Consumer Complaint: My Social Security XXXX ( XXXX ) was involved in a data breach that occurred on or before XXXX of XXXX, extending until XXXX. This breach affected individuals who underwent background checks and applied for jobs, leading to the appearance of numbers on my record. I did not provide consent for these accounts to be opened, and I lacked an understanding of credit and its mechanisms during that time. Consequently, I did not establish any credit relationships with the companies involved. I urgently request the removal of these erroneous entries from my credit report once and for all. The repercussions of these inaccuracies have been far-reaching and abnormal. Unfamiliar inquiries have appeared, accounts that I neither authorized nor opened have been added, and I've faced denials and disrespect due to these discrepancies. The errors in my credit report are extensive and profoundly incorrect. They encompass several aspects, including but not limited to : * Name Discrepancies : I want to clarify that my correct name is " XXXX XXXX XXXX XXXX '' I have never used nor consented to be referred to as " XXXX XXXX XXXX '' or any other variations. Despite numerous disputes, no corrective action has been taken, and this is my final attempt before pursuing legal action. Consumer Complaint: I applied for an Employment Development Department card and received a benefits card in XXXX through Bank of America. I made transactions from XX/XX/XXXX to XX/XX/XXXX. On XX/XX/XXXX, I checked the balance of my card of {$4700.00}. After this day, I decided to stop making transactions and let my benefits accumulate for the purpose of using the money for another payment in the future. I did not check on any statements, because I entrusted that Bank of America would have secured my benefits and notify me of any suspicious activity or fraudulent charges. My card expired on XX/XX/XXXX and I renewed the card. I received the new card on XX/XX/XXXX. Upon activating my card with my credentials, I discovered I had a balance of less than XXXX dollars. I filed a claim with Bank of America on XX/XX/XXXX to dispute any unauthorized transactions and requested a copy of all transactions. During speaking with a Bank of America representative, I was asked if I had received the renewed card. I was frustrated in the moment and forgot that I had the new card in my possession and said I never received the card because I was attempting to dispute the fraudulent transactions, not whether I received the card or not. I was frustrated, because my identity was stolen, and my benefits were stolen and wanted to just dispute the transactions. When receiving the document via email, I saw 43 fraudulent transactions totaling up to {$5400.00}. On XX/XX/XXXX, I received through the mail, a letter from Bank of America stating that my claim was denied because I renewed my card using my credentials and that the card was mailed to my address. On XX/XX/XXXX I called Bank of America again requesting to reopen the claim and filed a complaint with Bank of America. I stated that the issue was not whether or not I received the card but that there were fraudulent charges on my EDD card. I was asked to verify my identity via fax. On the same day, I faxed a photo of my government issued identification card and on XX/XX/XXXX I filed a police report documenting the unauthorized transactions and faxed it to Bank of America, along with my government issued ID and photos of the new/expired EDD cards in my possession. Therefore, I am making a complaint about Bank of America. I believe they were negligent and culpably indifferent towards my claim. I entrusted them with the security of my money/benefits and entrusted them to notify me of any fraudulent transactions and or suspicious activity, which they failed to do. I also entrusted them to reimburse the money/benefits that is stolen from me. If only they had made a thorough investigation of my claim by comparing my transactions from XXXX to XXXX to the unauthorized transactions I am disputing, they would have discovered that all of the fraudulent charges I am disputing were made outside of my area of residence, out of state, and internationally.

Consumer Complaint: Bank of America conducted a credit check on me without my consent. I gave them permission to perform ONE check when they they encouraged me to open a small credit card after closing my recently deceased wife 's credit card account which was brought to a XXXX balance. They then advanced money from that CLOSED account, after changing some of the information on the account, into MY new credit card account and then withdrew that money at the bank. They claim I was the one who withdrew the money without providing any evidence to support that accusation. They told me I needed a subpoena in order to obtain the documents and videos. After hiring a lawyer and providing a subpoena, they have yet to provide the evidence they used to deny my disputes. Consumer Complaint: I am submitting this complaint to BANK OF AMERICA due to improper used of my report and reporting inaccurate information on my file. I sent them a letter requesting to have an investigation to the unverifiable account, they stated that they did a proper investigation however when I checked my report the inaccurate information such as date opened, date of last activity, date reported, account status and payment history are still reporting. My rights were violated under 15 U.S.C 1681 section 602 A that states that I have the right to privacy, and 15 U.S.C 1681 section 604 A Section 2 stated a consumer reporting agency can not furnish an account without my written instructions.

