Issue: Closing on a mortgage
Subissue: Fees or costs after closing
Consumer Complaint: I received a letter dated XX/XX/XXXX from Bank of America stating they attempted to mail a check in the amount of {$1100.00} for the execess funds remaining on a home loan escrow account. I called Bank of America on XX/XX/XXXX regarding this letter, explained that I had divorced the co-borrower on the loan and asked for the check to be re-issued in my name solely, as the payments for the mortgage over the last year had come from my personal bank account. I was told to mail in the attached form and a copy of the Divorce Decree and Separation Agreement. I mailed these in the next day. I received a second letter dated XX/XX/XXXX stating that " The divorce decree and marital separation agreement states that the property will be split '', and asking for additional information regarding my divorce. I spoke with two different representatives on XX/XX/XXXX requesting the refund check be split, so I could be mailed my half of the amount in accordance with the decree. I was told they are unable to follow the Court Order without written consent of the co-borrower, my ex-spouse. I explained that it is not safe for me to be in contact with my ex-spouse, and asked for a Bank of America representative to contact him if they needed his consent. They refused. Bank of America is refusing to follow a Court Order, and instead is choosing to profit off of me by not releasing my half of the refund.

Issue: Managing an account
Subissue: Funds not handled or disbursed as instructed
Consumer Complaint: On XX/XX/XXXX, a bank transfer came into my checking account from XXXX XXXX from a company called XXXX XXXXXXXX XXXX XXXX. Bank of America cleared the transfer in the amount of XXXX without contacting me as being unusual activity in my account. On XX/XX/XXXX ( 26 days later ) XXXXXXXX XXXX came and took the money back as an unauthorized transfer. Bank of America froze my bank account with my Social Security XXXX XXXX being in process. I went to the Bank of America and my debit card was confiscated, and I wasn't allowed to have my XXXX check in the amount of {$920.00}. The fraud department wouldn't talk to me, and didn't return my calls. Another department told me it would be 90 days of an investigation to resolve this. On the XXXX th day, I received a phone call from a detective who asked me questions I answered to the best of my ability. I was receiving letters and statements for a few months until Bank of America closed my checking account, and said they would be mailing me a cashier 's check in the amount of {$920.00}. I never received the check, called and asked what address they sent it to, I was told only that it was mailed out on XX/XX/XXXX, and I would have to wait until it expired to get another one sent. In XXXX on the day it expired, I entered the Bank of America Branch in XXXX Florida and sat down with XXXX XXXX, the bank manager as she looked at the papers and letters I had, she called the number for that department, they said they could mail it to her Branch where I could pick it up. Then they put her on hold for over XXXX minutes, transfered get to someone else who told her they sent it back to the Social Security Administration. I called and was told it wasn't returned to XXXX. So I went into another branch in XXXX XXXX, where I heard a conversation on the phone with another bank manager, who was saying " I don't understand what you're trying to get me to tell her. '' Three times she said that to whoever she was talking to. She got off the phone and handed me a phone number and told me I had to file an appeal on his claim. I was never contacted about any claim, nor given a claim number. Bank of America had to pay XXXX the money from that transfer. They lied to me several times about sending me my check. I called the number they gave me, and was told they had no idea what I was talking about.

Subissue: Charged for a purchase or transfer you did not make with the card
Consumer Complaint: My government XXXX card was never delivered to me. They said that I received it and activated it and booked a cruise and an XXXX purchase totaling {$3900.00}. I filed a police report, asked them to dispute the charges, asked them to research the charges and they completely stonewalled me. They said they had proof that it was me that activated the card and sent me a print out of the transactions as proof. I was in the hospital XXXX XXXX during the time the card was supposed to be delivered to me. The charges were made on the stolen card XX/XX/23. I submitted a claim on XX/XX/23 when I realized that the card should have been delivered and it wasnt. I found out about the charges when I called to inquire about where the card was. It has now been months and they require me to fax all the information to them and when I do, all I get is a denied claim response. This is very wrong and stealing from a new mother.
