Consumer Complaint: I booked a trip to XXXX, XXXX on the XXXX website. I made three payments, the first payment was on XX/XX/2020 in the amount of {$190.00} ( BB & T checking account ). The second payment was made on XX/XX/2020 in the amount of {$430.00} ( BB & T checking account ). The third payment was made XX/XX/2020 in the amount of {$430.00} ( XXXX XXXX credit card ). Due to the Covid 19 pandemic XXXX cancelled the reservation on XX/XX/2020. I contacted BB & T and XXXX XXXX XXXX to file a claim so that my money could be refunded. I attached the e-mail from the XXXX site stating that they cancelled the reservation due to the Covid 19 pandemic. BB & T and XXXX XXXX denied my claim and told me that I would have to dispute the claim directly with XXXX I have tried to reach XXXX via telephone ( XXXX ) and the website but neither has worked. How am I supposed to dispute something with a company that I can not contact.

Consumer Complaint: I was recently modified with my Lender Suntrust. In the meantime they filed lis pendens which meant my private information became public in county records and XXXX and I have received a lot of solicitations. One particular concerns me because they called me pretending to be the mortgage company and because I am in the industry I knew better and they have called me 3 times now. The number they call from is XXXX Today I told them that I was going to report them and they used profanity back to me. My fear is that they are making these calls to consumers who aren't in the business and don't know the laws and are scamming them. Please tell me who to contact or how I can be of further assistance. Consumer Complaint: In XXXX I opened an account with Suntrust in XXXX, Florida. Two weeks after the account was opened they automatically closed my account and I didnt know the reason why. For the past 6 years I have been trying to open accounts with different banks only for them to close out my account and tell me that Suntrust was the root of my problem. XXXX XXXX XXXX informed me that Suntrust put an AFX out which give banks a red flag on my name and I didnt understand the reasoning. Over the years Ive been trying to get answers and on XX/XX/XXXX I found out I was a victim of identity fraud. Someone tried to cash false checks on that account. I tried to dispute it with Suntrust and the told me I couldnt because my account is closed. Im very hopeless and not having a bank account or able to get an account has hindered me over the years. If there is any help I can get from this horrific nightmare I would appreciate it. I am a victim and it has really cost me from being able to grow and have things financially and emotionally

Consumer Complaint: I am a new mortgage customer of SunTrust, soon to be Truist. Our mortgage was was purchased by SunTrust from XXXX XXXX XXXX. The account was setup on autodraft. On the first month SunTrust took mortgage payment plus an additional {$5000.00} which was not authorized.. We called their office immediately and they said it was a mistake but they couldn't do anything. After discussion operator gave a fax number and said we could send copy of our bank statment showing they had taken two payments. Operator could see clearly they had deducted an additional {$5000.00} but refused to fix the issue.

Violation of the ORDER OF THE GOVERNOR OF THE STATE OF MARYLAND NUMBER XXXX AMENDING AND RESTATING THE ORDER DATED XX/XX/XXXX TEMPORARILY PROHIBITING EVICTIONS OF TENANTS SUFFERING SUBSTANTIAL LOSS OF INCOME DUE TO COVID-19, AND ADDITIONALLY PROHIBITING CERTAIN REPOSSESSIONS, STOPPING INITIATION OF RESIDENTIAL MORTGAGE FORECLOSURES, PROHIBITNG COMMERCIAL EVICTIONS, AND ALLOWING SUSPENSION OF CERTAIN LENDING LIMITS. XX/XX/XXXX RE : Request for Deficiency Review and Denial of Entitlement to Sun Trust Bank Due to Illegal Practices and Procurement of Repossession : Collateral : Sun Trust Loan # XXXX ; Collateral Description XXXX XXXX XXXX XXXX XXXX Issue I am a resident of the State of Maryland and have recently encountered critical economic hardship and loss and dissolution of my business, XXXX, XXXX. As a result of the hardship, I was no longer able to afford the vehicle. For the reasons documented in this correspondence, I am requesting a Deficiency Review and Denial of Entitlement to Sun Trust Bank Due to Illegal Practices and Procurement of Repossession for Collateral : Sun Trust Loan # XXXX ; Collateral Description XXXX XXXX XXXX XXXX XXXX. XXXX XXXX, Maryland State Governor issued an order dated XX/XX/XXXX, that extends its temporary prohibition on repossession of certain personal property. For an entity, it includes lost or reduced business, required closure or loss of employees. In this case, XXXX XXXX, was dissolved due to COVID-19 and impacted my ability to sustain