Consumer Complaint: My XXXX check was stollen from the USPS post office on XXXX XXXX. The person who stole the check deposited it via mobile deposit into his account at Bank of America on XXXX XXXX. The check was written to XXXX XXXX XXXX for {$6300.00} as payment for my property tax. Bank of America deducted the funds from my XXXX account even though the payee did not match the depositors account. I filed a claim with XXXX on XXXX XXXX. I was unaware of the fraudulent deposit until XXXX XXXX of XXXX contacted me about late payment to my property tax bill on XXXX XXXX. I have been in contact via phone with XXXX Customer Claims Department every month since the complaint filing on XXXX XXXX. They have stated that they are in contact with Bank of America who has acknowledged the claim and is working on a resolution. It has been XXXX months and there has been no resolution or return of my funds. Today I received a letter from XXXX stating that if they do not hear anything from Bank of America within 90 days of the claim submission they will close the case and my funds will not be recovered. I have filled a police report with the XXXX XXXX, CA police department and with the United States Postal Inspection Service and have not received any information from them.

Consumer Complaint: On XX/XX/XXXX, I received an email from Bank Of America ( BOA ) stating my account was ready to be uploaded and funded. I immediately contacted BOA 's Fraud Department to notify them that I had not opened an account with them. On that same day, BOA shut down the account and everything was okay. On XX/XX/XXXX, I received another email from Bank of America stating an account was established in my name and again I called BOA and was assured the account was shut down. The Fraud Center recommended I contact XXXX and let them know my identity was stolen and to shut down any access, to ensure BOA would not open any more accounts. I did as I was instructed to do and contacted XXXX. At the end of XX/XX/XXXX, I received a Bank of America checking account bank statement on account number XXXX XXXX XXXX stating it had a XXXX balance. As a retired XXXX XXXX, I chalked it up as the computer issued a statement in error and that should be the end of the situation. Well, today I received another statement, so I immediately contacted Bank of America at XXXX and I asked why was I receiving statements on an account that shouldn't exist. Long story short I was informed by two employees they had no idea or clue and could not even verify if a statement was truly issued. One questioned if I actually received an authentic BOA statement. My concern is that I was under the impression that this account was closed and or even deleted from their system and obviously if I am still receiving statements it still exists. My other concern is that Bank of America is not doing its due diligence and fiduciary duty to ensure accounts are not being opened by people with fraudulent intent. If they ran Credit Reports and not XXXX this may have given them a better look at a consumer 's information and possibly that would have brought up questions of the customer 's phone number listed and or previously listed addresses etc. This whole incident is very troubling and stressful to me. I am listing the previous account number set up under my name in XX/XX/XXXX ; the account number ending in XXXX

I do not have funds in my bank account to cover these charges. I called Bank of America thinking that these XXXX charges were fraudulent. The representative informed me that these were legal holds from the state of Indiana. I asked if I had any rights to refuse these charges, and I was given the number for the Indiana XXXX XXXX XXXX : XXXX I lived in Indiana from XXXX while working as a professor at Indiana University XXXX XXXX. In XXXX I moved to Vermont and then several years later I moved to my current address in Massachusetts, where I have lived for over a decade while working as a professor at a small XXXX XXXX XXXX. I do not know what these charges represent and was not notified in advance of any impending deduction. I am also concerned that the statute of limitations on this debt may have expired. Now I do not have money to pay any of my bills. It is quite upsetting. When I looked online, I learned that Bank of America has been sanctioned by the Consumer Finance Bureau for allowing out-of-state garnishments of bank accounts and paychecks. This was just XXXX year ago, and the bank agreed to clean up its systems. They obviously are continuing to subject consumers to this illegal practice. I am also upset that despite the Consumer Protection Bureau 's order, issued in XXXX, the bank has ignored the Consumer Protection Bureau 's order to clean up its systems to halt these illegal out of