Consumer Complaint: I was withdrawing funds ( {$440.00} ) from my checking account at a walk-up Bank of America ATM in the evening on XX/XX/23, and received an error message that said, the transaction was approved but for security purposes your card has been restricted, call the number on the back of your card. No money came out of the atm. I called Bank Of America customer service, and they told me the XXXX came out of the account anyway, and they said they were filing a claim that night. They said they would expedite the claim so the funds would be returned the next business day. Monday morning, I call and they say there was no claim filed, and I filed a claim again. They said they would expedite it again. Later I call in today, they say my claim was denied immediate review, and that they can hold the {$440.00} that I never received that was in my account for up to 45 days.

Consumer Complaint: This new complaint is in reference to XXXX I have filed recently with CFPB with Bank of america . I have been a victim of fraud and identity theft si nce last year. Recently I had some unauthorized withdrawals from my account. I followed the steps from the bank and I also advised them that I did file a police report for identity theft in which they did not bother to get. I did speak to an employee at bank of america named XXXX XXXX on Friday XX/XX/XXXX he stated he worked in a " Executive position. He advised me that bank of america has me on cameras showing where I made these transactions. I did ask XXXX XXXX if he personally knows how I look or who I am and he stated no. I did ask him if he can use my Identification drivers license to compare the person in question and he stated bank of america does not have my ID on file. I did ask for a copy to be sent to me in which he couldn't say yes or no that he will be sending the evidence. I did ask him if my Drivers license matched the description of the person in question and he did advise me that bank of america does not have a photo Identification of myself. Due to the fact that I have been a victim of identity theft I highly believe that my identity has been stolen due to bank of america not having a tight security of my deposit account and falsely identifying myself without bank of america having a legal Identification photo of their customers. Bank of america will not give me my money back from withdrawals I haven't made during the time I was XXXX and XXXX XXXXXXXX. Last paycheck bank of america XXXX garnished my money without notice to be sent via Mail or a phone call as stated by federal guidelines under CFPB " If the bank or credit union determines that the transactions were in fact authorized, it must provide you with written notice before taking the money that was credited to you during the investigation out of your account. Also bank of america failed to comply with CPFB for the 45 day time frame to complete its investigation that was initiated on XX/XX/XXXX also no notices were sent to me via mail as requested. I did advise XXXX XXXX XXXX if I can send a " selfie '' of myself and my Identification drivers license and he gave me a false email address to its " claims department as stated on our recorded calls. I also wanted to provide police report in which he did not seem interested in. I did not want to post my medical condition due to embarrassment bit I believe they are saying I am lying about my recent diagnosis. I habe attached my FMLA with my doctor stating I can XXXX XXXX or work due to my XXXX XXXX. So how could I have made these transactions during my XXXXXXXX XXXX?

