Issue: Getting a credit card
Subissue: Card opened as result of identity theft or fraud
Consumer Complaint: I received a email from Bank of America about I wasnt approved for a credit card that I never applied for. I then checked my credit report and saw on XX/XX/2023 someone fraudulently took out a card in my name using my SS. I would like to have this looked into because this will affect my credit and I just got off bankruptcy. I want to press charges. Please and thank you. Im afraid that this will happen again since my SS is compromised.

Issue: Incorrect information on your report
Subissue: Account status incorrect
Consumer Complaint: Hello : The issue I am having with Bank of America is not actually a credit reporting but actually, being reported to XXXX XXXX. I have been a BOFA client for XXXX years and on XX/XX/2022, there was check fraud on my account. I immediately called BOFA to report and they froze my checking account. I informed them that I had my bil lpays scheduled to come out that evening and the day next and they reassured me that all bil pays would be paid from the " fraud '' account. I went to a banking center to open a new account. Starting the next day, my online banking showed my scheduled bill pays being returned for insufficient funds! I then called and was told that they did not honor these and I had to rebuild all my bill pays from the new account which took me hours. Needless to say I was receiving fees and returned payment notices and had to pay 4 bills double. Since then - now 5mths later, have had to call their fraud dept and online banking to request proof that my payments were paid thru the fraud account or not. I have called every 2 weeks for 5mths and never receive anything. I was REASSURED by BOFA that the frozen fraud account, which was overdrawn '' would NOT BE REPORTED to any agency until I would clear this up. Well, I had to pay the overdraft but they reported me to XXXX XXXX anyway and after dealing with the branch, the departments and escalated to their Market Manager they are REFUSING to remove me from XXXX XXXX even though the account has been paid back by my own funds. I would like to have BOFA remove me from XXXX XXXX. Thank you.

Subissue: Credit card company isn't resolving a dispute about a purchase on your statement
Consumer Complaint: I received a 1099-C, Discharge of Debt, on XXXX XXXX, from Bank of America stating they discharged {$13000.00}. Date of identifiable event was XX/XX/XXXX. I called the number provided, XXXX, and spoke to their agent. She said the associated debt was from a credit card that I opened on XX/XX/XXXX. I have not received a single notice or bill from BoA during the last 12 years. I told the rep that the Statue of Limitations in Mass. was 7 years, and we were well past the dead-line. she said you have to contact your Attorney or Tax Accountant. I told her your the ones that made the mistake, and that they should issue a corrected 1099-C, She again stated there was nothing she could do, so I requested that she send me a copy of all the account charges and the source, and gave her my new address. After about a month I called back because I had not received the requested information. I spoke to another agent, who informed me they don't have any records of my debt. I then asked the agent if I could speak to their floor Manager, XXXX, who again reiterated that they have no records to send me. I really believe that this debt can not be legally collected, then it can not be cosidered forgiveness of debt. I have been retired for 7 years, and this much implied income will cause a real strain on my finances. Thank you. XXXX XXXX

Issue: Managing the loan or lease
Subissue: Problem with fees charged
Consumer Complaint: B of A account number XXXX B of A has violated the FCRA in the way they have handled my loan. They have ruined my credit and my car. They hVw recklessly harmed me and I expect them to remediate the situation. I want an accounting for what was owed which I have already paid current. I want the repo fees and late fees reversed and any damage to my car to be corrected. Further I want my credit restored. And I want my car back timely. Car was purchased in XX/XX/2022 used from dealer. They negotiated financing and were supposed to set up automatic payments. That did not happen I called B of A made payment 1. They said they would set up automatic payments. I assumed this would happen and then I did not hear from the bank in XXXX I made an online payment using the B of A online website. It asked how much and I indicated a {$2000.00} payment this is a rounded up figure the actual payment is lower. I woke us this morning and the car was gone. I thought it was stolen and called the police they let me know that it had been repossessed. I was in shock as I had no ideas I was behind. I logged into the B of A account and it said they wanted 6 payments and a late fee of close to {$500.00} plus repo fees which they dont know how much it would be yet. I would have to wait at least 24 hours before I would know what the payment would be and then they would let me know if I can get the car. I asked the lady from B of A why they are asking for six payments ( I understood the late fee ) she said I was behind four payments. This was the first time anyone from B of A or anyone representing B of A notifies me that I was behind. So then I said why are you asking for {$12000.00} she said because you are behind five payments. I said wait a minute one minute ago you said I was behind four payments. She said and you missed one last Sunday. I was shocked and stunned I have never had such a problem. I was so taken back I went went back immediately online and paid the six payments. And let charge they asked for but she was not willing to give me any other information or information about my car. I have surveillance cameras in my driveway and it shows that about XXXX this morning they attached my car to a XXXX truck and dragged it. This is a XXXXour wheel drive car and I have pictures of where the wheels of the car were dragged down the street and I am worried that the car has been damaged as a result. Thai car is not supposed to be dragged on that manner. B of A never once contacted me about being delinquent, no calls, no emails, no letters. When I went online in XXXX there was no notice on my account that I was behind on payments. My credit report will show XXXX years of clean credit history. I tried calling and they treat me like a I am thief and refuse to talk to me. They said I have to wait 24 to 48 hours. I am leaving for out of town and I dont know how this will be resolved.

Issue: Opening an account
Subissue: Account opened as a result of fraud
Consumer Complaint: On XX/XX/XXXX, I noticed a new account linked to my Bank of America account. I only have a Bank of America Platinum Plus Mastercard that I have access to online. Another account was added under my login that was listed as, " XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ''. Details show the account may have been opened on XX/XX/XXXX with several transfers of credits and debits that include a description listed on XX/XX/XXXX noted as " Transfer from my name to an unknown name listed as XXXX XXXX. After immediately contacting Bank of America Fraud Dept when I noticed this on XX/XX/XXXX, they initiated their process of identity theft/fraud. I did not open this banking account and do not know who XXXX XXXX is as this name is noted with the transfers. I also completed a police report with my local police department. After receiving further documents from Bank of America, I don't know how this account was opened with my name but there were two separate checks used to make the deposits. Each are {$99.00} and dated XX/XX/XXXX with my full name, address, email address, and former telephone number listed and show XXXX XXXX as the check account which appear in the line items of Bank of America on XX/XX/XXXX. I do not have a checking account with XXXX. The signatures on each check are obviously computer script and not my own. Memo line on one reads Electric Bill and the other check reads For Purchase. Transfers, returns, and fees from XX/XX/XXXX through XX/XX/XXXX appear as line items in the Bank of America detail. This account has since been removed and closed. However, Bank of America is requesting very personal information from me to mail back to them that includes my driver 's license, copy of social security card, copy of social security statement, copy of police report, proof or residency, any original documents received. Their letter says to mail or fax all of this within 30 days or my claim will be denied. This seems extremely shady that Bank of America authorized a fraudulent checking account in my name and now in order to pursue my claim they need all my confidential and sensitive documents that a person could potentially apply for any credit for anything. This seems highly inappropriate for Bank of America.
