Consumer Complaint: I was told i was able to open a bank account with no issues. So I wasted time and money going to the bank in person and all that wait time. To be told they can not open my account even though I brought my documents. They told me that it was because of XXXX XXXX and I got in contact with them. They told me they don't have any thing to do with opening a account. That is the decision of the bank and to contact them about it to see what is going on and why they keep giving the run around. I am just trying to open a checking and savings account. I feel that the bank of America is not telling me the truth and not helping me with opening an account. I have check my XXXX XXXX report and there is nothing bad on my report to prevent me from opening my accounts.

Consumer Complaint: on XX/XX/year> I paid XXXX XXXX XXXX XXXX {$1300.00} for my past bank of america credit card. the court date was to be XX/XX/XXXX and they told me i may have to go to court. I called the court and they said that i still had to attend court. XXXX XXXX XXXX failed to alert the court that i paid the debt. i was there in court waiting for their reps to show up on the XXXX of XXXX, but no one was there representing them. they should have contacted the courts on the XXXX to drop the case. the money that i paid them was from my va XXXX and social security XXXX. paying them money from both sources has caused me a lot of XXXX due to my XXXX from XXXX XXXX. they also rarely answer their phones. and since they didnt show up for court i want them to refund my money, especially since it's from my XXXX payments. Before a debt collector can take Social Security or VA benefits, they must sue you and win a judgment against you for the amount you owe. Then, the debt collector must get a court order that tells your bank or credit union to turn over money from your account or prepaid card. and they did not get a court order for this. they also never gave me time to do the confession of judgement they wanted me to sign, due to all of my military related health issues.

XXXX works in the fraud department and asked me about a check and wanted to know if I wrote it. I said no and said he would stop payment on this and he transferred me to another fraud specialist named XXXX # XXXX. She asked me for my social security number and I gave it to her and realized that was not a good idea and I told her I would call her back to get information and she HUNG up on me. I immediately called the bank back to inform the bank I had scammers calling me pretending to be the bank because the number XXXX called from was XXXX XXXX number and not the bank. The bank made me feel better because XXXX and XXXX do work for the bank. And the representative of the bank said that I did approve the check. She changed the check to fraud. I told the bank to listen to the recordings so the bank could listen to me saying no. The bank said the check was not cashed and I would get my money back in two days. I went into my account and looked at the check and it was cashed # XXXX {$4500.00} to a XXXX XXXX XXXX. I reached out to the XXXX XXXX where the check was cashed XXXX XXXX XXXX. I spoke to the CEO and he said the check was approved by the BOA and he was concerned as to why BOA never contacted him about this matter. I spent 3 days working on this ... one BOA employee said that XXXX is a really nice guy and would never do this on purpose and that they will be retraining him. If you would like to see the check that XXXX approved let me know. I am so glad that I called the bank back after talking to XXXX after she hung up on me. If I had not called back, XXXX would have changed the check as fraud after XXXX approved it without my consent. And I never would have known. I filled out a report to the Federal Trade Commission. I went to the Police Department and they said, we are short staffed, filing reports takes a long time and as always people filing the reports never get justice. I am not able to get the recordings or my notes entered from BOA. I believe that I found a fraud glitch in the BOA system. I asked BOA why XXXX called me from a State of California XXXX # and they said BOA uses their number. I believe I have my money back. I am not closing my account because if I do I won't be able to contact them about this situation if I have more questions.

Consumer Complaint: Dear Bank of America, I am writing to address a concerning issue regarding our agreement and the handling of my financial affairs. Upon reviewing our agreement, I have come to realize that there are significant discrepancies and breaches of trust on your part. I extended my credit with Bank of America in good faith, expecting that my security would be traded on the secondary stock market as agreed upon. However, it has become evident that Bank of America has failed to perform its duties adequately. I discovered that your organization was relying on the assumption of my incompetence, hoping that I would not notice the waiver of my rights to the security interest. Despite my initial oversight, I am now fully aware of the situation and am prepared to take appropriate action. I understand that while I may have waived certain rights, you are still obligated to issue my billing statements. Furthermore, I am competent enough to recognize that I must accept my dividend check at face value and return it to ensure proper balance in the books. It is unacceptable for Bank of America to tarnish my creditworthiness unjustly. Your actions, including the reporting of late payments, while engaging in security fraud, are egregious and must cease immediately. I remind you of your obligation to adhere to the Fair Credit Billing Act ( 15 U.S.C. 1666 ), which requires financial institutions to adopt reasonable procedures to ensure that consumers receive billing statements. Moreover, under the Uniform Commercial Code ( U.C.C. ), specifically 1-302, any attempt to limit rights and remedies for failure to comply with obligations is unenforceable. Additionally, Bank of America failure to send billing statements via certified mail, thereby knowingly committing mail fraud, violates Title 18 of the United States Code ( U.S.C. ) 1341. I demand that Bank of America rectify the situation promptly. You have 30 days from receipt of this complaint to update my account to " paid as agreed, never late.