I just received correspondence from the Bank of America regarding a mortgage ( Acct # XXXX ) for XXXX XXXX XXXX XXXX XXXX, Michigan which documented that XXXX XXXX ( Acct # XXXX ) refinanced the original XX/XX/XXXX Bank of America mortgage ( Acct # XXXX ) sometime during XXXX. Following, the XXXX XXXX mortgage was then transferred back to the Bank of America on XX/XX/XXXX. According to the XXXX County Register of Deeds, XXXX XXXX never filed the mortgage nor the amendment and instead the XXXX County Register of Deeds only recording the XX/XX/XXXX mortgage and discharge of the same mortgage on XX/XX/XXXX ( XXXX County Register of Deeds documentation attached ). Please have XXXX XXXX send me a copy of the mortgage as well as the modification when the mortgage was transferred to the Bank of America on XX/XX/XXXX as well as filing the required documents with the XXXX County Register of Deeds. Consumer Complaint: Someone filed for EDD benefits under my social security number. I notified Bank of America as soon as I knew of the fraudulent activity in my name. At the time, Bank of America failed to file a claim for the benefits paidout through EDD. I was told to contact EDD and the benefits would be repaid to me directly, which they were not. Over hundreds of phone calls made to EDD and Bank of America between XXXX XXXX, and I have still not received the benefits that should have been paid to me on my unemployment insurance claim. On XX/XX/XXXX, EDD finally gave me the correct answer to reclaiming the benefits paid to the fraudulent person and that was to deal with Bank of America. On XX/XX/XXXX I filed a claim with Bank of America because they had not originally regarding the fraudulent activity. Bank of America then broke up the claim into four separate individual claims because the fraudulent person had requested different ATM cards over the time span of the claim. Three of the claims have been approved and one claim has not been. The one claim that has not been approved is for a total of XXXX. The other claim amounts were {$2100.00}, {$2400.00} and one {$5000.00} electronic bank transfer. All claims were originally denied multiple times before 3 of the 4 claims were approved. During that time Bank of America new of the fraudulent activity yet because of a error in the EDD system, My correct address was never updated and is still yet to be updated in Bank of Americas system. So every time there was an update on the claim or the claim decision, they were sending my personal information to the fraudulent persons address. This continues to happen over and over again despite notes that have been put on the account by Bank of America managers/ supervisors . The claims originally were denied for being more than 365 days old. Which unfortunately, because I didn't know about the fraudulent activity right away, I couldn't file a claim. And if Bank of America had filed a claim originally when I notified them in XXXX of XXXX, the claims would not have fallen outside of the 365 day window. The Second time the claims were denied I was told because there were transactions on the debit card after I had notified them of fraudulent activity. Which supervisors at Bank of America have verified that there were no transactions after the fraud was reported. It is now been over a year Calling XXXX times a week for status updates on the claim and it is now been escalated to the point where Bank of America has no time frame on when the claim will be decided upon. It goes months in the investigator 's hands with no update. As of today XXXX XXXX XXXX, I was told the last time the investigators left a note on the account was early XXXX. I feel like I have been stonewalled in getting any sort of resolution and reclaiming the EDD benefits that should have been paid to me. EDD has reported to the internal revenue tax offices that I received these benefits and I have received letters requesting that I pay the taxes on such benefits that I did not receive. I've requested for documentation from Bank of America on why the three other claims were approved, and was told that they are not allowed to give out the information on how the claims were approved and or why. I've tried to seek legal counsel but have not been able to find a lawyer or an attorney that knows how to go about dealing with Bank of America and resolving this issue. I've done everything Bank of America has asked, sending in a statement of fax, original police report numbers from when I found out about the fraud, copies of my driver 's license. with EDD, I jumped through multiple hoops and rings of fire verifying my identity, sending in copies of bills and bank statements and sworn affidavits verifying I am who I am. Going through the appeals court and even doing a live ID me interview proving I am who I am. I know this is long-winded but that is the short version of my problems with Bank of America XXXX I hope that you're able to provide assistance and resolving this issue and coming to a resolution with Bank of America. My credit return, it wasn't post in statement in XXXX XXXX. It returned on receipt, it was XXXX XXXX by scanning on receipt. I didn't come to use my credit card at XXXX in XXXX XXXX and it charged and weird happened, it was {$56.00}. It posted in XXXX XXXX. Why did happen VISA CARD charge and CHIP and post it become MASTER CARD charge receipt! It was fraud and weird happened from Bank of America credit card.

Consumer Complaint: Money was taken from acct XXXX I was not notified from bank that card was being charged {$2000.00} until I went into my app to see my acct was at {$0.00}. So I reached out to Bank of America they asked I go to the bank to speak to someone so I did. Specifically spoke to someone who stated I was the XXXX person that was there to speak to someone because of fraudulent activities on their bank accts. Co workers with Bank of America even had these suspicious activities that same week. After I spoke to the the rep at the bank they stated it would take 45 days for the acct to be reviewed and investigated. I had not received any type of notice until I called BofA. She stated they needed to close my whole acct and make a new one. Never received any new bank information or a call to have something set up or have me come in to get a new bank acct. A few days later I had received a letter basically stating they reviewed account and no further action was needed. This was my mortgage payment and has now put me behind.
