled to compensation as per USC 1692 ( k ) of monetary relief of ( {$1000.00} ).

Consumer Complaint: On XX/XX/2023, I found myself in a difficult situation with the Bank of America branch in XXXX XXXX, MN, XXXX ( XXXX XXXX XXXX XXXX, XXXX XXXX, MN XXXX ). I had given my new landlord a rent check for {$1500.00}, dated XX/XX/XXXX, but was still waiting for an expected wire transfer from my XXXX bank account to cover the funds. As Business Day # 7 came and went without the transfer arriving, I knew that my rent check was going to hit my Bank of America ( BofA ) account on this morning and would become massively overdrawn. To avoid this from happening, I took the morning off work to drive XXXX miles from XXXX, MN to the nearest BofA branch in XXXX XXXX, MN. I also requested a telephone meeting with a representative from the bank on the afternoon of the XXXX, explaining that I would be in the morning with the funds to cover the account and to please not bounce the check immediately upon receiving it. Despite my best efforts, however, the check had been processed by the time I arrived at the branch, leaving my account overdrawn by about {$1500.00}. I was disheartened to learn that my check had been returned due to insufficient funds, despite having already deposited enough cash to cover the balance. BofA had possession of the funds to cover my rent check and knew who to remit them to, yet they made no attempt to inform me or return the funds. As a result, I was forced to take more money out of my line of credit to cover the new balance owing of {$1700.00}. This act of negligence on behalf of BofA has caused me not only material financial harm but also emotional discomfort and stress. I received notice from my landlord that my check had bounced, and I was embarrassed that this happened with my first rent check. I now have to pay rent each month with a cashier 's check, which is an inconvenience and a hassle. Additionally, this may have negatively affected my credit. It is unclear why the funds were not deposited, as at this moment, the account has not been formally closed by BofA. I did not intend to deceive the bank or my landlord, and I had no reason to believe that the check would not clear. If the bank had any concerns about the payment, they should have notified me before processing the check. This would have given me an opportunity to address any issues and prevent the check from bouncing. This whole situation has caused me loss of time and resources, including driving from XXXX to XXXX XXXX to deal with this issue. I have also incurred a late fee of 8 % plus {$35.00} returned check fee, solely because the check did not clear, even though the funds were available. I urge BofA to take responsibility for their actions and return the funds they are holding. They should also take steps to prevent this from happening to others in the future. I hope that by sharing my story, others can learn from my experience and avoid similar situations. Currently my BofA shows a positive balance of {$1700.00} locked funds. I find this troubling because this account is supposed to be closed. If requested I can provide the cashier 's check receipt for {$1700.00} for my rent + fees, my original lease agreement showing the monthly rent agreement of {$1500.00} per month, as well as the photocopy from my landlord of the returned check due to insufficient funds notice sent to them dated XX/XX/2023.
