Pursuant to this title and subchapter, Ally Financial XXXX has unlawfully collected XXXX completed payments from myself, the consumer, and directly applied such payments to this debt from the date or XXXX XXXX, XXXX until XX/XX/XXXX. Ally Financial XXXX is in violation of XXXX usc XXXX ( d ), Ally Financial XXXX has contacted me multiple times in attempt to collect this alleged debt. Consumer Complaint: I XXXX XXXX XXXX XXXX entered into a consumer credit transaction with Ally Financial on XX/XX/2019. A consumer credit transaction is a transaction in which a finance charge is involved. Pursuant 15 USC 1605 a finance charge is the sum of all charges in a consumer credit transaction and given my knowledge of this, I was not expecting to receive bills. Shortly thereafter I started receiving bills which is a violation of 15 USC 1692b. In addition, the bills contained false and misleading information which is a violation of 15 USC 1692e, and bill contained abusive verbiage which is a violation of 15 USC 1692d. Also, at no point since entering this consumer credit transaction have I been advised of my right to rescind nor have I received any documents pertaining to such, which is a violation of 15 USC 1635.

Consumer Complaint: In XX/XX/2021 an inadvertent late posting was posted to my mortgage account, when I contacted XXXX XXXX Corporate they corrected the incorrect late posting, I subsequently reviewed my credit reports with XXXX, and I discovered multiple unauthorized and/or fraudulent inquires listed on my credit reports. I contacted the Credit Bureaus and explained I may be a victim of identity theft, these inquires are not mine. After contacting the credit bureaus, I discovered in XXXX the credit bureaus were now reporting me as deceased and froze my credit profile, now in XX/XX/2021 I discovered a new fraudulent account ( Ally Financial ) listed on my credit reports. I'm XXXX years old, this has been extremely stressful and emotionally draining. I'm reaching out to the CFPB for help, I've contacted the credit bureaus about the fraudulent inquiries and Ally Financial and they have not removed this incorrect/fraudulent information from my credit reports, also Ally Financial has been unresponsive to my disputes of this fraudulent posting on my personal credit profile.

Consumer Complaint: I am not going to deny that Ally Financial helped me in the past when I found myself in a financial crisis. After losing my job on XX/XX/XXXX, I managed to pay the installments of both vehicles up until XX/XX/XXXX. During the pandemic, Ally was supposed to give me 90 days extension on both of my vehicles. My XXXX XXXX was covered but they failed to do it on my wife 's XXXX. Collectors from said financial institution called me unstop and no matter what I told them they kept stressing me out daily. None of the collectors did their job properly because threats about taking my vehicles were constantly made and I had to repeat myself over and over because they did not put notes in the system about my prior communications and every day, different person kept calling me. In XX/XX/XXXX, I got into a very heated argument with a collection representative who would not understand that I did not have the money and I even told him that I could give him a check but it was not going to do the business any good since I did not have the funds in my checking account. The conversation got so intense that when he mention that he was coming to get the XXXX because it was so far past due, I lost my head and told him that if he was to put one foot in property, I was going to kick his behind. I proceeded to call Ally to complaint about the collector 's attitude, I was told by a supervisor that she will take action and promised me that it will never happen again. The very next day in the morning, he called me again I hang up on him. 2 or 3 days later, the XXXX got repossessed and I received a call from a XXXX area call number and when I answered the person on the other side just giggling, and I am almost positive that it was him that called. I have spoken with, who I thought was a professional person, all I know that her name was XXXX, who also question why the extension was not applied to the XXXX. After I mentioned to her that I did the math for both vehicles and I was just amazed that that the interest rate in both vehicles were so high and the term of the loans were so long and that so far I payed between {$30000.00} and {$40000.00} for both cars, she sent me a letter practically putting all the blame on XXXX XXXX, since I signed the contract with them and they had nothing to do with it. After that letter, my accounts were taken out of the system so I could not make a payment on line, they erased most of the important email communications, thank God a got copies, I could not use the internal mail to present to them my concern, presenting some system error, I recorded that on my phone. Called XXXX and left a message asking her to provide me a copy of the lawyers letter, since my briefcase was stolen, they never responded and I was not aware that I was supposed to be in court on XX/XX/XXXX because I was being suit by Ally, papers were never served, and my understanding was they were supposed to do the whole process again and here I was waiting to be served and this is the last drop in the glass, they repossessed both of my vehicles putting in jeopardy my wife 's and my job. I HAVE DONE EVERY SINGLE THING POSSIBLE TO NEGOTIATE THE CONTRACT WITH THIS FINANCIAL INSTITUTION AND THEY DECIDED NOT TO ANSWER TO ANY OF MY REQUEST. It was not that I did not want to pay, I wanted to re-negotiate the contracts because I was not about to pay close to {$80000.00} for both vehicles and they would not do it. After reading your report of the examination done by CFBP and the Department of Justice ( DJ ) filed on XX/XX/XXXX, now I understand how Ally works manipulating the system and violating Section 701 ( a ) of the ECOA in coordination with the dealerships and targeting XXXX American, XXXX and XXXX consumers, who have to pay higher interest rate in a longer term contracts. Furthermore, I was researching the internet and Ally is also had law suit in Missouri where they have to pay a large amount for illegal repossession of vehicle and collection procedures. With that been said, I am reaching out to you for your assistance and asking to please look into my case, hoping there will not be other consumers affected as I am right now.

Consumer Complaint: We signed closing documents with Ally Bank while in XXXX on a XXXX condo. Days later we were informed by Ally that the closing was void because they failed to provide a lawyer at signing which is XXXX law. We closed again several weeks later and continued paying both the original lender and then the new lender after the second, official closing. We then started getting bills from XXXX XXXX for the original failed closing. They insisted the original closing was valid and refused to help us. Ally also failed to help us. My credit score now has dropped by around 100 points due to XXXX XXXX showing late and missed payments on the fraudulent mortgage. This is the only negative thing ever on my credit report.

Due to the Corona Virus Pandemic, we are all facing which has me sitting still at home and I saw the recent news about the multiple XXXX Data breaches. I decided to look at my credit reports from the 3 major credit bureaus and found that someone had used my Identity. I have no idea how the theft took place. I also have no knowledge of any suspects. I did not receive any money, goods, or services as a result of identity theft. I contacted the Credit Bureau and told me to file an Identity Theft Report which I am doing.