services for the business which impacted the payment for the car/note repossessed. The Orders prohibition on certain repossession due to COVID-19 suspended any self-help remedy under the Maryland Commercial Law Code or any rule or regulation that would permit a creditor to repossess any car, truck or personal property used as a residence until the state of emergency is terminated and the health emergency is rescinded. For the duration of the state of emergency, the Amended and Restated Order extends the Substantial Loss of Income protections from eviction to residential and commercial tenants alike, and provides for a blanket suspension of self-help repossession remedies for vehicles and personal property that serves as residence and a prohibition on the initiation of residential foreclosures. In addition to TITLE 14 OF THE PUBLIC SAFETY ARTICLE, AND IN AN EFFORT TO PROTECT THE PUBLIC HEALTH, WELFARE, AND SAFETY Order of XXXX XXXX XXXX, XXXX, GOVERNOR OF THE STATE OF MARYLAND Sun Trust Bank has not followed The Order of the Governor of the State of Maryland dated XX/XX/XXXX and The Voluntary Surrender Agreement I signed on XX/XX/XXXX does not adequately document that I agreed to waive my rights, protections, or defense relating to cancellation of the Contract with Sun Trust Bank because I documented that I was open to legal review in reference to not waiving my rights ( left margin ) of the document. Background Attempt to Seek Financial Assistance On XX/XX/XXXX, I contacted Sun Trust, Bank at XXXX and XXXX, to discuss my concerns regarding loan payments on the vehicle. I requested a loan rewrite ( Consumer Auto loan Rewrite Program ), lowered interest rate/refinance ( 3.82 current rate ), and loan payment deferral option for three months as stated by the representative. I was informed that since my loan was less than ( 9 ) month mature, I was unable to qualify for a loan payment deferral option for three months. The vehicle was not seized, I voluntarily returned the vehicle to the lender Sun Trust Bank. There was no personal property left in the Vehicle. I was informed that it would not be until XX/XX/XXXX that I could be considered for any extension. Sun Trust Bank/creditor was not willing to work with me. I was not able to negotiate a delay in my payments or a revised schedule of payments. I was unable to reach an agreement to change my original contract. Sun Trust Bank, my creditor or lessor refused to accept late payments or make other changes in my contract. I inquired about the voluntary repossession, as I did not agree to it, I had no other choice since Sun Trust Bank denied any opportunity to assist me with my request. Coercion On XX/XX/XXXX, I contacted Sun Trust Bank at XXXX to discuss the voluntary repossession option for the vehicle. I spoke with XXXX on a recorded call at XXXX XXXX I was placed on hold and by XXXX XXXX. I had the opportunity to speak with her. I inquired about the amount of money that could be obtained for the vehicle, she said, Sun Trust Bank asks for the XXXX XXXX XXXX XXXX at an auction. I provided my name, social security number, ( last four digits ), and I provided the reason for the surrender was due to a financial hardship. At no time did the customer service representative indicate the debt could be halted due to the following : I was advised by XXXX ( CSR ) that I could take the vehicle to any Sun Trust Bank branch and surrender it inside the bank. I was informed ( by XXXX ) that the next steps in the process would include : A request for pickup of the vehicle would be made, towing fees, administrative fees, and storage would be applied. The vehicle would be taken to a local lot. I would receive a correspondence ( faxed or mailed ) within 7-10 business days. My credit report would reflect a repossession. - Currently all three Credit Unions have been reported negatively. The vehicle would be sold at auction. Any deficiency on the loan would be billed to the borrower and at that time, any recovery balances would result in payment arrangements/modifications to collection of the debt. I inquired about the COVID-19 pandemic and the impact on the process and a reasonable timeframe of this process based on the public health pandemic. ( No clear answer could be provided ) I was advised that if I decided to voluntarily return the vehicle, that once I arrived at the bank Branch, give Sun Trust Bank a call and I would be afforded the opportunity to speak with a Customer Service Representative at that time. ( This never occurred ) ( Spoke with my Creditor or Lessor ( XXXX and XXXX ( CSR ) On XX/XX/XXXX I arrived at the Sun Trust Bank at XXXX XXXX. because I realized that I could not afford the vehicle anymore, I utilized the option of an alleged voluntary repossession. I returned the vehicle to the