By Definition The IRS Clearly says a Cancelled or Charge off is Income. Consumer Complaint: Hi, I am writing to bring to your attention a dispute I am currently facing with Bank of America regarding fraudulent charges on my account. I believe your intervention may be necessary to help resolve this matter. On XX/XX/XXXX, my Bank of America card was allegedly used to make a purchase at XXXX XXXX in XXXX, WA, amounting to {$360.00}. However, I can confirm that I was out of town on business in Iowa during this time, and my card was in my possession the entire period, securely stored in my wallet. Immediately after the suspicious charge, Bank of America flagged the transaction, along with several others, as potentially fraudulent. I received timely notifications via text messaging, and I promptly confirmed these charges as fraudulent. Subsequently, on XX/XX/XXXX, I contacted Bank of America 's fraud department and initiated a discussion regarding the unauthorized transactions. The bank assigned claim number XXXX to this case. To my dismay, the very next day, on XX/XX/XXXX, Bank of America surprisingly and without clear explanation, denied my claim, absolving themselves of any responsibility and leaving me liable for the fraudulent charges. Consumer Complaint: Dear Sir/Madam, I am writing to bring to your attention a fraudulent transaction that was made from my account on XXXX. I was shocked to discover that {$1000.00} was withdrawn from my account without my authorization or knowledge. Upon discovering this unauthorized activity, I immediately contacted Bank of America to report the fraudlent transaction .After that, XXXX I discovered {$440.00} another fraud transaction on my wife account .Most part of this money were pending when we called the Bank. We called immediately Bank of America customer service again and report the fraud transaction. Firstly, They open claim and paidback my money, however, XX/XX/XXXX, I got some letters from Bank Of America, I have attached a copy of them. I discovered from Bank research XXXX an account had been created on XXXX XXXX in my name without my knowledge or consent. Subsequently, XXXX tickets for a XXXX XXXX concert on XXXX were purchased using my Bank Of America credit card XXXX amounting to a total of {$1000.00} XXXX contacted to Bank of America again and explained my situation and also I field a police report to document the incident .To my dismay, despite these efforts, the issue persisted. I also reached out XXXX XXXX Customer service to address the situation .However, during our communication, they claimed to have sent verification emails and asserted that the tickets had been delivered to my mailbox .I explained them I have not received any such emails, and the tickets were never delivered to my address .After that XXXX XXXX offered me 2 alternative tickets for a different event for selling and getting money .I found this solution inadequate and I did not accept their offer because I never bought any tickets from their website. Then, I went different time to Bank of America for solving this problem. However I did not get any helpful step and Bank offered me I should to pay back {$130.00} for my credit score. And at the same time Bank Of America sent new message to my wife email address about my wife claim XXXX. They did not send any information about my wife fraud transaction but they demand {$440.00} pay back. In addition, I have filed a police report and attached a copy for your reference. Please investigate this matter urgently and keep me informed of the progress of your investigation. I would appreciate a prompt resolution to this issue. Thank you for your attention to this matter.

Consumer Complaint: On XX/XX/XXXX, my account was placed on hold. Reason given was an " invalid check ''. When I enquired, no one could give me any further details as to what an " invalid check '' meant. Funds in the account at the time were from two cleared checks ( ck # XXXX {$7300.00}, ck # XXXX {$260000.00} ) and other cash balance. I was advised that in order to obtain those funds, the issuer of the check had to request a recall of the check. Funds were cleared and sitting in the account. I then went to the issuer of the check and advised them of the procedure as advised by the bank. The issuer of the check then contacted the bank and was told the account was on hold for fraud. The issuer of the check then contacted the police department and an investigation ensued. There were a total of four checks given to my company for the purchase of merchandise on their behalf. When questioned, I gave the issuer a full acount of all funds including the two checks totalling {$9900.00}. Proceeds of the first two checks were wire transferred to a third party who was a legitimate part of the purchase transaction. The following two checks ( XXXX & XXXX ) were placed on hold by the bank. The reason given was " fraud ''. I advised the issuer of the last two checks to proceed with the recall so that the issue could be resolved. The issuer of the check then proceeded to do a recall of one check # XXXX for {$7300.00}. The issuer of the other check for {$2600.00} ( same issuer ) decided not to pursue a recall on check # XXXX for {$2600.00} but chose to make a claim through their insurance for a loss of funds. The insurance claim was paid by my company. The insurance company then contacted me and demanded I make the payment of {$2600.00} to them as I was named the person responsible for the loss. I paid the claim in full and the matter was settled. I have a settlement letter from the insurance company confirming this. I have also copy of the claim, signed and notarized by the issuer of the check. After this matter was settled, I returned to the bank to make a claim for the balance of fund in the account. I presented all settlement documents showing that I had paid the insurance claim in full for the check amount which was still on hold in a frozen account. The bank refused to release the funds to me. I have spoken to several officers at the bank, the fraud department, risk department, legal department and many others since XXXX, XXXX. On XX/XX/XXXX, I was asked to return to the bank branch for the result of a five day review of the funds in the frozen account. Since XX/XX/XXXX, I was told at least a dozen times, that the funds were " in review ''. When I returned to the branch on XX/XX/XXXX, I was told the funds will not be released to me. I then asked what will become of the funds in the account? I was told that after five years, the funds will be turned over to the state as unclaimed funds, and that I would then have to make a claim with the state. Presently the account has a total of {$3000.00}. In addition to proceeds from the check, there is cash which is also not being released to me. I countered that waiting five years to turn over the funds as " unclaimed funds '' is not factual as I have been making claims on the funds for the past two and a half years and I have legitimate documents proving that the funds belong to me. The bank is still refusing to release said funds to me.

Consumer Complaint: Bank of America has unjustifiably taken just under {$2000.00} from me since yesterday and when I contacted them this morning to return it they offered an absurd explanation blaming me for paying into my account at the beginning of XXXX. They offered to send a paper check in 14 days. When I said yes return my money but I would like it immediately they ended the conversation and provided a generic phone number to call. I was not rude or volatile. I made sure to express my displeasure but kept it very civil as it is not the employees fault but the institution theyre employed by. The employee failed to perform her job function and did not submit a refund claim for money they have yet to reasonably justify taking from me. I have a reasonable suspicion this is an act of retaliation for my claim against this card last month that went unresolved.

( see attached foreclosure document ) For years we wondered why BofA ignored the hold on the loan as we were working out a loan modification with Countrywide. We learned recently that the house sold for more than the loan amount - substantially more. Bank of America however made sure to use up all the excess amount above the loan balance by tacking on misleading, inaccurate and bogus interests and fees so that there will be no surplus foreclosure funds ( that normally would be returned to the homeowner. ) This complaint is for Bank of America to return to us the excess or surplus foreclosure funds that they illegally appropriated for themselves and " stole '' from us.
