Consumer Complaint: On XX/XX/2015, XXXX XXXX XXXX engaged in a open ended credit transaction with American Express. American Express sent me monthly statements, which showed a positive number in the balance column stated that I owed a debt. 18 USC 8 shows that all obligations ( debt ) are the responsibility of the US. American express has called me on numerous occasions and have sent me emails about paying a balance that is in the positive. They have engaged in adverse action by closing my account and reporting negative information on my consumer report. All of the statement they have sent me have billing errors on them. They have violated me by stating that I owe this alleged debt and by closing my account and by furnishing negative information on my consumer report without my written permission.

Issue: Getting a credit card

Subissue: Application denied

Consumer Complaint: Let me begin by stating that I, as the natural person is the original creditor, and credit is my RIGHT granted pursuant to 15 U.S. Code 1602 - Definitions and rules of construction ( e ) The term person means a natural person or an organization ( f ) The term credit means the right granted by a creditor to a debtor to defer payment of debt or to incur debt and defer its payment. ( g ) The term creditor refers only to a person I would like to inform the Consumer Financial Protection Bureau of the violations of this company under the Truth In Lending Act ( TILA ) & the Equal Credit Opportunity Act. I applied for an extension of credit on XX/XX/2021 and engaged in a consumer credit transaction pursuant to 15 USC 1602 ( i ) and was denied extension of my credit by this company. This company has violated 15 USC 1681a ( k ) ( iv ( II ) & 15 USC 1691 ( d ) ( 6 ) - Adverse Action, because the action that this company took was adverse to the interest of myself, the consumer. I have included the law here for reference. 15 U.S. Code 1681a ( k ) Adverse Action. ( iv ) an action taken or determination that is ( II ) adverse to the interests of the consumer. Let me remind this company that pursuant to 15 USC 1602 ( j ) I have an open end consumer credit plan in which I am able to contemplate repeated transactions. There is no limit to the amount of credit I am able to extend myself as the original creditor. I contacted this company on XX/XX/2021 at XXXX EST and spoke with a representative to inform this company of their violations and to reconsider their determination of my application to prevent further concerns. I was met with harassment and further violations and this company refused to extend credit to me. I would like to further remind this company that they are in violation of 15 USC 1691 ( a ) ( 3 ) as this company has discriminated against me for my attempts to exercise my rights under 15 USC 1691- Equal Credit Opportunity and extend credit back to myself. It is discrimination for a creditor to invoke adverse action for a credit consumer transaction if that transaction was in part due to a consumer report. I have included this law here for reference 15 U.S. Code 1691 ( a ) Activities constituting discrimination ( 3 ) because the applicant has in good faith exercised any right under this chapter. As you can see Consumer Financial Protection Bureau, This company has violated my rights as the natural person and a consumer. This company is held liable under 15 USC 1691c ( 1 ) ( A ) ( B ) and they are held liable for their discrimination and violations under the Federal Deposit Insurance Act, in addition to 15 USC 1691c ( c ) they are held liable under the Federal Trade Commission Act. Before I continue to file for monetary damages because I, the consumer, have been mistreated by this company and they are held civilly liable under 15 USC 1691e ; I would like to hear their response in hopes that they reconsider their position. - I have also included the letter that they sent me after my application was denied for reference for this company Sincerely XXXX XXXX

Issue: Closing your account

Subissue: Company closed your account

Consumer Complaint: Debt Collector, AMERICAN EXPRESS closed my credit card due to non payment of an alleged debt. As a consumer, credit was extended to me through the use of my social security number that is linked to an account attached to the strawman XXXX XXXX that was issued to my parents at my birth. AMERICAN EXPRESS can not issue credit as banks do not have the power to do so. This credit transaction is already being paid for through my account at the treasury thus, I have open ended credit. Since this was a consumer credit transaction I should have received the proper disclosure form for rescission under the Truth In Lending Act in which AMERICAN EXPRESS did not disclose to me. That is a violation of 15 USC 1635. I also disputed this alleged debt and since it was in dispute AMERICAN EXPRESS was to return to me all payments that I have made to them in which they did not which violated 15 USC 1692h in the Fair Debt Collection Practices Act.

Issue: Getting a credit card

Subissue: Application denied

Consumer Complaint: Today, I contacted American Express with an attempt to redeem an American Express Rose Gold Credit Card. The company notified me that I was denied based on my credit score. I did speak with a representative ( XXXX ) who told me all of the reasons why my credit was denied during this transaction. As a living breathing person of sound mind and body aware of my consumer rights, I understand that I am the owner of the credit and simply issuing a credit to myself. Via 12CFR1002 regulation ( b ), this act of denial is discriminatory and I would like to further look into this matter to come to a suitable resolution.

Issue: Advertising and marketing, including promotional offers

Subissue: Confusing or misleading advertising about the credit card

Consumer Complaint: American Express offered me a 0 % APR for purchases from XX/XX/XXXX through XX/XX/XXXX. I paid my bill in full for any charges before the promotional date started and have paid more than my minimum payment since then. I keep being charged interest each month. Each time I chat with American Express, I am given different reasons and excuses. None of which match the agreement terms I accepted that Amex offered me. I have the details of the deal from Amex in an email. What they are doing is very misleading and I believe violates Fair Credit Billing Act. They kept trying to tell me different dates of why I was being charged, each of which I was able to prove wrong. Then, I was finally able to get in touch with a manager, he explained that I paid all charges prior to the start of the promo APR. I even paid over the amount due to pay some towards what I am using the promo offer for. The manager said they apply the payment how they see fit and applied part of it to my charges before the promo period and applied the majority of it towards my 0 % promo charges. This is unacceptable and I believe it is fraud and misleading business practices. I have attached the recent chats with them which shows part of the misleading answers their employees were giving me, but I don't have access to the previous messages.

Issue: Problem with a purchase shown on your statement

Subissue: Card was charged for something you did not purchase with the card

Consumer Complaint: I received an American Express gift card for {$50.00} on XXXX XX/XX/2021. I used the card to purchase {$25.00} in gas on XXXX XX/XX/2021. On XXXX XXXX I went to the same gas station using the same process to purchase another {$25.00} in gas. The clerk informed me that the transaction was refused because I didn't have sufficient balance for the {$25.00}. I requested {$20.00} in fuel instead of the {$25.00}, so there should be {$5.00} remaining balance. I looked up the account online on XXXX XX/XX/2021 and the balance shows a negative {$20.00}, as all three transactions are showing completed ; {$25.00}, {$25.00} and {$20.00}. This seems highly unlikely as I only received {$45.00} in benefits and American Express would go out of business if their systems allowed negative balances on prepaid gift cards. I called into the Amex call center and spoke with two different agents, both of whom told me that all three transactions were good and that there was no way to dispute the {$25.00} charge. In my view, Amex is doing everything they can to make it difficult to receive the full value of prepaid gift cards. This is known as " breakage '' and it appears the systems are designed to maximize the breakage at the expense of the consumer.