following address after calling and speaking with XXXX XXXX, Sun Trust Branch XXXX XXXX XXXX XXXX, XXXX, Maryland XXXX Upon my entry into the branch, Mr. XXXX XXXX requested my license and telephone number to the repossession division. I informed him that I had spoken to XXXX and provided him with the XXXX number as advised by her. I was requested to call if I made the decision and that I would be able to speak with her directly. Mr. XXXX XXXX contacted the customer service representative. I am unaware of who he spoke with, and at no time was I afforded the opportunity to speak with the representative over the telephone, however the individual requested that he provide me with the alleged Voluntary Surrender Agreement. Violation of Legal Rights & Due Process The document was never reviewed by XXXX XXXX or the representative over the telephone and I read the document and based on the contents of the document, I notated on the left margin that me waiving my right to a hearing was open to legal review because I did not agree. Upon reading through the Voluntary Surrender Agreement on XX/XX/XXXX, I initialed, underlined, and documented that waiving my right to a hearing, I was open to legal review because of the following concerns I initialed in disagreement : Sun Trust Bank to dispose of the property in its sole discretion. The signer appoints Sun Trust Bank as their attorney in fact to transfer the title to the property. ( I was in the possession of the title and was informed that the bank did not need it, I did not need to sign it over to them, and that I could keep the title. The document denotes that I waive any claims that I have against Sun Trust Bank and I did not waive any claim. I do not have the right to reinstate the contract- I requested to work with Sun Trust Bank on XX/XX/XXXX and XX/XX/XXXX and was denied any right to work with the Sun Trust Bank ( as indicated on the Voluntary Surrender Agreement ) before I decided to return the vehicle. At no time did XXXX XXXX or the customer service representative ( unknown ) indicate the debt could be halted due to the following : III. Prohibition on Certain Repossessions. To the extent any statute, rule or regulation of the State of Maryland or any political subdivision would permit a Creditor to repossess any automobile, truck, or Chattel Home by self-help ( including, without limitation, CL XXXX, XXXX, XXXX, XXXX, or XXXX ), such statute, rule, or regulation is hereby suspended until the state of emergency is terminated and the catastrophic health emergency is rescinded. The Order of the Governor of the State of Maryland dated XX/XX/XXXX. In fact, they proceeded with the process through Phase I of the Order issued by Governor XXXX XXXX. PUBLIC SALE CORRESPONDENCES/NOTIFICATIONS III. Prohibition on Certain Repossessions. To the extent any statute, rule or regulation of the State of Maryland or any political subdivision would permit a Creditor to repossess any automobile, truck, or Chattel Home by self-help ( including, without limitation, CL XXXX, XXXX, XXXX, XXXX, or XXXX ), such statute, rule, or regulation is hereby suspended until the state of emergency is terminated and the catastrophic health emergency is rescinded. Letter # 1 On XX/XX/XXXX, I contacted SunTrust Bank after I received the initial letter outlining the next steps in the process. I spoke to MsXXXX XXXX at the XXXX telephone after I received the letter provided in the letter. The letter outlined SunTrusts Notice to Plan to Sell the Property at Public Sale on XX/XX/XXXX. If I had traveled against Governors Orders, I would have attended and financially inconvenienced myself for no reason. However, the letter indicated the vehicle would be sold for Public Auction at : Address/Time- XXXX XXXX, XXXX XXXX , XXXX , Virginia . The auction is located 1 hour and 30 minutes from my home address, out of the State of Maryland, scheduled on a workday of which I could not take leave, scheduled during the pandemic, financial hardship, safety concern, and mandatory Governors Orders for Maryland residents to stay home, and only essential employees should be on travel. Out of state travel is prohibited for general citizens in the State of Maryland until Governor XXXX lifts the ban and the orders. For these reasons, I did not attend the public auction. Letter # 2 On XX/XX/XXXX, I received a second letter dated for XX/XX/XXXX. The letter outlined SunTrusts Notice to Plan to Sell the Property at Public Sale on XX/XX/XXXX. If I had traveled against all orders, I would have attended and financially myself inconvenienced for no reason. However, the letter indicated the vehicle would be sold for Public Auction at : Address/Time- XXXX XXXX, XXXX XXXX , XXXX , Virginia . The auction is located 1 hour and 30 minutes from my home