Consumer Complaint: A cheque from the US Treasury was endorsed via forgery of someone whom has been impersonating me for some time. The cheque was taken from my mailbox as people have been sorting and forwarding my mail. The parties involved have been attempting to take power of attorney from me, so that they can validate the endorsement of the cheque and the spending of the funds. The checking account and savings account is in XXXX XXXX & XXXX XXXX name. The money came from an originated cheque that was paid to my order XXXX XXXX. The parties involved never gave me access to the money and are using my name and identification fraudulently.

Consumer Complaint: I sent a communication to BANK OF AMERICA, regarding my option to opt out of having my nonpublic personal information shared/reported to any credit bureaus including XXXX, XXXX and XXXX. In regards 15 USC Code 6802, it states that : a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party ( BANK OF AMERICA AND THE BUREAUS MENTIONED ABOVE ARE NOT AFFILIATED ) any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 6803 of this title. ( b ) Opt out ( 1 ) In general A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( They NEVER gave me this information/option ) ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option. ( Again, they never gave me that option when the transaction was initially done ). *Also see ; 12 CFR Part 1016 Subpart A* They DID NOT give me full disclosure when the transaction initially took place, which is misleading and fraudulent. NONPUBLIC PERSONAL INFORMATION MEANS : personally identifiable financial information ( i ) provided by a consumer to a financial institution ; ( ii ) resulting from any transaction with the consumer or any service performed for the consumer ; or ( iii ) otherwise obtained by the financial institution. NON AFFILIATED THIRD PARTY MEANS : any entity that is not an affiliate of, or related by common ownership or affiliated by corporate control with, the financial institution, but does not include a joint employee of such institution. I am demanding that this information that I choose to no longer have shared with the bureaus, be removed from all of my credit reports immediately. In addition, compensation for their violations of the law and making my life difficult.

Consumer Complaint: Bank of America started charging a monthly or maintenance fee last year which stated they would not charge an overdraft fee, or I would not have to be concerned about an overdraft fee. I was never charged a fee because I have direct deposit. Bank of America is stating that the way my job deposits my check through ACH, I ' am being charged now. When my debit card was declined because the purchase was {$8.00} dollars over. I called in only to find out that the maintenance fee doesn't cover the overdraft fee. So, what is the maintenance fee covering?

Consumer Complaint: I'm just gon na start this off by saying these people are so annoying. I wrote a letter to bank of America to inform them that I am opting out and revoking all previous permission that I may have given them in terms of sharing my nonpublic personal information to any non-affiliate. Bank of America knows that they are not affiliated with XXXX XXXX XXXX and XXXX and that it does not fall under any exemption that is either in 12 CFR 1016 or 15 USC 6802 of course they always have some stupid excuse as to why they can't do something or you can't speak to a representative who has a little bit more power to get anything done so I'm making this notice available to the CFPB to demand remedy. Bank of America received an opt out notice from me about a month ago dated XX/XX/2023. The opt out notice stated that I was revoking any verbal or nonverbal permission that I gave them to share my nonpublic personal information with any non-affiliate indefinitely. Bank of America has still not made communication with me sharing my nonpublic personal information with non-affiliates such as XXXX, XXXX XXXX and XXXX who by the way do not fall under the exemptions for who Bank of America can share non-public personal information with. This is irritating because Bank of America along with these other creditors never follow the rules but the consumers are always supposed to follow the rules. in addition they did not give any notice on how to opt out of sharing my nonpublic personal information with non- affiliates which is also against the law. I am demanding that Bank of America rectify the situation by removing my non-public personal information and stop sharing my non-public personal information who is non-affiliates who do not have an exemption under 12 CFR 1016 and 15 USC 6802 such as XXXX, XXXX XXXX and XXXX. If anyone is confused about what non-public personal information is here is the formal definition of the term as provided by both 12 CFR 1016 and 15 USC 6802. 12 CFR 1016 : Nonpublic personal information means : ( i ) Personally identifiable financial information; and ( ii ) Any list, description, or other grouping of consumers ( and publicly available information pertaining to them ) that is derived using any personally identifiable financial information that is not publicly available. 15 USC 6802 : Nonpublic personal information ( A ) The term nonpublic personal information means personally identifiable financial information ( i ) provided by a consumer to a financial institution ; ( ii ) resulting from any transaction with the consumer or any service performed for the consumer; or ( iii ) otherwise obtained by the financial institution. ( B ) Such term does not include publicly available information, as such term is defined by the regulations prescribed under section 6804 of this title. ( C ) Notwithstanding subparagraph ( B ), such term ( i ) shall include any list, description, or other grouping of consumers ( and publicly available information pertaining to them ) that is derived using any nonpublic personal information other than publicly available information; but ( ii ) shall not include any list, description, or other grouping of consumers ( and publicly available information pertaining to them ) that is derived without using any nonpublic personal information. This makes the whole transaction nonpublic personal information as the transaction itself is private.

