Issue: Trouble using the card
Subissue: Trouble using the card to spend money in a store or online
Consumer Complaint: I received an American Express pre-paid online gift card in the amount of XXXX. I tried to use the card at a number of online merchants, XXXX, XXXX XXXX, XXXX, XXXX. The card was declined at every merchant where I tried to use it. The card was activated and there were sufficient funds. I called American Express on XX/XX/23 and XX/XX/23 to request assistance. They indicated that the card was being declined because the merchant was marked as fradulent in the American Express system. Every merchant where I tried to use that card was declined. They indicated that I should just keep trying to use it until I found a merchant where it was accepted. They could not provide the name of a merchant or a list of merchants that would accept the card. The merchants were not declining the card, it was american express declining the transactions because they felt the merchants were fradulent. I tried a second time to get help from Amex and was transferred to a " supervisor '' who after an hour had still not picked up their phone. The card is unusable. Amex has the XXXX and will not provide assistance on how it can be used.

Issue: Improper use of your report
Subissue: Reporting company used your report improperly
Consumer Complaint: The Fair Credit Reporting Act ( 15 U.S. Code 1681 ) says ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. So whenever there is a violation under the FCRA, it impairs the efficiency of the banking system. This is a violation of my privacy with my consumer report, since I control what is listed and what is not. In the event that any accounts are reported without my written consent, that is considered identity theft. This is a violation of both 15 U.S. Code 1681b ( 2 ) and 15 U.S. Code 1681c-2. This leads way to civil liability against the credit reporting agency for negligent and willful noncompliance under 15 U.S. Code 1681n, which allows for {$1000.00} per violation, for account listed without my expressed written consent.

Subissue: Sued you in a state where you do not live or did not sign for the debt
Consumer Complaint: Dear Sir/Madam, I am writing to you to lodge a formal complaint against XXXX XXXX XXXX regarding their detrimental impact on my financial well-being and overall quality of life. The actions taken by your company have resulted in significant hardships, including threats of legal action and potential damage to my credit score. I strongly believe that these actions are not only in violation of consumer protection laws and regulations but also constitute illegal practices, such as the unauthorized purchase and resale of my debt without any proof of my agreement to such obligations. It is imperative that your company provides conclusive evidence demonstrating my consent to the acquisition and subsequent resale of my debt. The absence of any record of my agreement renders this process completely illegal. I demand transparency in this matter and an immediate cessation of any attempts to resell the aforementioned debt back to me. Moreover, I am appalled by the threats your company has made, including threats of legal action and adverse effects on my credit. These actions not only violate consumer laws but also disregard ethical practices expected from a reputable organization. The following is an overview of the laws and codes that your company has blatantly violated : Violation of Consumer Laws and Codes : a. Fair Debt Collection Practices Act ( FDCPA ) [ 15 U.S.C. 1692 et seq. ] : Your company 's actions, including threats of legal action and credit damage, violate the FDCPA, which protects consumers from abusive debt collection practices. b. Fair Credit Reporting Act ( FCRA ) [ 15 U.S.C. 1681 et seq. ] : By reporting inaccurate and unjustified negative information on my credit report, your company has violated the FCRA, which mandates fair and accurate credit reporting. c. New Jersey Fair Credit Reporting Act [ N.J.S.A. 56:11-33 et seq. ] : Your actions are also in violation of the New Jersey Fair Credit Reporting Act, which safeguards consumers from unfair and inaccurate credit reporting practices. I kindly request that you thoroughly investigate the details outlined in this complaint and take immediate steps to rectify the situation. Furthermore, I expect you to promptly provide a written response acknowledging the receipt of this complaint and informing me of the actions your company intends to take to address the issues raised herein.