address, out of the State of Maryland, scheduled on a work day of which I could not take leave, scheduled during the pandemic, financial hardship, safety concern, and mandatory Governors Orders for Maryland residents to stay home, and only essential employees should be on travel. However, the letter indicated the vehicle would be sold for Public Auction at : Address/Time- XXXX XXXX, XXXX XXXX , XXXX , Virginia . The auction is located 1 hour and 30 minutes from my home address, out of the State of Maryland, scheduled on a work day of which I could not take leave, scheduled during the pandemic, financial hardship, safety concern, and mandatory Governors Orders for Maryland residents to stay home, and only essential employees should be on travel. Out of state travel is prohibited for general citizens in the State of Maryland until Governor XXXX lifts the ban and the orders. For these reasons, I did not attend the public auction. Letter # 4 On XX/XX/XXXX, I received a fourth letter mailed to my home dated for XX/XX/XXXX. The letter outlined SunTrusts Notice to Plan to Sell the Property at Public Sale on XX/XX/XXXX. If I had traveled against all orders, I would have attended and financially inconvenienced myself for no reason. Address/Time- XXXX XXXX, XXXX XXXX , XXXX , Virginia . The auction is located 1 hour and 30 minutes from my home address, out of the State of Maryland, scheduled on a work day of which I could not take leave, scheduled during the pandemic, financial hardship, safety concern, and mandatory Governors Orders for Maryland residents to stay home, and only essential employees should be on travel. Out of state travel is prohibited for general citizens in the State of Maryland until Governor XXXX lifts the ban and the orders. For these reasons, I did not attend the public auction. Letter # 5 On XX/XX/XXXX I received both the regular and certified letters dated for XX/XX/XXXX outlining the explanation of calculation of deficiency or surplus. The letter also indicates that I broke my promise in their agreement under the loan identified. I disagree with the assessment as I reached out to Sun Trust, Bank to seek assistance in this matter and I was denied any relief in the process to maintain the vehicle. Legal Rights As outlined in the Order of the Governor of the State of Maryland Number XXXX Amending and Reinstating the Order dated XX/XX/XXXX due to COVID-19, prohibiting certain repossessions. Section III. Prohibition on Certain Repossessions. To the extent any statute, rule or regulation of the State of Maryland or any political subdivision would permit a Creditor to repossess any automobile, truck, or Chattel Home by self-help ( including, without limitation, CL XXXX, XXXX, XXXX, XXXX, or XXXX ), such statute, rule, or regulation is hereby suspended until the state of emergency is terminated and the catastrophic health emergency is rescinded. And. The XXXX Maryland Code, COMMERCIAL LAW, TITLE 12 - CREDIT REGULATIONS, Subtitle 10 - Credit Grantor Closed End Credit Provisions, Section 12-1021. Repossession : the provisions of this section, including the requirement of Sun Trust Bank furnishing a notice following through with repossession, have not been adequately followed by Sun Trust Bank, as outlined in the Law and Order in addition to the following : Sun Trust Bank intentionally breached the deficiency judgment. Sun Trust Bank/creditor was not willing to work with me prior to me returning the vehicle to the bank. I was not able to negotiate a delay in my payments or a revised schedule of payments under my current contract. Sun Trust Bank, my creditor or lessor refused to accept late payments or make other changes in my contract. I inquired about the voluntary repossession, I did not agree to it, I had no other choice. Sun Trust Bank deleted my account in the application effective XX/XX/XXXX and I am unable to view the unpaid balance at the time the goods were repossessed. I requested the information on XX/XX/XXXX. On XX/XX/XXXX, I inquired about the COVID-19 and the impact on the process and a reasonable timeframe based on the public health pandemic and I do not believe sending a certified letter on the 10th day to arrive at my residence after XXXX XXXX was advantageous or legally and professionally responsible on the part of Sun Trust Bank. On XX/XX/XXXX, I received a subsequent letter documenting a public auction would commence in the State of Virginia, due to the pandemic and the Maryland State Governor who mandated that to all non-essential business, close, this was not an option. On XX/XX/XXXX, I received a subsequent letter documenting a public auction would commence in the State of Virginia, due to the pandemic and the Maryland State Governor who mandated that to all non-essential business, close, this was