Subissue: Information belongs to someone else
Consumer Complaint: I recently received a copy of my credit report which showed several unauthorized and fraudulent inquiries and accounts on my credit report that were not opened by me ( See attached Affidavit, and Police Report ) that resulted from a short vacation in XXXX XXXX, Florida. I don't have any knowledge of these accounts being open, and any contract bearing my physical WET signature is fraudulent and was not signed by me. I understand that under federal law, ( Sec.602 ( a ) ( b ) of the Fair Credit Reporting Act. ) unauthorized inquiries, and fraudulent accounts shall not be allowed to be placed on my file unless I have approved it. I requested proof from the creditor, and they were unable to provide me with any proof otherwise. The presence of these fraudulent accounts and inquiries on my credit report constitutes inaccurate information, which must be removed under the ( Sec.602 ( a ) ( b ) ) Fair Credit Reporting Act. According to the FCRA Section 609 ( a ) ( 1 ) ( A ) you are required by federal law to verify, through the physical verification proof of the original signed consumer contract ( i.e. an original consumer contract with my signature on it ) any and all accounts that you post on a credit report. Otherwise anyone paying for your reporting services could fax, mail or email in a fraudulent account. Furthermore, I requested proof from the creditor, and they were unable to provide me with any proof otherwise.

Issue: Problem with a purchase shown on your statement
Subissue: Card was charged for something you did not purchase with the card
Consumer Complaint: The issue is regarding American Express case # XXXX, XXXX, XXXX. American Express rebilled my account for without my consent more than 2 billing cycles after dispute notice was reported to American Express. Disputes were reported XX/XX/XXXX. XXXX closed XX/XX/XXXX, then we had 2 additional statements closed, XX/XX/XXXX, and XX/XX/XXXX. Amex can not suddenly come On XX/XX/XXXX to reapply these charge after such an extended time exceeding 2 billing cycles without my express authorization. Furthermore, the rebilling was without any valid basis but pure corruption on the part of AmEx by some very bay players within American Express. See attached documents confirming the date if dispute and credit. All of a sudden, long after the 2nd billing cycle has ended, American express sent me notice informing me they will be rebilling my account.

Issue: Fees or interest
Subissue: Problem with fees
Consumer Complaint: I had a scheduled payment on XX/XX/2022. I was notified by Amex that the payment on XX/XX/2022 was returned due to insufficient funds but that no action was needed from me because they would make another attempt. I was then charged a {$29.00} Return Payment Fee. I was surprised because it never happened before. And there were funds in the paying bank. Later the payment went through with no issue. I contacted American Express for a refund of the {$29.00} Return Payment Fee. But the agent XXXX from Website Chat told me that he could not help me in any way that I should contact Customer Service by phone. I called American Express, and the agent XXXX told me the fee was charged by the paying bank and she could not do anything at all and that I should contact the paying bank for reimbursement. I then contacted the paying bank, XXXX, the representative told me that XXXX did not charge any fee in the process and I should be contacting Amex. I am really disappointed in Amex agents scripted answer and basically it was a lie and very misleading. They would not provide any help and just wanted to turn me away. I do not think this charge should be on me or the paying bank, XXXX.

Issue: Incorrect information on your report
Subissue: Account status incorrect
Consumer Complaint: XXXX is consistently ignoring my requests to update an account which the data furnisher has already admitted they're reporting erroneously. AMEX # XXXXreported I was late on my payment. But they had closed the account & never adjusted the accounting accurately. XXXX has not done their job in verifying this information. I've contacted them numerous times over the phone as well as AMEX. The account is in good standing. XXXX has failed to comply with FCRA Section 611 where they're supposed to get verifiable proof. They're also violating section 616 & 617 by willful noncomplying with FCRA laws. I need both AMEX & XXXX to update their records to reflect a positive tradeline. I'm currently suffering emotional stress which is causing performance issues at my job. I need this matter handled ASAP. Please update to closed/never late. Thank you

When I applied for a XXXX Credit Card and when I went for a limit increase back in XX/XX/XXXX. In good faith I exercised my right to credit in which I intended for my personal, family and household use and was discriminated against pursuant to 15 USC 1691a ( 3 ). I understand that no personal information shall be taken for public use without equal and or just compensation pursuant to the US Constitution. entered into a consumer credit transaction with American Express by submitting an application which became an asset when I entered my name, address, phone number, email and social security number which secured an account in which I received No Benefit. Since I received No Benefit pursuant to 15 USC 1602p this is an unauthorized use of the consumers social security number/credit card pursuant to 15 USC 1602l . I have enclosed a copy of the adverse action letter which evidences unfair, deceptive and abusive practices pursuant to 12 USC 5531 in which I have highlighted. Since the letter you sent me on XX/XX/XXXX is both proof and evidence that I have been discriminated against, you are also criminally liable. I demand that American Express resort to reasonable procedures to rectify this affair and compensate me for the use of my personal information along with my social security number and all the proceeds it generated in the application/asset. Otherwise, this would be considered an unauthorized use since I have received NO BENEFIT. Following this initial attempt to rectify, I will be sending an invoice to collect actual damages for said violations. Silence is Acquiescence, Agreement and Dishonor.
