Issue: Opening an account
Subissue: Account opened as a result of fraud
Consumer Complaint: Dear Sir or Madam, My name is XXXX XXXX. On XX/XX/XXXX, I received an email from Bank of America to confirm an email for an account I did not open. The email stated that " If you dont recognize this activity, call us at XXXX. ". I called that number and after a 30 min delay I finally reached a representative who passed me to another representative, who then suggested I call another number ( XXXX ). I have been on hold for 20 more mins and finally spoke to a second customer representative without a successful resolution. I have spent a total of more than 1 hour on the phone. Based on the conversations with the bank it appears someone tried to fraudulently open a bank account on my name. The application process for a bank account is still open ( contingent on providing additional details ). I have notified the bank that I did not try to open a bank account and that it is likely fraudulent activity - but the bank is unable to close that application ( their systems do not allow it ) or to flag that application as fraudulent because it is still in process. I would like Bank of America to immediately cancel any outstanding request to open anything on my behalf. I would also like Bank of America to assure me that any future request for any banking activity with the bank will involve a high bar for confirmation to ensure that this does not happen again. Thanks and warm regards, XXXX

Consumer Complaint: I am a bank of America Alaska miles card holder and I have been for years. I have never once received an advertised companion fare. I have called them multiple times about it and they said that my companion fare is released when the annual fee is charged. I was charged my annual fee on XXXX and there is no companion fare available to me.

Consumer Complaint: My original home loan was with Bank Of America. When the crash of XXXX happened I could no long afford my house payment and went into default. I had a first and second loan on the property. In XXXX when I was working again I did a loan modification with Bank Of America. I assumed it included the second. I've been paying on the property ever since as it is my primary residence. In XXXX XXXX XXXX XXXX contacted me threatening foreclosure because of the unpaid second load they obviously purchased from B of A. They could never furnish me a signed contract proving the balance I owe. And It is nearly double the initial amount. I dont have the money to fight this so I made an agreement to pay. I gave them {$2400.00} cash and agreed to payments of {$350.00} a month. In XXXX when XXXX hit I once again lost my job and income. I was able to make the house payments yet got a little behind on the XXXX payments. Over the years I have tried to make the payments every month. I normally pay {$500.00}. Today I tried to log into the system to make a payment. I was locked out and told to call. I did. I was informed that all of my payments have been going towards the late fees and not the principal. And my property is being placed in foreclosure status again. I was told to submit a loss mitigation form and they will try to help. Which I did. Currently I can not access my account to see payments or balances. This place is operating illegally in my opinion. They cant even provide me with a signed statement proving I own them money. Nor can they explain why the balance is so high. I can not afford an attorney as I am barely surviving now. I need help.

Consumer Complaint: XXXX XXXX Bank of America took over {$1100.00} out of my account with no notice in any way by allowing someone named XXXX XXXX to make fraudulent XXXX claims that he didn't make transfers to my account in XXXX XXXX. This almost caused me to get evicted. Bank of America also made it extremely difficult ( over 10 hours on phone in 1 week ) telling me non stop that I will not get my money back, finally someone allowed me to send in text message proof. This person ( XXXX XXXX ) made claims of over $ XXXX between myself and 2 other people due to him losing his job and essentially making tons of false claims to try to get as much money as possible. I luckily had text message proof that I provided to get my funds back. Once I received my funds, weeks later in XX/XX/XXXX my account was frozen for 5 days around XX/XX/XXXX leaving me stranded with NO MONEY also causing tons of NSF/Returns from outside merchants. One in particular was my XXXXXXXX XXXX XXXX XXXX. It was closed due to returned payments bc of Bank of America 's negligence. I have requested time and time again proof that XXXX requested from Bank of America and they still ignore my requests and refuse to assist.

Consumer Complaint: On XX/XX/2023 a hacker accessed my XXXX XXXX account ( which had a credit card attached to it ) and within hours ( while I was asleep ) they created a fake XXXX business page and fake ads. Totaling {$4500.00}. I appealed to Bank of America. They saw some 'pending ' transactions that were clearly XXXX and fraudulent ( I do not repeatedly run {$900.00} ads on XXXX XXXX my average monthly is between $ XXXX {$400.00} in total ). I appealed and Bank of America ( BOA ) is denying that the charges are fraud. And to add insult to injury, their letter from BOA said I provided access to my account. I DID NOT provide anyone access! Any forensic accountant can see that they charges were bogus and were out of pattern with my spending.

Issue: Opening an account
Subissue: Account opened as a result of fraud
Consumer Complaint: Today, XXXX at XXXX XXXX i received 4 emails stating a new checking account was opened in my name at bank of america. I did not open these accounts and immediatley contacted bank of america, after looking up their fraud phone number ( not the number listed in the email ). I made my report of fraud and was told the account was closed. At XXXX XXXX i received another email from bank of america about changes to my account. I called again and was told the account was still open. The 2nd representative claimed they closed the account again. I reported the fraud and put account security freezes at each credit reporting agency. Bank of america could not provide any additional details about the account. The account should have never been open and the account should have been closed when i first contacted them.

Issue: Struggling to pay mortgage
Subissue:
Consumer Complaint: We were part of and/or involved with the Bank of America scandal in 2008. I am a XXXX XXXX veteran and a single parent. Due to my sons and my own health issues I was forced to take unpaid time off from work. Along with time off, I worked for the XXXX XXXX XXXX and we were working under imposed work rules due to failure of contract negotiations which caused sequestration. I attempted to deal with Bank of America on my own and numerous times, over the course of 18-24 months, the agents I actually got to speak to told me NOT to make any payments toward my mortgage. I was told the payments would not be applied toward my mortgage and would be sent back. I attempted to make a payment or 2 anyway but as the agent told me my payments were returned to me. At the time I had paid a significant amount of the mortgage down but got behind due to the above reasons. Eventually I was forced to hire an attorney which cost me over {$10000.00} to have this matter taken care of. We ended up in court and a judge ordered a modification which I ultimately accepted. The problem was that because of the amount of time all of this took I ended up with over {$110000.00} in fees, interest etc. tacked onto the end of my mortgage. Additionally the terms were changed from a 30 yr mortgage to a 40 yr mortgage. My outstanding balance skyrocketed from {$270000.00} to over {$400000.00}, which is more than what I even bought the house for. Since this incident Ive been buried and struggling to make ends meet as I am the ONLY working person in my 4 person household. To this day my house is in foreclosure ( no sale date has been scheduled ) and things have only gotten worse.