not an option. On XX/XX/XXXX, I received a subsequent letter documenting a public auction would commence in the State of Virginia, due to the pandemic and the Maryland State Governor who mandated that to all non-essential business, close, this was not an option. On XX/XX/XXXX, I received a subsequent letter documenting a public auction would commence in the State of Virginia, due to the pandemic and the Maryland State Governor who mandated that to all non-essential business, close, this was not an option. Sun Trust Bank never afforded me the opportunity to make provisions to advise me of any changes that may occur based on the delivery time and mechanism for the COVID-10 Maryland State pandemic ( Agent ) as to who was delivering the certified letter, that I never signed for, it was placed in an unopened mailbox. Obtaining the certified letters, no communication regarding the letters or timeframe of delivery based on the pandemic, currently has compromised my safety and well-being as a certified mail card was left in my mailbox. I was advised that if I decided to voluntarily return the vehicle, that once I arrived at the bank Branch to give Sun Trust Bank a call and that I could speak with a Customer Service Representative at that time. ( This never occurred ) The Voluntary Surrender Agreement : The document was never reviewed by XXXX XXXX or the representative over the telephone with me and I read the document and based on the contents of the document, I notated on the left margin that me waiving my right to a hearing was open to legal review because I did not agree. Upon reading through the Voluntary Surrender Agreement, I initialed, underlined, and documented that waiving my right to a hearing, I was open to legal review because of the disagreement of the terms I also initialed in disagreement. The Voluntary Surrender Agreement provided by Sun Trust bank does not allow you to reinstate your loan, and I read the document and based on the contents of the document, I notated on the left margin that me waiving my right to a hearing I was open to legal review because I did not agree. The notice of right to redeem or rights upon resale was not sent certified to the following address : XXXX XXXX XXXX XXXX until XX/XX/XXXX, ( 10 ) days after the - Required ; contents.- Within 5 days after the credit grantor repossesses ( voluntarily ) the tangible personal property the credit grantor shall deliver to the consumer borrower personally or send to him at his last known address by registered or certified mail, a written notice. The unpaid balance at the time the goods were repossessed- On XX/XX/XXXX, I contacted Sun Trust Bank after I received the certified letter ( 2nd ) attempt per my request for the letter to be delivered outlining the next steps in the process. I spoke to Ms. XXXX at the XXXX telephone number provided in the letter. I was verbally informed that the payoff for the vehicle was good through XX/XX/XXXX for the total amount of {$44000.00} and that this information would be mailed to me within 3-5 business days to my home. However, the letter from SunTrust Bank dated for XX/XX/XXXX documented that the outstanding balance was {$44000.00}. SunTrust Bank neglected to consider the financial hardship and the fiscal irresponsibility ( gas, tolls, potential citations, car notes, and legal fees ) of the consumer by scheduling the sale of the vehicle during the very stressful pandemic/COVID-19 by scheduling and inconveniencing the borrower by offering an out of State public sale and expectation for an 1.5 hour drive to rebid on the vehicle. SunTrust Bank disregarded the consumers employment by attempting to place the consumer in a negative position with the employer by risk of a criminal citation which could incur legal fees, and livelihood if the employer is notified of any charges received by employees for any reason by the State of Maryland during the Stay Home Orders as mandated by Governor XXXX. ( Travel out of state ) SunTrust Bank purposefully inconvenienced the consumer by scheduling a public auction/sale of the vehicle that was unanticipated in travel as outlined 1 hour and 30 minutes from my home and out of state. SunTrust Bank compromised the safety and potential criminal wellbeing of the consumer by assigning the public sale of the vehicle out of the State of Maryland, further compromising the medical safety and health of the consumer, in addition to placing the consumer at risk for confrontation by law enforcement for being on major highways during the Maryland State and Virginia Commonwealth Governors Stay Home Orders. SunTrust Bank purposefully mislead the consumer by imposing The Voluntary Surrender Agreement signed on XX/XX/XXXX does not adequately document that I agreed to waive my rights, protections, or defense