Consumer Complaint: My name is XXXX XXXX and all information stated below is to be accounted for as my personal statement. My identity and personal credit report were used without my knowledge or consent. The reporting of this information is in violation of the FCDPA 15 USC 1692c 805 ( b ) Which states : " Except as provided in section 1692b of this title, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a post judgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector '' My personal credit file is displaying information that is fraudulent and I have attached the Identity theft report as required by FCRA 605B ( 15 U.S.C. 1681c-2 ), Subsection ( b ) ( a ) Block. Except as otherwise provided in this section, a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt by such agency of ( 1 ) appropriate proof of the identity of the consumer ; ( 2 ) a copy of an identity theft report ; ( 3 ) the identification of such information by the consumer; and ( 4 ) a statement by the consumer that the information is not information relating to any transaction by the consumer.

Consumer Complaint: On XXXX, XX/XX/XXXX in the morning I was able to use the card just fine. This is an account I've had open for some time and have my paycheck deposited onto. Then, I received an email advising that my account was suspended. When I tried to call, I received the following email without ever even reaching a human being : Hi XXXX, During our recent review of your Serve Prepaid Debit Account, we identified Account activity that we believe violates the terms of the Consumer User Agreement. As a result of such activity, and pursuant to Section 15 ( d ) of the Consumer User Agreement, your Account and your Account privileges have been permanently suspended. If you have any questions or would like to inquire further, you may write to us at the following address : Serve Customer Care XXXX XXXX XXXX XXXX, GA XXXX Thanks, The Serve Team I don't understand this. The last purchase I made was to send myself a few packages, as I am in the process of a cross-country move and have a XXXX and need to do this as opposed to using a XXXX ( I don't know if this flagged some sort of activity- shipping parcels? ). I have paychecks directly deposited onto my account. I had to immediately connect with my employer to have my direct deposit cancelled. I've had funds left on the card. I have no idea what happened or why. I reached a representative and was told to call XXXX with no explanation or anything.

Consumer Complaint: We booked a room at a hotel in XXXX for a week, using our American Express card. Upon arrival to the room, the heater was broken and it was 11 degrees outside. The next day the hotel maid stole a pair of diamond earrings from the bathroom counter of our room. We called police and vacated the room immediately. The hotel manager charged us for the full week although we stayed two days. We filed a dispute with American Express under the terms of our card holder agreement. This agreement has numerous rules violated by the hotel. It also clearly states the card can not be used for illegally activity. The hotel was given 20 days to respond which they did not comply with. The consumer protection laws of XXXX make it illegal to rent rooms without heat. Initially, American Express sided with us and gave full credit for the charge of {$1800.00} from XXXX They later reversed this decision and recharged our account. We believe American Express compared the amount of annual business we do, vs the annual business the hotel does and violated agreement terms in favor of XXXX XXXX.

Consumer Complaint: On XX/XX/2023, I sent an affidavit of truth to the following companies regarding reporting inaccurate information to my consumer file at XXXX, XXXX and XXXX. The first complaint was sent to XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX and American Express and XXXX XXXX XXXX. According to the tracking numbers that were provided in the affidavit of truth they received the information and the dispute and continue to report the errors to my credit file. The following financial institutions are continuing to violate the Fair Credit Reporting Act after I requested to exercise my right under 15 USC 1681 ( i ) ( a ) ( 2 ) ( B ) 2 Exclusions please see attached affidavit of truth. Also, under the Fair Credit Reporting Act and the Federal Trade Commission specifically the Gramm-Leach Billey Act 15 USC 6802 Obligations with respect to disclosures of personal information and my right to opt out from credit reporting was violated by these financial institutions. All five of these financial institutions knowingly and willfully withheld pertinent information regarding the disclosure of my information to affiliated and non-affiliated third parties, which include XXXX, XXXX, and XXXX. They knowingly and willfully withheld information that explains how I the consumer can exercise the non-disclosure option. The following accounts are in violation of the Fair Credit Reporting Act 1. Consumer Complaint: I paid the total amount owed on my American express credit card. I paid the XXXX $ off completely. My balance was XXXX after my payment. I have the receipt from my bank. I used a cashiers check from my bank XXXX XXXX XXXX XXXX. After a few weeks i get a bill from American express saying I own XXXX $ on a XXXX balance. I contacted them and said I do not own anything. I paid the balance off in full. I received a letter from American express saying they cleared the fees and that I do not own the XXXX XXXX I immediately called American express and asked them what the balances was and was told XXXX dollars balance. I told American express to close my account, I no longer wanted anything to do with them. My account was closed in XX/XX/2022 with a XXXX balance and nothing owed to them. for the last few weeks American express keeps sending me bills saying I owe them {$40.00} dollars, I have even send them there own letter sating that I do not owe them anything. They are hurting my credit report and I would liked them fined XXXX dollars and would like to be paid XXXX dollars for the emotional stress and damages to me and my credit. I had to close my credit card because of them and there wire fraud scam and that hurt my credit report.

Instead of writing a book I will simply state the facts as briefly as possible. I received an E-mail from XXXX XXXX that they charged my account with a fictitious charge of about {$450.00}. I called the telephone number in the e-mail to get this corrected. The man who answered said it was a mistake on the part of XXXX XXXX and that they would correct it and add an extra {$50.00}, for my trouble. The man on the telephone had me input the correction amount of {$450.00}. In my computer and told me that I input the wrong amount. He then showed me my bank account that reflected a deposit of {$5000.00}. Then he had me withdraw the {$5000.00}. and said to buy 10 - {$500.00}. Gift cards. I only purchased 4 cards, read him the numbers, then I stopped at the police station and informed that I had been scammed good. Th man called me to see how I was making out when I was speaking with the officer so I let him answer the phone. It was a short conversation. I called American Express within a couple of hours to stop the payment on the four gift cards but two had already been cashed and American Express had prevented the payment on the other two cards. I immediately called American Express and they refused to speak with me because I was not the vendor. The supervisor at XXXX on XXXX XXXX ( XXXX ) tried her best and called me for my name and mailing address because she was told that they were going to send me some new gift cards. It Never happened. I called American Express in XXXX and spoke with customer service for a good half hour. She was no help and said that it was against company policy to refund money or to issue new cards and that there was nothing she could do. I told her that I wanted to speak to her supervisor and she reluctantly told me she would but it would take a few minutes. After two to three minutes, I heard the phone ring. After another five minutes of listening, I put the phone down on my desk and listened to it ring another forty five minutes. I was only looking to be reimbursed for the two cards that American Express canceled. The two that were cashed are on me. I am the one that got scammed. I did not expect to get scammed by American Express as well and neither did I expect to get treated the way I did by the American express supervisor. I always thought well of American Express, and I am very disappointed. I think that customer service is not in that supervisors vocabulary, and he probably does not realize what his attitude can cost your Company. Since American Express cancelled the last two cards they should either refund me the money or issue new cards as they initially intended. Thank you for listening. God Bless You. It is a Fact that afant is the only natural person with rsthand competent knowledge of the facts of this transaction. 2. It is a Fact that afant is a consumer as dened in the Fair Debt Collection Practices Act specically, Title 15 USC 1692a ( 3 ) because afant is a natural person. I am writing in regards to the XXXX data breach & the subsequent compromise of my personal information.