The presence of this inaccurate information is concerning and I request that it be investigated and corrected as required by the Fair Credit Reporting Act ( FCRA ). Upon reviewing my credit report, I discovered an account listed as " undesignated '' under ownership status. This designation is ambiguous and does not accurately reflect the true status of the account. Moreover, I affirm that this account does not belong to me. The FCRA mandates that credit reporting agencies maintain accurate and complete information in consumer reports ( 15 U.S.C. 1681e ). Despite my previous attempts to have this matter corrected, the error persists. This continued reporting of incorrect information may constitute a violation of 15 U.S.C. 1681i, which requires agencies to correct or delete inaccurate or unverifiable information from their files. I am formally requesting that [ Credit Reporting Agency Name ] conduct a comprehensive investigation into this matter and remove or correct the erroneous entry to reflect only accurate information on my credit report. On Monday, XX/XX/XXXX I posted that I was searching for a pair of sandals and a user " XXXX XXXX '' messaged me and said they had the item in hand and agreed to send them to me after a XXXX " friend/family '' payment was made in the amount of {$920.00}. I checked their references and all seemed to be legitimate. Payment and address was sent and they said they would ship it the next day ( XXXX ). On XXXX, they messaged asking if they could send the next day and I agreed. On XX/XX/XXXX, they asked for my shipping details again which I sent and they then sent me tracking information. I was a bit skeptical as they were using a delivery company I'd never heard of " XXXX XXXX XXXX ''. There is a website and it provided shipping info but said the delivery was " pending ''. This morning, XX/XX/XXXX, they messaged me at XXXX PST asking if I received my item and told me to email the company if I hadn't. That raised reflags and that's when I discovered that this person was posing as a legitimate/trusted buyer/seller XXXX XXXX. They created an account with the same profile picture and information, but the username IP was different. I now realize that I should have used my better judgement and now trying to see if there's any way to get my money back. In the meantime, I don't want this to happen to anyone else. I cant run my company at 100 % without funding. 12 usc 1431 are required by law to fund small business with XXXX with out documentation. I had to show funds and run personal credit. I feel like my equal credit opportunity and consumer credit protection was violated by doing so. I just want funding for my small business. SO I PUT IN FRAUD CLAIM WITH BANK OF AMERICA PREPAID EDD CLAIMS DEPARTMENT. Claim # XXXX I SENT Fraud department copy of POLICE REPORT, federal trade commission report, copy of XXXX I was taking from my doctor on weekends, copy of my ID, COPY OF MY XXXX XXXX REPORT showing fraud accounts open in my name also Edd debit card was listed, copy of Edd identity paper work, also copy of email from assembly office of XXXX XXXX which XXXX XXXX XXXX the assymbler is still on the case trying to help me with appeal I emailed him to Edd office for appeal, bank of America told him someone would be calling me thru email he sent me nobody has from investigation department till this day. I put 6 claims in so far with numerous complaints filed from Coustmer service and supervisors who are not allowed to call or talk to investigation department just send emails. I tried calling corporate Bank Of America, and visted branch and manager stated we arent allowed to call that department we just identify Edd Coustmers identity here. Nobody you can call or complain about investigations nor fraud department for Bank of America Edd fraud claims department. There is no hope there I tried left messages Edd stated thats its on Bank of America end not theres. I called Edd fraud line numerous times left messages no help there. I didnt certify, didnt accept funds, my claim hadnt been updated to actual amount has of today I asked even numerous emails been sent to investigators in that department from Coustmer service and supervisors, no new note updates from investigation department, my claim is just sitting there being denied for different reasons. I tried calling and to report my issue since this happened in XX/XX/XXXX when I found out. No provisional credit was giving. No nothing. Coustmer service said were all being basically denied she wasnt supposed to tell me that another Coustmer service said will be written up. My 6 claim is pending since XX/XX/XXXX takes up to another 45 days. Im asking for someone to look into my case. I was told I have well over enough documentation my claim should been granted long time ago. Bank of America branch manager stated the claim should been updated to actual amount, and highlighted the fraud credit cards on transactions from XXXX XXXX report, if I was regular Bank Of America Coustmer not Edd he could helped me resolve my issue. I have all proff on my claim nobody can help me.