relating to cancellation of the Contract with Sun Trust Bank because I documented that I was open to legal review in reference to not waiving my rights and I did not accept any responsibility for any balances due because I believe Sun Trust Bank fraudulently advised me and manipulated the situation. Sun Trust has adversely reported the repossession to the following credit bureaus : XXXX XXXX, XXXX, and XXXX and as a result my FICO score has decreased considerably and ( 2 ) creditors have closed credit accounts, in addition, and prior to the dissolution of my business, all of my secured and unsecured debt was paid at one-hundred percent on time. As outlined in the Regulation, if the provisions of this section, including the requirement of furnishing a notice following repossession are not followed, the credit grantor shall not be entitled to any deficiency judgement under the loan agreement. In accordance with the XXXX Maryland Code, COMMERCIAL LAW, TITLE 12 - CREDIT REGULATIONS, Subtitle 10 - Credit Grantor Closed End Credit Provisions, Section 12-1021. Repossession : The credit grantor shall furnish to the consumer borrower a written statement which shows the distribution of the proceeds : The proceeds of the sale of the goods- {$28000.00} The remaining deficiency balance, if any, or the amount due the buyer- {$16000.00} All expenses incurred because of the sale- ( Retaking and Storing the Collateral ) {$330.00} The actual and reasonable cost of the sale- {$410.00} To date, Sun Trust bank did not furnish the following : The unpaid balance owing under the agreement at the time the property was repossessed- I had to request this information in writing, see Letter dated, XX/XX/XXXX, had I not inquired, I would not have received it. On XX/XX/XXXX, I contacted Sun Trust Bank after I received the certified letter outlining the next steps in the process. I spoke to Ms. XXXX at the XXXX telephone provided in the letter. I asked her for this information, and she informed me that all auctions are private, and the sale is not discussed, and that Sun Trust Bank requests the XXXX XXXX XXXX XXXX at the auctions. Ms. XXXX also informed me during the telephone conversation that I would not be able to obtain that information. Any statement as to the condition of the goods at the time of repossession which would cause their value to be increased or decreased above or below the market value for goods of like kind and quality- Not provided. RESOLUTION & RELIEF I am currently challenging the creditor, Sun Trust Bank for any difference between what I owe on my contract ( plus certain expenses ) and what my creditor received for reselling the vehicle plus any other fees I owe under the contract for the following reasons : Sun Trust Bank failed to abide by the ORDER OF THE GOVERNOR OF THE STATE OF MARYLAND NUMBER XXXX AMENDING AND RESTATING THE ORDER DATED XX/XX/XXXX TEMPORARILY PROHIBITING EVICTIONS OF TENANTS SUFFERING SUBSTANTIAL LOSS OF INCOME DUE TO COVID-19, AND ADDITIONALLY PROHIBITING CERTAIN REPOSSESSIONS, STOPPING INITIATION OF RESIDENTIAL MORTGAGE FORECLOSURES, PROHIBITNG COMMERCIAL EVICTIONS, AND ALLOWING SUSPENSION OF CERTAIN LENDING LIMITS on XX/XX/XXXX, however, SunTrust Bank proceeded. Sun Trust Bank intentionally breached the deficiency judgment because Sun Trust Bank failed to sell the vehicle in a commercially reasonable manner based on the pandemic/COVID-19 and the Governor XXXX Marylands Stay Home Order which prevented any opportunity for me to attend any private auction. ( 4 ) Notifications for Out of state travel. Sun Trust Bank, in contrast to this order forwarded me ( 4 ) letters documenting that all processes continue and furnished a deficiency notice during the pandemic contrary to adherence to the Order of the Governor of the State of Maryland Number XXXX Amending and Reinstating the Order dated XX/XX/XXXX due to COVID-19, and subsections, under the XXXX Maryland Code, COMMERCIAL LAW, TITLE 12 - CREDIT REGULATIONS, Subtitle 10 - Credit Grantor Closed End Credit Provisions, Section 12-1021. Repossession and the order that all repossessions cease and desist within the State of Maryland during this time of economic despair. Sun Trust Bank did not adhere to the XXXX Maryland Code, COMMERCIAL LAW, TITLE 12 - CREDIT REGULATIONS, Subtitle 10 - Credit Grantor Closed End Credit Provisions, Section 12-1021. Repossession by following the law at one hundred percent of the requirement of the credit grantor as outlined in this document because Sun Trust Bank did not provide the unpaid balance owing under the agreement at the time the property was repossessed, the purchaser 's name, address, and business address, the number of ( reasonable ) bids sought and received, and any statement as to the condition of the goods at the time