state garnishments of bank accounts. Consumer Complaint: I realized in XX/XX/XXXX that I was making payments to a credit card that was paid off back in XX/XX/XXXX, and that Bank of America was still in fact taking money from my account which resulted in a credit that is owed to me by Bank of America. Bank of America from XXXX, never reached out to me. In fact right now- for XX/XX/XXXX, they are saying I have a past due balance that needs to be applied to the credit that is owed to me. ( Can I laugh at that?! ) below is my experience from XX/XX/XXXX from the time I made a call to customer service until this point : In XXXX, I got a bank statement from Bank of America ( like I do every month ). I made minimum payments to pay it off ; and apparently paid this credit-card back in XXXX. I signed in XXXX and noticed that bank of America was still taking out automatic payments for a PAID OFF BALANCE, and in fact, I had a credit that is OWED to me. I talked to a XXXX ( from Texas ) in XXXX ; and she realized that you have been charging me every month for a paid off balance which was applied to my credit. She told me that this has been paid off since XXXX and is not sure why I was still getting money deducted from my account. She then proceeded to ask me for my bank account info, which I gave her in which the manager was working to escalate it to get me refunded. I called two weeks later and talked to another XXXX ( from Tennessee ) ; and she told me that they were working on it ; and told me that {$120.00} ( the XXXX payment ) was refunded to my account. I told her what about the rest of the months, she said that she is not sure and needs to send this to a manager to escalate. Mind you, every single time I called about this, I had to re-explain myself, which you might not think is a big deal doing so twice, but I have done this over XXXX times! She told me that I needed to reach out to XXXX XXXX as thats where the money was sent. I proceeded to look at the XXXX XXXX at the State of IL ; and received a notice ( attached as part of this letter ) saying that they dont have anything on file for me, from Bank of America XXXX Go figure, now I have to call you guys again. I called in XXXX and talked to a representative again, repeated myself again and talked to an untrained employee who needs to be retrained, and I can not remember her name for the life of me, but dont worry it will come to me and I will file a complaint. She proceeded to tell me that I have a balance that needs to be paid off ; and I said no I do not and that is in fact the money that I am owed back as I was being charged for a paid off credit card. She was persistent in telling me I owed this but because she lacks training and common sense, I told her to go back to anytime last year to see what that balance looked like and what it looks like now ; they are two different types of statements, and on the last page of the statement it states that this is a credit and I do not need to pay for it. I got no where with this untrained person in fact wasted an hour and a half of my time, and in fact lost nerves too having to work with people who lack common sense. Again, no customer service experience or the mindset to think outside the box. So, I called again a few days later, and spoke with a gentleman out of XXXX, who told me that he can help me when I explained my situation and asked to speak to a manager. He transferred me to a manager who proceeded to say he is going to look into this and call me back, and guess what, he never called me back and neither did any other managers that promised to call back instead of flat out lied, cause guess what, I had to call AGAIN! I believe his name was XXXX the manager. I explained to him to look to see when I paid off my balance and that BoA never reached out to me about paying off a credit card that I dont owe money to. He said he is going to look at it and call me Thursday at the latest ( and we spoke on a Tuesday ) so 2 days later and nothing. He said he was going to call XXXX XXXX for the State of IL because apparently, its listed on the BoA end that they paid it to them, but the state doesnt have it, so I dont really know. Either way, he said XXXX call me Thursday, so I waited until that next week to allow for more time. As I promised myself, I called BoA that following Tuesday and spoke to another manager, explained myself again that lied to me again. I gave my bank account information again ; he said he was sorry and is going to help, and nothing again. This is the most frustrating experience ever, and I am going to sue if this does not get resolved. I did see that BoA was sued for not paying people out their rewards, and I feel like this is the same thing- BoA scamming people into not giving them their OWN money back.
