Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: Dear Sir/Madam, I am writing to you to file a formal complaint against XXXX XXXX XXXX XXXX regarding the detrimental impact their actions have had on my financial well-being and overall quality of life. The actions taken by your company have resulted in significant hardships, including threats of legal action and potential damage to my credit score. I firmly believe that these actions not only violate consumer protection laws and regulations but also constitute illegal practices, such as the unauthorized purchase and resale of my debt without any evidence of my agreement to such obligations. It is of utmost importance that your company provides conclusive evidence demonstrating my consent to the acquisition and subsequent resale of my debt. The absence of any record indicating my agreement renders this process completely illegal. I demand transparency in this matter and an immediate cessation of any attempts to resell the aforementioned debt back to me. Furthermore, I am deeply disturbed by the threats your company has made, including threats of legal action and adverse effects on my credit. Such actions not only violate consumer laws but also disregard the ethical standards expected from a reputable organization. The following is an overview of the laws and codes that your company has blatantly violated : Violation of Consumer Laws and Codes : a. Fair Debt Collection Practices Act ( FDCPA ) [ 15 U.S.C. 1692 et seq. ] : Your company 's actions, including threats of legal action and credit damage, contravene the FDCPA, which safeguards consumers from abusive debt collection practices. b. Fair Credit Reporting Act ( FCRA ) [ 15 U.S.C. 1681 et seq. ] : By reporting inaccurate and unjustified negative information on my credit report, your company has violated the FCRA, which mandates fair and accurate credit reporting. c. New Jersey Fair Credit Reporting Act [ N.J.S.A. 56:11-33 et seq. ] : Your actions also breach the New Jersey Fair Credit Reporting Act, which protects consumers from unfair and inaccurate credit reporting practices. I kindly request that you conduct a thorough investigation into the details outlined in this complaint and take immediate steps to rectify the situation. Additionally, I expect to receive a written response promptly, acknowledging the receipt of this complaint and informing me of the actions your company intends to take to address the issues raised herein. Failure to resolve this matter in a satisfactory manner will compel me to escalate this complaint to the New Jersey Attorney General 's Office and the New Jersey Office of Attorney Ethics. I am prepared to exercise my rights under the law to protect my interests and seek appropriate legal recourse. To rectify the situation, I demand the following actions be taken : * Immediate removal of the negative credit reporting associated with my credit card account from all credit reporting agencies. * Cessation of any further negative reporting or collection activities related to this account. * Written confirmation of the removal of the negative credit reporting within 14 days from the date of this letter. * Written acknowledgment that my complaint and your response will be forwarded to the Attorney General 's Office of New Jersey and the New Jersey Office of Attorney Ethics, in accordance with applicable laws and regulations.

Issue: Trouble using your card
Subissue: Credit card company won't increase or decrease your credit limit
Consumer Complaint: On XX/XX/2023 I received the following message from American Express regarding my no-preset spending limit card. Your Preset Spending Limit has changed We're reaching out because we wanted to let you know as quickly as possible that after a recent review, we have assigned a Preset Spending Limit of $ XXXX, XXXX to your account. The annual fee that I have been paying on this card for the last 6 years, and the terms of agreement with the lender corresponds to a no-preset limit CC. Now, Amex arbitrarily chose to place a preset limit despite no late payment and balances paid in full. Whats more, at the time of this abrupt change my business was in the middle of making international payments with this card for US Gov contracts. Charges were suddenly declined with no fair warning. This goes against consumer protection laws. Additionally, it also goes against consumer privacy, since they are asking for my personal returns before deciding if they will reinstate the no-preset spending limit that I had for the last 6 years. I can not presently provide this information. The representatives I spoke to say that the decision is AI based and they cant do anything about it. The bot may choose to limit the card due to incremental activity. We have been using the card for business as always intended. Historically, charges have always been the same. This is blatant prejudice and disregard for small business. After more than a 6-year perfect credit relationship with Amex, they have no right to arbitrarily limit my use while still charging exorbitant annual fees that correspond to a no-preset limit card. American Express needs to comply with the terms & conditions that I originally signed up for, and pay for. Otherwise, they are breaching consumer protection laws and putting my XXXX business at risk as an unreliable lender. They are also misleading the consumer by offering no-preset limits, at the most expensive annual CC fees in the market, and then turning around and modifying their agreements at will.

Issue: Closing an account
Subissue: Company closed your account
Consumer Complaint: American Express closed my checking account and stated it was due to an incorrect address, the address was input by customer service who misspelled my street name and I was not notified in advance of this action. Additionally, The previous complaint that I filed was closed based on the fallacious answer via letter from Amex in which they state that I made a late payment directly contradicting the outcome of the directly previous complaint that I'd made about them stating that I had not paid when I had and was NOT late in this complaint their resolution was to REPAY ERRONEOUS LATE FEES. They follow up with an iteration that they follow the REMA laws, when in fact they do not. Audits are NOT randomized and a customer service worker explained that it was " something in my credit report '' that caused the audit. I have searched all credit agencies AND XXXX and have NOT found any information that would justify an audit. I provided more information to them upon request than I provided to acquire the account XXXX years ago. They ignore it claiming that I needed to show them wages and investments etc. I generate several streams of income none of which I have to justify and since there was no valid catalyst for this audit, I continue to posit that this is discriminatory/ retaliatory and unlawful under several rema laws which I will cite here : the Equal Credit Opportunity Act ( ECOA ), 15 U.S.C. 16911691f, and the Consumer Financial Protection Act of 2010 ( CFPA ), 12 U.S.C. 5536 ( a ) ( 1 ) ( A ) 2 The Federal Financial Institutions Examination Council ( FFIEC ) Interagency Fair Lending Examination Procedures ; page 29. 3 The FFIEC Interagency Fair Lending Examination Procedures ; page 32. 4 12 CFR 345.41 ( a ). 5 12 CFR 345.41 ( c ) ( 2 ). 6 The FFIEC Interagency Fair Lending Examination Procedures ; page 32. Please do not close this complaint until you receive an actual answer as to the lawful cause for the audit and the adverse actions other than a simple " denial '' any criminal simply can deny any action, this does not make the statement valid. My credit rating fell from XXXX to XXXX through no action of my own and I don't want to receive another generic boilerplate letter intended to make me seem at fault when simple forensic investigation PROVES otherwise.

Consumer Complaint: The Fair Credit Reporting Act ( 15 U.S. Code 1681 ) says ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. So whenever there is a violation under the FCRA, it impairs the efficiency of the banking system. This is a violation of my privacy with my consumer report, since I control what is listed and what is not. In the event that any accounts are reported without my written consent, that is considered identity theft. This is a violation of both 15 U.S. Code 1681b ( 2 ) and 15 U.S. Code 1681c-2. This leads way to civil liability against the credit reporting agency for negligent and willful noncompliance under 15 U.S. Code 1681n, which allows for {$1000.00} per violation, for account listed without my expressed written consent.