of repossession which would cause their value to be increased or decreased above or below the market value for goods of like kind and quality. For all these reasons outlined in this correspondence : Sun Trust Bank should not be entitled to any deficiency judgment to which they would be entitled under the loan agreement. I am respectfully requesting that the Commissioner of Financial Regulation review this information and decide concerning the private sale and whether the sale was or was not accomplished in a legal, reasonable, and ethical manner. It is my hope that after the Commissioner of Financial Regulation review this information and render a decision concerning the private sale and whether the sale was or was not accomplished in a legal manner and upon that determination, the Commissioner enter an order disallowing any claim for a deficiency balance to be allowable by Sun Trust Bank to the consumer. If such determination is made, upon that determination, may enter an order disallowing any claim for a deficiency balance, I am also requesting a thorough review by all applicable agencies identified on this correspondence in this matter who have the jurisdiction to do so and who may decide whether or not the mechanisms that Sun Trust Bank utilized to process a voluntary repossession, and private sale was accomplished in an appropriate legal and reasonable manner contrary to the Orders of Maryland State Governor XXXX and violations under the XXXX Maryland Code, COMMERCIAL LAW, TITLE 12 - CREDIT REGULATIONS, Subtitle 10 - Credit Grantor Closed End Credit Provisions, Section 12-1021. Repossession. I have provided documentation and a narrative regarding my concerns. Consumer Complaint: XX/XX/2020 I contacted Light Stream about applying for an auto loan. I submitted an online application that was completed with ease. XX/XX/2020 the application was submitted and I was contacted by the loan provider ( Light Stream ). I am an XXXX XXXX U.S. Military that is XXXX XXXX in XXXX. To complete business in America, I have to use my father 's phone number. He was contacted by a representative asking questions about my loan. He stated that I am in the military and stationed overseas ; his number is used to complete business when I can not be reached. I also give him permission to answer calls on my behalf. Still on XX/XX/2020 I was emailed by the representative stating I should call her for some questions. At this point, she already knew that I am not physically in the U.S. I called the number that was attached in my email and I explained to her that I am in the military, stationed in XXXX and I do not have a contact number in the United States. I gave her permission to contact my father and stated that he has the ability to answer questions on my behalf. As the conversation continued, I answered some questions about my application and was told I would receive a response within 24 hours. At this point the representative was told about my situation and me not being in the states physically. It was understood at this point that I was recommended by the dealership and was trying to purchase a car in the United States. XX/XX/2020 I received an email stating I was not approved for the loan. I called the company during their opening hours and spoke to a representative. It was then explained to me that Light Stream declined my loan because I am not physically in the USA. This completely went against everything I understood before. The representative I spoke to before the loan was declined clearly knew I was overseas and trying to purchase a car in the USA. At no point did she mention those guidelines or tell me my situation was against their policy. I continued to ask what my options were to get approved and I was constantly pushed to have a Co-signer or I would need to fly to the U.S. to make the purchase. If the policy would not allow me to be approved for the loan, then the representative should have mentioned that before asking me to confirm my application and processing the hard credit check. The representative in the beginning knew my situation as it was explained twice that my situation involves me being in XXXX and me purchasing a car while I am not physically in the USA. Additionally, nowhere on the application nor on the website does it state that the applicant must be in the U.S. If it does, it is not easily found. I attempted to email the company directly but none of the emails are reaching a representative. When I attempted to call the company, I was again pressured to find a co-sign for the loan. If the policy for this company demands the applicant be in the USA then the representative should not have continued with my application knowing my situation. Instead she did a hard check, declined my loan, and caused damage to my credit.
